Snipes sentenced to 3 years for tax charges

(CNN) -- Actor Wesley Snipes was sentenced to three years in prison and fined up to $5 million Thursday for evading federal income taxes, CNN affiliate WESH is reporting.

It was the maximim sentence possible under federal sentencing guidelines.

Prosecutors last week urged U.S. District Judge William Hodges in Ocala, Florida, to sentence Snipes to the maximum penalty to demonstrate to taxpayers that refusal to pay income taxes carries severe penalties.

Snipes was convicted on three misdemeanor counts of failure to file federal income tax returns.

"This case presents the court with a singular opportunity to deter tax fraud nationwide," the government said in its sentencing recommendation. Video Watch more on Snipes' defense »

Snipes, who has starred in movies such as "Blade," "Major League" and "Murder at 1600," had been charged with felony conspiracy counts for participating in a scheme that rejects the legal foundation of the tax system. However, a jury accepted his argument that he was innocently duped by errant tax advisers and acquitted him on the most serious charges.

"The fact that Snipes was acquitted on two felony charges and convicted 'only' on three misdemeanor counts has been portrayed in the mainstream media as a 'victory' for Snipes," the government document says.

"The troubling implication of such coverage for the millions of average citizens who are aware of this case is that the rich and famous Wesley Snipes has 'gotten away with it.' In the end the criminal conduct of Snipes must not be seen in such a light."

Assistant Attorney General Nathan Hochman, head of the Justice Department's Tax Division, last week promised to beef up the government's efforts to pursue those engaged in a variety of schemes making legal assertions that income taxes are either voluntary or unconstitutional.

"For nearly a decade Snipes has engaged in a campaign of criminal tax conduct combining brazen defiance with insidious concealment," the prosecutors say. "By these means Snipes has escaped paying more than $15 million in income tax to the IRS and has pursued an intended fraudulent harm to the United States Treasury of more than $41 million."

The document says Snipes shipped millions of dollars to accounts in Switzerland, Antigua and the Isle of Man to avoid taxes.

"Given defendant's income, earning capacity, and financial resources, both disclosed and undisclosed, the United States submits that a fine of at least $5 million is warranted," the sentencing recommendation says.

The 35-page argument for the stiffest possible penalty ends with a dramatic flair.

"In the defendant Wesley Snipes, the court is presented with a wealthy, famous and inveterate tax scofflaw. If ever a tax offender was deserving of being held accountable to the maximum extent for his criminal wrongdoing, Snipes is that defendant," it says.

Making "an example" out of someone or sending a "signal" is such an abuse of power. It ultimately forces you to do more time or punishment for the sake of detering future behavior.

In other words they try to make you do someone else's time.

The Latest from Tax Honesty

This sickens me, every word they use sickens me. These taxes are unaportioned and direct, the most clear violation of constitutional law there is, not even to delve into the reality that no law is actually in existance, that no law was ever ratified to even require these payments.

They're a little behind updating their information, but I checked out Tax Honesty for the recent lawsuits filed against the US regarding this very subject. Again and again they, and all of us, are told "NO." and when asked why, they simply reply "BECAUSE WE SAY SO"

It's not legal

It's not Constitutional or moral to punish one person more harshly than you would otherwise, as a warning to someone else.

The main reason I'm a Libertarian is because I don't want to be punished or regulated for the sins of others, and I don't want to be taxed to put them in jail. (Offenders should pay their own way and make restitution.)

All eyes were on this. My guess is they need a full-colour full page front page pic of Mr Snipes being led into custody in a jumpsuit to sear into our collective consciense that "taxes arent optional" - then in 6 months he'll be let out with no fanfare but we'll all never forget the lesson.

Way to make good use of the tax money. Obviously he has the money to pay the fines and back taxes. But now its going to cost additional money to house a high profile convict for 3 years. He's not a violent offender. Brilliance... our tax money at work.

You say that Snipes should have asked

them to "Show me the law." Well, I've got news for you, in court you can't use that defense. In the pre-trial motions that are made, the feds make their motions that you CAN'T use any of the truthful arguments & the court grants them - you are screwed. All of the motions you make for your defense are denied. The justice system is "just us," and they will throw you out if you try to defend yourself using what you know. I don't know how it is in civil cases, but in criminal ones like Wesley's, it is the most unlevel, crooked courtroom you can imagine. The federal judges don't care. They are hired by the fed & they march to their command. The jury is instructed that they aren't to judge the law, they are just to judge guilt or innocence, & when the jury is chosen, you can bet the majority of them think, "If I have to pay taxes, so should he/she." AND "If I vote innocent, the IRS could come after me." People are afraid & it's next to impossible to get a fully informed jury. AND, don't get me started on Federal Grand Jurys - what a bunch of sell-outs, filled with plants from the fed. I'm sure Wesley fought with all he had & I hope he has some good appeals attornies. Where the fed got the height of his crime this high for this sentencing is beyond me - VERY scary.

He lost because he caved and said he was led astray by so called tax protesters instead of trying to force them to show the law requiring him to file there by sending the message to the jury that he concedes he was liable to file but was given bad information. He should have stuck to the "show me the law" defense he couldn't have done any worse.
