Congress has no option: Michigan triggers Article V Constitutional Convention

By: Michael Lotfi

LANSING, Mich., April 4, 2014– Michigan’s recently passed resolution calling for an Article V convention of the states to amend the federal Constitution may have been the catalyst to finally put the process in motion. At the magic number of 34, Michigan joins multiple other states that have successfully passed a resolution calling for a federal balanced budget amendment (BBA). Tennessee passed its BBA resolution only a couple weeks before Michigan.

Michigan Senate Joint Resolution V calls upon Congress to allow Michigan to join other states in requesting an Article V convention of the states.

“A JOINT RESOLUTION to petition the congress of the United States to call a convention to propose amendments to the constitution of the United States to require a balanced federal budget.”

If nothing is done about the Federal Reserve a bba is a joke

I think the whole point of this convention is to get Americans to own the debt that is currently run up by private institutions like the Fed. They can only do this if we let them.

oops....I was going to say

oops....I was going to say something constructive, but see no reason to stick my neck out ...

I can't understand why anyone

I can't understand why anyone even argues about this issue.

THEY DON'T FOLLOW THE ONE WE HAVE NOW! WHY WOULD THEY FOLLOW A NEW ONE?
THEY DON'T FOLLOW THE ONE WE HAVE NOW!
THEY DON'T FOLLOW THE ONE WE HAVE NOW!

Am I crazy?

Of course, they are lying ...

... again. The balanced budget thing is just a cover, so that Republican voters are less likely to be vocal in opposing it.

The Constitution does not say that a convention can propose only a particular amendment. It says a convention is called for the purpose of proposing amendments (plural). The "balanced budget" is a rouse. It is meaningless. They don't need to indicate a reason to call a convention. They can just call it. But to be politically feasible, they are using the balanced budget to trick people.

And guess what else? They can also have the states call state conventions for ratification rather than have the state legislators do it, giving those legislators political cover for their evil.

"The Congress ... shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress ..."

I'll tell you exactly what they are trying to do. They want to get a convention, run by big government state legislators, who will propose several amendments. Once proposed, each individual amendment will have to be ratified by 3/4 of the states, but there will be NO TIME LIMIT. It might take a year, it might take 20 years, but they will have those damn things "out there" to be ratified eventually be enough states over time.

They want a NATIONAL SALES TAX. That is what Herman Cain's run in the primary was all about. It was a trial balloon to test the waters. They don't care about the 9% rate. They only care about getting it approved and the the amount will increase quickly.

They want to KILL THE RIGHT TO OWN FIREARMS. They will have some sort of fuzzy language that allows the feds to do that in a non-obvious way.

They want a lot more things, as well (too numerous to mention) that will effectively kill the primary thesis of the founding fathers that centralized government is a bad idea and that power should be decentralized.

Those who support this want a one-world government. Period.

And anyone who supports it and cannot think through to the implications of how it will turn out is a non-thinking, useful idiot. Period.

..and I would NOT be surprised if this originated in DEARBORN.

The link has gone dead.

The link has gone dead. Looks like the Ben Swan site pulled the article down.

not to up to date

on this stuff... does this mean the only thing up to change/create is a balanced budget amendment, or could other things be changed or revised such as the second amendment??

Everything would be up for grabs...

No telling what perversions would come out of it.

I'm not sure about you, but I don't remember ever signing the Constitution. The edicts of dead people aren't a substitute for my consent.

I don't think

even if a balanced budget amendment was passed, they wouldn't listen, but how about putting term limits on these idiots.

Had to happen at some point.

I think every state knows there is something wrong with the system and I guess it may take many different approaches to find the best solutions.

Why amend a constitution we dont follow anyway?

They are likely to build a balanced budget amendment that enshrines monetary inflation and gives the power to borrow and spend to the executive.

Séamusín

This would be a good time to let them know

that any attempt to support/move forward with Article V would result in NO support from VOTERS.

Call them.

Even if, by some miracle, only good things came of this...

...like the only thing they add is a BBA, I still think it's dangerous to have a constitutional convention. If it gets into public consciousness that these things produce good results, there can always be a 2nd one called ("we're going to do even more good this time!") where they lay the hammer on us. Again, if they want amendments, go though the amendment process. I don't trust the existing power structure to do right by the public.

Liberty4Me's picture

I agree. Such a path would

I agree. Such a path would certainly lead to the unraveling of the republic.

Regarding a BBA, I think they'd be happy to have one. Then, they can raise taxes to provide for their agenda (i.e. the bad way to balance a budget) and claim "Hey, it's the law now. This is what you all demanded."

READ the BBA language.

There is nothing good in it.

It INCREASES the indebetedness level 5%.

It puts official authorization of the federal debt into the US constitution.

It allows a BRAND NEW national sales tax to be passed by a simple majority of congress.

It does NOT require a balanced budged in the case of a "national emergency".

It takes the power of sequester out of Congress' hands and put it in the presidents hands.

So, help me understand please how there's anything good in the BBA.

I'm Sure You're Correct

I didn't mean that proposed BBA law (which I'm sure you're right that it contains new and evil stuff). I just mean a BBA in a generic sense.

no option????

like... they can't just ignore the Constitution??
Since when.

I oppose a convention

Tinkering with the 'most sublime constitution ever conceived by the mind of man', is folly. The country is sliding toward a chaos that cannot and will not be avoided. The millionaire political class that occupies the three branches of governance are picking the bones of a still withering corpse. You my dear friends are that corpse. How does it feel to be eaten alive? A 'convention' will open a Pandora's Box of changes, all harmful, and the sheeple will welcome them.

Fully Agreed

I just want the politicians to FOLLOW the constitution. If they want a balanced budget amendment then go through the process of amending the constitution. While they're at it, they should remove the income tax.

Michigan does stupid, it started in 1908.

In 1837, Michigan became a State. They borrowed $5 million for road and canals. They spent the money, but the public improvement produced no return on investment.

The improvements were sold for $2 million and the Michigan taxpayers were stuck paying for an asset Michigan no longer owned.

In the Early 1840s a law was passed prohibiting public financing of public works.

In 1850 Michigan Constitution made it unconstitutional for public funding of State projects.

On 1908 the prohibition was lifted.

Thanks. Civil debility, indeed.

History provides no evidence that public debt is ever for the general (universal) welfare.

The proposer of laws proposes self-authorization of debt and people accept it without historical proof. That's crazy!
