I have been threatened!
By Cung le's agent.
First he wanted half of the money I collected saying I used Cung Le's image. He said if I didn't pay him that he would sue me and have me thrown in jail.
I told him to go screw and hung up on him.
He called back and then said that I MUST return the money to the contributors and send him the receipts.
We collected a total of $716. Less Paypal fees the total is $689.11.
Now here' the kicker. Cung le is fighting Frank Shamrock. Shamrock's people have said that they would place RON PAUL's name on his trunks in the March 29th fight for $1000.
I was gonna cover the difference to do it. After emailing the contributors any response I got was to go with Shamrock and that they did not care who the fighter was. They just wanted RON PAUL's name out there.
Obviously, Cung Le and his agent will know we went with Shamrock.
Cung Le's agents position is that I used Cung Le's image to collect the money. However, I did not have Cung Le's picture on the site. I had his YouTubes and the fight poster. When I first made the site I had Cung Le's pic on it. The agent told me that would cosst money so I took it down.
So do I just go with Shamrock?
Or give the money back and scrap the entire thing?
Do I owe Cung le's people any money?
There was no written agreement.. Just phone calles.

ask him if he would like to contribute some money to help promote Ron Paul. When he starts screaming about throwing you in jail and putting a lien on your dog then take the opportunity to extoll the benefits of Ron Paul's message of returning to a Constitutional Republic. He'll hang up, get drunk and bash his head against the wall. I know it's an old trick but it will always works for me when people call during dinnertime.

People are very iffy on giving money to something online. If you were going to do this very worthy project you should have come up with the $1000 on your own. After the project got off the ground people would have contributed.

i was sort of confused as to what you were talking about when first reading your post, but i think it sounds like you were in some sort of verbal tentative agreement about putting RP on Le's trunks? Why then is he demanding money if he did not (once again extrapolating from what youre saying here) fight with his name on his trunks yet? You cant be thrown in jail for this, in fact it wouldnt go outside the local small claims court system being it sounds like a claim for less than 5000 something odd dollars. Lets say it came down to a situation where he DID file suit against you, you STILL wouldnt go to jail because it would be a civil matter, not a criminal one. theres no fraudulent activity by the sounds of it nor is there even ill intent, just a bully of a manager trying to scrape any cash he can from anywhere he can to support his broke ass fighter.
now going back and reading the part about his actual dispute, i suppose one could make the statement that if you use someones property or person/image to make money without proper consent to do so, you might be liable for damages (again this is a civil matter, hypothetical one at that, no jail time here). One important distinction you have on your side is that this is not a for profit venture and that there was also no formalized contractual agreements, so theres no way you could be accused for using his image on a for profit venture for your own personal gain.
I would say if youre worried, seek a lawyer or go to a lawyer community forum and see if someone will answer your question there, but i wouldnt really worry too much about it. definitely dont let them bully you into forking that money over to them.
also, one last suggestion, if you want to avoid that altogether, Refund everyones money, let them know the situation again (formally) in a mass mailer, ask them to recontribute if theyre interested in going with shamrock, nix any image association with le altogether and that should pretty much solve any sort of legal obligation you have by any means to the le-ripoff foundation. :)

I also think that they would damage their fighter's image by going after some poor RP supporter. That would be a pubic relations fiasco.

I am guessing since you went into this with a verbal agreement that you are not used to dealing with legal issues. You must know an attorney somehow, maybe a friend of the family or something. Just get on the phone with one and start asking questions. Don't be shy about it, just do it. And then get Shamrock if you can!!!
