UPDATED 8:00 am Central time march 28 : Resolution to revoke delegates from John Mccain
This is what i have come up with so far in this draft and any more thoughts would be appreciated. Keep in mind the more you have the stronger your resolutions are.

RESOLUTION to deny Senator John McCain of Arizona (hereafter, "John McCain") any (STATE) delegate votes at the 2008 county, state, and national Republican Party conventions:
WHEREAS John McCain was placed on the ballot in (STATE) without obtaining the required number of petition signatures, due to his prospective acceptance of Federal matching funds; and
WHEREAS John McCain ostensibly won the 2008 Republican Party primary in (STATE) as a result of being placed on the ballot solely due to his prospective acceptance of Federal matching funds; and
WHEREAS John McCain has willfully withdrawn from the Federal matching funds program, violating the sole condition whereby he qualified to be on the ballot in (STATE); and
WHEREAS John McCain must therefore be deemed ineligible to have been on the ballot for the 2008 Republican Party primary in (STATE), rendering all votes for him null and void; and
WHEREAS John McCain cannot therefore be deemed to have actually won the 2008 Republican Party primary in (STATE), and thus no (STATE) Republican Party delegates can be obligated to vote for John McCain at county, state, and national Republican Party conventions; and
WHEREAS, by participating in the (STATE) Republican Party primary on a fraudulent basis, John Mccain has clearly failed in his obligation to respect and honor both the integrity of the Republican Party in (STATE) and the election laws of (STATE); and
WHEREAS the Republican Party has the responsibilty and obligation to hold any prospective nominee of its party accountable for any violations of the law in any state, at a minimum by refusing to allow such an individual to win its nomination; and
WHEREAS the delegates for the Republican Party have the reponsibility to mantain the integrity of the Republican Party by withholding their votes from any candidate who has violated either the integrity of the Party or the election laws of (STATE); and
WHEREAS it is impossible to determine how votes cast for John McCain in the 2008 (STATE) Republican Party primary would otherwise have been distributed;
BE IT RESOLVED that we the people of the Republican Party of (STATE) hereby release all delegates from any obligation, legal or moral, to vote in convention for John McCain based on his illegitimate participation in the 2008 (STATE) Republican Party primary; and
BE IT FURTHER RESOLVED that we the people of the Republican Party of (STATE) enjoin all our delegates to NOT vote in convention for John McCain, and to vote for whichever remaining candidate(s) they believe best uphold(s) the platform and traditions of the Republican Party and the Constitution of the United States of America.

There is for sure one state McCain did not qualify to be on the primary ballot for. MCCAIN DID NOT COLLECT ENOUGH SIGNATURES to be on INDIANA’S PRIMARY BALLOT. He was short in the 4th district. However, Todd Rokita, the secretary of state (and mccain endorser) let McCain on the ballot anyway. WHERE IS THE OUTRAGE. Us Ron Paul supporters trekked door to door for weeks and weeks collecting signatures and informing the public. I am in the district she was talking about so I fired an email to a lady in our county voter registration (and filing) office inquiring about what I had heard and if there was any truth to it. Following is her rather detailed account of what happened.
“Indiana requires presidential candidates to submit 4500 signatures in order to appear on a major party ballot. And there must also be 500 signatures from each of the state’s 9 U. S. House districts. McCain’s petition was upheld on March 12 by the Indiana Election Commission.
My understanding is that McCain had 498 signatures that everyone agreed were valid, from District 4, on February 12. There were also 3 signatures from Monroe County(the county is split into two different House Districts) that were questionable, because that petition did not say which U.S. House district they were from. McCain then submitted another 13 signatures on Feb. 22.
Indiana practice is not to accept petitions on a piecemeal basis. In other words, petitioners only get to turn in signatures once. If there are not enough, a supplemental petition is not permitted, even if the supplemental petition is turned in on or before the deadline.
It is also Indiana practice that petition forms must be completely filled out, and omitting the district number is usually fatal.
But….the Indiana Election Commission members voiced the opinion that the voters should not be deprived of their opportunity to vote for McCain in the primary over meaningless technicalities. This decision has also set a precedent for the future, Indiana will be forced to let other petitions also be submitted in sections, not necessarily all at once.

Well mccain is in a catch 22 the way i see it.
1: If he has withdrawn from matching funds he will have great challanges in the states where he was allowed on the ballot with obtaining the required petition signatures.
2: If the FEC doesn't allow him to withdraw from matching funds the yes he has broken the law for has over spent according to the FEC by over 4 million dollars.

It also seems to me
to be an issue about when he started going over his $54 million. Was that before or after he put in his request to be removed from applying for the public funds. Also, it is my opinion that IF the funds were made available to him totally, then he is considered to have accepted them--and since he USED them as collateral for the loan, that in itself is an acceptance of the funds. Also, he accepted the funds by not getting the signatures. So there are other ways to accept the funds than by simply taking the money out of the bank.

McCain OK in PA with required signatures
I just called the PA Department of State, Bureau of Elections, and they told me that John McCain had more than enough signatures to put him on the ballot. They assured me that NO ONE gets on the ballot in PA without the 2,000 signatures required for the Presidential election as well as filing fees having been paid.

GOPers may not call them "superdelegates" but each state has 3 unbound delegates that are chosen by virtue of their position in the state parties. These delegates are free to vote for whomever they want to at National

For states where McCain did
For states where McCain did meet the requirements, what do you think about drafting a resolution (if one hasn't already been drafted) seeking to revoke his delegates based on either:
1. McCain exceeding his spending limitation due to his application for matching funds
2. McCain violating other states ballot requirements and therefore not running a legitimate campaign.
or some other reason.

Dr. Parent, I think this is great, and have read the many comments already on this thread. This is TRULY PICKY, but just to add to the punctuation discussion, I think the punctuation after WHEREAS should be a comma, not a semi-colon. A semi-colon is not appropriate in any event--maybe a colon, but I think a comma. Also, BE IT RESOLVED, I believe, can just continue without any comma, semi-colon or anything after it, although you can use a colon or the word "that" (BE IT RESOLVED that...).

"Accept matching funds" vs. "Qualify for" matching funds
Make sure your Secretary of State's website and the election code indicate that he must "accept" matching funds, not merely "qualify." He qualified, even though he's not taking them, so if that's the language, he's not in trouble. Look for language that says he must agree to spending caps, too.
