Someone did buy land on

alloidal title in Texas, Waco, Texas, His name was David Koresh. The government didn't like it evidently.

Unfortunately

While emminent domain is constitutional, the term "just compensation" is not really defined. Personally, I would like to see a constitutional amendment getting rid of emminent domain or at least defining just compensation in such a way that its use would be extremely prohibitive.

I still think that Ron should take Texas

by a landslide on this issue alone.

Eminent domain sounds good

in UK it's called Compulsory Purchase which sounds more honest.

Just a thought on Eminent Domain...

I'm no attorney, but what would happen IF, say a right of way were to be run through your property, suppose you deeded a portion of your land , on the approaching border, to several hundred individuals ( say a square foot each) such as, lets say the the defenders of the Alamo or our founding fathers, then wouldn't they have to research the heirs and serve them with the purchase offers? I have thought about this for use in the proposed rights of way for the proposed Trans Texas Corridor being crammed down the throats of property owners here in Texas. It may not stop them but I'm sure it would slow them down to a crawl. We are not free if we aren't willing to defend Liberty, Patriot4Paul.

Any legal advise / thoughts on this approach?

Would this deeding of property be a viable way to thwart the taking of ones property? We are not free if we aren't willing to defend Liberty, Patriot4Paul.

You are suggesting a huge

You are suggesting a huge Title nightmare, however I think it is funny. There are no heirs and devisees of the Estate unless the Grantee is deceased, if you deed to the dead without an insured deed they may back vest the legal vesting to the last insured deed. But yes they would have to notice all persons showing ownership on the chain of title.
My suggestion is to contact a Real Estate Attorney who is part of the Revolution and get sound advice.

Jack Daniels did this.

I can't verify this but someone told me that they own one square foot of property of the Jack Daniels distillery. They receive a proportional distribution of the profits from their land investment and Jack Daniels reduces it's tax liability. The person that owned the land received a bill from the I.R.S. for one cent. It cost the I.R.S. fifty cents to send the bill.
They're sooo benevolent.

Wow...

If this is real. I think it is Awesome.

Do you know the process for obtaining allodial title

to you your property? It is not really yours unless you have allodial title.
In fact you don't even own your car. Even after it's paid in full. So what is the process for obtaining allodial title to your home land car etc...?

Tennessee Department of Revenue Operations Supervisor Denise Rottero Told Judge Greer how Tennessee's auto registration process works.
The process begins with the "surrender" of the Manufacturer's Statement of Origin (MSO) by the auto dealer to the Department of Revenue in exchange for a Certificate of Title. Asked if a Manufacturer's Statement of Origin is proof of ownership, legal title to the automobile, Ms. Rottero said, "Yes"
"Are you telling me that ownership of an automobile must be surrendered to the State before it can be registered?" she was asked.
"Surrender title, yes'" Rottero said.
The certificate of title to your automobile is Not title, it's merely evidence that title exists. Your car's legal TITLE is the MSO, which the dealer surrendered to the State. Ms. Rottero said the MSO is put on microfilm for permanent keeping, the original is destroyed.
After the trial, spectators expressed shock that their personal automobiles were actually owned by the state. "No wonder state law officers stop people for no reason!" said a housewife. "If your car's got a Tennessee plate, it's theirs, and they can do anything they like to you!" That's the law, but it's voluntary. No one but Judge Greer had dared say that if you don't surrender your car to the state in exchange for plates, you go to jail.

Needs to be researched.

All I know about Allodial Title is it has something to do with owning your property outright and obtaining a Land Patent.

I can answer your first question.

I am a Senior Escrow Officer in AZ and handled the SRP / Sierra right of way project for the gas pipeline from Pinal County to Maricopa County. SRP would offer the land owners fair market value for the easement and if the land owner said to go pound sand. They then took them to court and enforced Eminent Domain. I was then told that when the project was complete SRP to show good faith paid the victims of the process a lesser value of the original offer. But I have no proof of that I did not cut those checks. The whole process made me sick and disgusted.

So

You have to accept fair market value and leave. Period. Right? Is fair market value usually a good price, one that most people could accept and be fine? This has always been this way, right? So this is not a new thing in the US, right? Don't get me wrong, I don't like it, but it is not new.

Pretty much old news.

Condemnation is the process of taking private property for public use through the power of eminent domain. When private property is taken by the government, the owner is entitled to receive just compensation. Hmmm that is something to ponder.
In my position as an Escrow Officer part of my job description is to be a third party disinterested and at times that is the hardest part of my job. Especially when the land owners would send the Escrow checks back to me, telling me to roll it up real tight and offering advice as to where I could stick them. Very few have fought this process and have won. Out here builders and politicians are in bed together (very ugly offspring). Does Keating Five ring a bell?
