I Argued With State Tax Mercenary

There's nothing more painful than calling the IRS or state tax goons. I try to be nice. I try to remember that they're fallible human-beings. But the moment they starting getting a certain tone (like, "SIR YOU OWE THIS MONEY") I can't stand it..!

Today I called to ask why my "tax bill" had gone up $200. Of course they applied more arbitrary "fines or fees" and blah blah. I then asked her what moral and legal right they thought they had to HARASS me for this money?

She really couldn't answer.

She tried to answer, but it was incoherent.

A lot of gibberish. She even admitted - "I can't really explain it".

So then I decided to go on a monologue about liberty. Why not? I asked her to consider the immorality of her job. Harassing people to pay something they NEVER AGREED TO PAY. I asked her to think about the insanity of putting this on someones record (background check) which could could keep me from getting a job! Obviously, it would seem if you want people to pay this ransom, you should not make it harder for them to find a job. I laughed at this one because it was so absurd.

She was silent.

I'm not sure if this is something they hear often or not? But the way I look at it is this - If they're going to FORCE me to pay them, THEN THEY'RE GOING TO HAVE TO HEAR ME BITCH AND MOAN EVERY STEP OF THE WAY. These fucks are going to get every sermon on liberty I can think of.

And I suggest all of you do the same.

I always paid my fair share.. Didnt stop the IRS from billing me a 2nd time for taxes I already paid.. Evidently they make up their own rules as they go along...

The Federal Income tax is an excise tax. Excise tax and Privilege tax are synonymous. Exercising a Federal privilege is a taxable activity. If you don’t exercise a Federal privilege there is no taxable activity. Boeing makes jet planes for the Federal govt. and jets for private commercial airlines. Making planes for the Federal govt. is a privilege and is a taxable activity. Making planes for private airlines is not exercising a Federal privilege and therefore is not a taxable activity.

So, why do you pay? When you work for a company, they give you an accounting of your earnings in January for the past year. It is an information return and you know it as a W-2. The IRS also gets a copy. The information return contains specific terms, not words, which mean something other than what you use in everyday language. These terms are defined in Title 26, the Internal Revenue Code.

The company unknowingly misapplies the law and tells the IRS that your “Wages” were from exercising a Federal privilege. If you did so, you have a taxable activity. If you did not exercise a Fed privilege, then you rebut the incorrect information return and pay no tax. Use the IRS Form that provides for such rebuttal. You are not alone. Approximately 99% of the people think they owe the tax when it only applies to 1% of the people. Smack down that information return.

We, at the Daily Paul, want our servants to follow the Constitution they have sworn an oath to protect and defend. Our founders put strict Constitutional limitations on the taxing powers of the Federal government.

The United States Constitution, Article 1, Section 2, Representatives and direct taxes shall be apportioned among the several States. Section 9: "No capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken." Mentioned twice, must be important.

So Robert, learn the truth about the “Income” tax and no more bitching and moaning or pain, just smile your way to your new-found freedom/Liberty. The Constitution is the Supreme law of the land. No direct taxes.

on February 24, 2006, Schiff was sentenced to 151 months (12 years and 7 months) in prison and was ordered to pay over $4.2 million in restitution to the Internal Revenue Service; Schiff was also sentenced to 12 additional months for contempt of court. On December 26, 2007, the United States Court of Appeals for the Ninth Circuit affirmed Schiff's convictions except for the criminal contempt convictions. The Court vacated the contempt convictions because of the failure of the trial court judge to file contempt orders under rule 42(b) of the Federal Rules of Criminal Procedure. The Court of Appeals indicated that the trial judge could file the appropriate paperwork and re-sentence Schiff on the contempt convictions. On September 5, 2008, the trial judge re-sentenced Schiff to eleven months in prison in connection with the contempt of court, effectively lowering Schiff's overall original sentence by one month.

Devil's advocate

I'm going to start this by telling you that I do not believe what I am about to write is true, moral, or right in any way. But I'm going to play the devil's advocate here to illustrate a point I'd like you to consider.

Here goes...

You live here in the USA, don't you? You use the roads, you benefit from having a public with a certain level of education, you've got fire, ambulance, & police protection, the military protects you, and you've got access to a whole bunch of services like unemployment, welfare, social security, and the like. You either use or might use any and all of those services, and by God, you need to pay your fair share. Who are you to tell everyone else that they have to pay for these things for you? If you don't like it, leave and go somewhere else. I hear Somalia is nice. Besides, I voted for the people in charge just like you had the opportunity to, and it's simply too bad if you don't like the rules that they make & enforce. You'll have your chance to vote for someone new next time, and if enough people agree with you, then you'll get your way. After all, just because you don't like some laws or rules doesn't give you any right to disobey those rules. You need to work within the system to change them, just like everyone else does. So shut up, pay your fair share, & stop complaining. Why, it's because you pay taxes that our military has been able to make sure you're not speaking German, Russian, or Chinese! So, while you're entitled to your opinion you better keep paying, or else!

How many of these pro-state 'arguments' above have you used yourself when discussing or debating liberty with others? If you've used none of them, that is outstanding! But if you've used any of them? What do you think makes you special? Why don't you have to live under the same circumstances you'd force upon others?

I don't think anyone has a right to steal from you. But I assure you, if you don't pay up there will be a crowd to cheer those who would come take it from you by force. But only if those who come to steal from you have the right costumes on.
