Splitting Up California Into 6 States Has Enough Signatures To Be On 2016 Ballot

(Reuters) - A long-shot effort to break California into six separate states got a boost on Monday, when the billionaire venture capitalist behind the proposal said he had gathered enough signatures to place it on the ballot in two years.

Timothy Draper, a founder of a Silicon Valley-based venture capital firm that has invested in Twitter, Skype and Tesla, among other companies, has been agitating for months for a ballot initiative to chop the most populous U.S. state into smaller entities.

"It’s important because it will help us create a more responsive, more innovative and more local government, and that ultimately will end up being better for all of Californians," said Roger Salazar, a spokesman for the campaign. "The idea ... is to create six states with responsive local governments - states that are more representative and accountable to their constituents."

Small problem

The constitution says no new state shall be formed from an existing state. (Yeah, I know about West Virginia. Things were even weirder back then.) There are only a couple of ways in which the constitution cannot be amended by a super-majority. This is one of them.

In order to pass a constitutional amendment allowing new Californias to spin off, it would take the approval of all 50 states, including the existing California. Danged unlikely.

If five of the new states are intending to secede, I reckon Mr. Obama would do a brisk Honest Abe on their butts.

Would require CA legislative consent

Per Article IV they could split up the state with consent of the CA legislature. And if Jefferson wanted to incorporate part of WA then they would require their legislative consent aswell.

Article IV Section 3 Clause 1:
"New States may be admitted by the Congress into this Union; but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress."

I want to know why the MSM is so dead set against this idea. You can see if you read articles about this they all have a negative slant. Take this Reuters article. It is ostensibly a balanced article as it includes a description of the plan, a quote from each side, and equal paraphrases from each side, but look at the language they use in their own descriptions:

I've lived in Redding for 8

I've lived in Redding for 8 years now. I am a firm supporter of the State of Jefferson movement. In our State legislature, the northern 11 counties have 1 representative. Los Angeles county alone has close to 30 I believe. Our voice is never heard. We are sick of it.

West Virginia

was formed by splitting Virginia into two parts. As I read the Constitution, approval by Congress and the state legislature makes this O.K. (I don't recall all the details.)

California voters may not have the final word. It appears that the California legislature has the final word.

As long as the new state is not surrounded by the "parent" state, i.e. within the jurisdiction, forming a new state from an existing states will work.

But ...

At the time West Va. became a state it was indeed part of the Confederate States of America a country that the USA had no control over ~ Save at the point of a bayonet

I hadn't considered that...

but nothing surprises me anymore. The State of Jefferson has been gaining some momentum, although I don't think there has been enough to warrant this as a plan to thwart it.

This Will Be Interesting

California's economy is very large.

The parts of it that are in agriculture are tired of the regulations heaped on them by the dense population centers.

I'll be on the border of another new state, if this happens, and I'm looking forward to shopping in a state with lower sales taxes.

I might even move into one that has lower income taxes.

This could be fun.

The only thing I don't like is the idea of calling my new state "Silicon Valley." I grew up in that valley (I'm in Diablo Valley, now), and it was all fruit and nut orchards and strawberry fields. We need a better name.

12 Senators

I'd rather keep California at two senators than twelve.

Actually...

California would have 12, but only 4 would likely have the annoying big government politics. Most of the non-LA/non-SF parts of California would favor smaller gov't politicians, so instead of 2 unfriendly senators you'd have 4 unfriendly senators potentially offset by 8 friendlier senators, which is a good shift in the balance of power.

Since the house of representatives is by population and California is pretty populated throughout even in rural areas, there would be no change in number of representatives in the house, at most 1 or 2 more due to rounding.

House members allocated by population

Dividing a state does not increase the net population of the state. You might get an extra member here or one less member there due to rounding error, but no real difference. This is only really an issue in states that have virtually no population like the dakotas or wyoming, and they have a minimum number of 1 representative.

And this means we would have a much smaller government in each portion of California, which is a net win for the states there.

By my math with 315 million people in the U.S.
there should be over 10 000 Representative in the house alone.

Am i to understand since we have around 500 members of the house that each member represents about 700 000 people

It seems we are not following the Constitution here for the correct allocation of representative in the house.

Although I cannot blame you guys for...

envisioning a scenario in which the fracturing of California resembles that of cancer cells metastasizing, I cannot help but conclude that neither of you are privy to California politics. If this assumption is false, then I apologize. However, I must make you aware that there are so many people in this state that have literally no representation, and in theory, it would be refreshing to have some.

Continuing with the cancer allusion, the regions at the helm in California are the Bay Area and Los Angeles County. As a resident of this state, it would be nice to isolate them, and prevent their ideology from metastasizing throughout the rest of the state.

I cannot help but take the bait when people advocate for smaller government in general, but then make California the exception to the rule because of some bumper sticker rationale.

The feds stole this money from users at Silk Road who were not committing aggression. Then Tim Draper bought these BTC. Thus, he is a buyer of stolen goods, although the feds don't see it that way for whatever logical reason.
