What States Allow Write In's OR Which States Do Not

0 votes

If anyone has the actual facts on this - please share.
Whether it is easier to list those that allow write in's
or maybe it is easier to list those that don't.
Or if anyone has any official information on this topic at all -
thanks

It's my understand that there are still four states

which claim that their "sore loser" laws apply to presidential elections. They are Mississippi, Ohio, South Dakota and Texas. Ohio amended their sore loser law in 1993, as a result of a lawsuit by Lyndon LaRouche, in order to make it apply to presidential candidates. Here in Texas, the Constitution Party lost a lawsuit against Texas, in their attempt to overturn the Texas sore loser law, in 1996.

See: US Taxpayers Party :vs: Garza, 924 F Supp 71 (1996).

Best regards.

Missouri Write In Permitted - but not for Primary candidates

Missouri Write In Permitted - but not for Primary candidates so No Ron Paul write-in here

MO, no write in

"Sore loser" law

"Presidential hopeful

"Presidential hopeful Congressman Ron Paul does not need to win the republican nomination to earn my vote. He does not need to win the nomination to earn your vote either. I am voting for Ron Paul for President of the United States regardless of whether he wins his party’s nomination or not. Imagine that! It’s called the Ron Paul Factor! The fools at Fox News might want to take note. They just cannot stop the Ron Paul vote."

I declared I would write-in Ron Paul but...

I will wait to see what happens at the Convention and what Ron Paul himself recommends. In a recent interview (I forget where I heard it), Ron Paul was asked directly if he would run as a third party candidate if John McCain wins the nomination. He answered rather emphatically, "No!"

So I think he will indicate what he plans to do after the convention, I will wait till then.

In the meantime, I am very interested in Chuck Baldwin of the Constitution Party; but I am having a hard time letting go of the hope I have had for so many months. I still have Ron Paul signs on both sides of my car!

And here's a nice list of

And here's a nice list of all the State websites for SoS and Elections:

Interesting, the government

Interesting, the government has Official Federal Write-In Absentee Ballots, for military and overseas, that are entirely blank:

http://www.fvap.gov/pubs/ofwab.pdf

So it sounds like if you go out of the country you can write in anyone you want.

Further digging....

It's easier to qualify to

It's easier to qualify to vote for whoever you want using this than I thought;

-a civilian residing outside the United States
-a member of the Uniformed Services
-a Uniformed Services family member
-a member of the Merchant Marine
-a Merchant Marine family member

http://www.fvap.gov/pubs/vag/appendix_d.pdf

Essentially all military and their families can use it and don't need to be out of the country. Never would have guessed that. Doesn't Ron Paul have a large group of military supporters?

Could those living close to a border use it by having one sent to Canada or Mexico?

Apparently you can do it by

Apparently you can do it by fax too, depending on this state map:

http://www.fvap.gov/ivas/fvap_state_menu.html

And under certain

And under certain conditions, like a military member actually being outside his state, requesting a ballot and not receiving it, you can vote online!

How would they ever monitor that? And, I wonder what is to stop anyone from voting online.

California is pretty

California is pretty straight forward for write-in, I don't see any restriction, except that a candidate needs to send in a declaration by October 21, 2008 and that blank form is also attached:

Now to confirm all the state info...

Well, here is a blog that

Well, here is a blog that references a website that claims write-ins can be done anyway, if they are all documented in case there is any litigation.

http://keelynet.wordpress.com/2007/12/13/ron-paul-can-only-w...

The thing is the website referenced is one of the crappiest websites I've ever seen. It does make sense, so maybe the guy that made the site just has poor taste:

The voter wishing to

The voter wishing to participate in this Write-in campaign will go to the polls and vote as usual, but with the following four simple exceptions:

1) On the regular printed ballot there can be found 3-6 blank lines for Write-in vote entries – or, in the case of mechanical/electronic voting devices; simply ask the Precinct Captain for instruction to effect “Write-in” voting, using the subject device, then;

2) Using a ball-point pen for paper (or by the available system method); Write-in the NAME and OFFICE of voter’s choice of candidate[s], e.g.: “Ron Paul, for President” then complete the Ballot selections - OTHER THAN the Office[s] already voted by Write-in;

3) Make NOTE of the SPECIFIC DESCRIPTION for the voting system used, as well as the PRECINCT ID, and PHYSICAL ADDRESS of the voting place used, then immediately thereafter - and THIS IS CRUCIAL;

4) USE THAT INFO TO Complete the Affidavit form – designed for this purpose & available by request, with instruction for its usage, at Our “Contact Us” page. ...

Then; have the NOTARIZED Affidavit scanned into a Word.doc file, which you email to us, using the secure system decribed in the instruction sheet - thus creating a secure record, should vote count litigation become necessary.

"No" in South Carolina

We have a big Constitution party organization here, and I mean BIG! We will back Baldwin if we cannot vote for Ron Paul.

Wow - It's Sounding Like

the only choice we may get to have some kind of voice -
this year - even if it is a protest vote and to send a LOUD
signal of disaproval with the GOP - is to Vote 3rd Party.

Any Comments on 3rd Party Candidates - Should President Ron Paul
not be on the ballot per September....

I for one have posted here before - my thoughts on Chuck Baldwin
Constitution Party - being a RP supporter and most of what he is
running on echoes Dr Paul....

please list someone you have heard about or might consider voting for....

I support what Ron Paul is

I support what Ron Paul is doing, and as a ten-term Republican congressman, it's perfectly logical for him to want to stay in the GOP.

A lot of people in this movement, however--who are more collectivist in mindset than libertarian--believe that everyone in the Ron Paul movement should support a (misguided) attempt to take over the Republican Party, and with some of these people, there is absolutely no encouragement of dissent.

To you people, I have one thing to say: Do NOT tell me what political party to vote for. Especially since the one you choose to "infiltrate" has the worst record on abuse of the constitution...the Republicans are not the lesser of two evils--not since 9-11 and GW Bush.

If you choose to support this party of traitors to both the Constitution AND the cause of conservatism, that's your business.

I will never vote for any Republican whose name isn't "Ron Paul".

In Missouri Write-In permitted but not for Ron Paul

In Missouri and in many other states they have "sore loser" laws. Which basically means that if a candidate loses in a primary they cannot be written in during the general. So just because your state has a write-in rule does not mean you can vote for Dr. Paul. Over 35 states have sore loser laws.

So, the American people are

So, the American people are far from free to vote for who they want? When it comes right down to it you are told who to vote for.

Agree

Well "We The People" are in charge and there must be a way we can force the hand for the people's vote to count. Any ideas?

NO write in MO

for a canidate who ran and lost a primary in MO. Other persons can have a write-in, but has to file paperwork with the SoS.

Hawaii

While millions of voters may believe they can write in any name on their ballot as a form of political protest, this is not true. Write-ins are barred altogether in Hawaii, Indiana, Oklahoma and Nevada, although Nevada permits a vote for "none of the above."

Eight other states -- Alaska, Florida, Georgia, Kansas, Minnesota, North Carolina, Texas and Wisconsin -- allow write-ins during general but not primary elections, with the added wrinkle that Texans cannot write in names in run-off elections. Three states -- New Mexico, Ohio and Washington -- refuse write-ins for "sore losers," that is, candidates who ran and failed in the primary. And 17 other states, including New York and Connecticut, place varying restrictions on the counting of write-in votes. 'A Voters' Rights Case'

What country am I living

What country am I living in?

I don't really feel free to do anything without the risk of getting in trouble or having to fill out a government form first.

Apparently many people don't even have the freedom to vote how they want.

Once you start looking at everything collectively, it's much worse than you would ever imagine.

And this in a "free" country.

:(

if I can not write in Ron

if I can not write in Ron Paul, I will vote for Chuck Baldwin!
