DEMAND FOR PUBLIC HEARING

TO THE MEMBERS OF THE LAKEVILLE CITY COUNCIL:

On Thursday, June 19th at 3AM certain officers of the Lakeville Police Department entered into my home, without warrant and disturbed my peace and the peace of my family. The excuse these officers gave me for entering my home, uninvited, is that my garage door was open.

The People of this state have secured to themselves certain rights, and the government that We the People created are restrained from violating these rights.

I have the right to my peace, to my sleep. As do my children.

It is imperative the rights the People secured in our constitutions are not violated by our government.

As this government is created by the People and for the People the People have the right and duty to correct any and all malfeasances of the government.

ACCORDINGLY, Demand is made pursuant to my secured right to petition my government (and to control the malfeasances) for a PUBLIC HEARING. At the public hearing the Citizens will address our government and seek solutions so that infringements upon the secured rights of the Citizens will no longer occur in Lakeville.

Response to this Demand for Public Hearing in the form of written confirmation of the date, time and place of said hearing, as well as confirmation of public notice of the public hearing must be made within 10 days. Failure to respond to this Demand for Public Hearing will result in my exercising all remedies available to me at law.

This NOTICE is brought pursuant to M.S. Sec. 466.05.

this happened last night the pioneer press is running a story on this. What do you think I should??

I was woke up by police officers in my home while I was sleeping in my bed, they woke me up with flashlights. I got out of bed, I was very confused and trying to understand what was going on. They were at the edge of my door to my bedroom shining flashlights in my face. And knocked on my wall. I got up and came over to see what was going on. I was told “your garage was open and your keys were in your car unlocked and your front door was open” I was very confused and asked “where’s my car” They said” in your garage” So I walked down the stairs. I was very confused thinking why are the police in my home. I asked “did anyone call the police” and they said no. My children were down stairs sleeping with their cousins having a sleep over. The police said “you should lock your doors, someone could have come in here and took your kids and you wouldn’t have know you were sleeping, we rang the door bell and knocked on the door and no one answered”
Then they left. I couldn’t believe the police would come in to my home because my garage door was open. I never gave any permission to enter. I am appreciative of them patrolling but this was too far.

On 6-19-2008 sergeant Steve Klehr stopped over. He wanted to talk to me about the police entering my home and why they did it. He told me the reporters called and he wanted me to know the police side of what happened. He told me the police who stopped by saw my garage wasn’t shut and stopped. They walked around my home to see if anything was going on. He said they walked into my garage and the door was open to my mud room. They then went back to the front and were looking in my windows and saw a child on the floor and came in to see if the child was ok. They were so glad no one was hurt. Now that they were in my home they needed to wake me up and let me know they were there. They tried to wake up one my children down stairs to go up and wake me up. The child was too tired and went back to bed. So the police came upstairs and woke me up. This was the story the sergeant told me.

Heres what happened. The door was not open; they said it just wasn’t latched last night, now the story today is the door was jarred open. The kids were sleeping in the TV room and they couldn’t be seen from the window. When they came in my room they said they shined flashlights in my face and pounded on the wall and said Lakeville police. I got up and said what’s going on. They said your garage was open. I said what, half asleep. She said your garage was open and your keys were in your car and the doors unlocked. I asked where is my car, one of the police said in your garage. They said we were ringing the door bell and knocking and no one answered. They never mentioned the child on the floor. This was a new story today.

I told the sergeant who stopped by tonight I appreciated them patrolling the neighborhood however them entering my home was over the line and crossed the boundary violating my rights. I was waken up by flash lights in my face at 3am because my garage door was open.
The sergeant stood strong on the position that the police were really grateful the child was not hurt and they wanted to air on the side of protecting the child. I told him again my rights were violated. I believe the only reason he came was damage control and to try to down play the situation.

I'd love to hear his take on this one. I agree that they never should have stepped foot in your house without making a better effort to awaken you from outside with phone call as others have suggested. No matter how good their intentions, the possibilities of things turning ugly were not worth the risk, not to mention the obvious illegality of entering without a warrant.

I went to city counsel

I went to city counsel meeting tonight and asked them to put it on the next city counsel meeting to vote to give me a public hearing or not. If they dont give me a hearing, any suggestions for strategy?

I always sleep with a loaded gun next to my bed, if I heard someone come in I might have been killed by the police. If guests were in the house at the time, I would be more reluctant to shoot, but if there were flashlights and men, It would be a life or death situation.

The problem we have is

The problem we have is simple:
people who swear oaths dont know what it means and the citizens dont know our rights. The chance of people being hurt due to constitutions violations is 100%.
I would like to see the executive branch add to thier continuing ed, a class on the constitution and open it up to the public to bring us together with our government. I would also encourage ALL public officials to attend, including judges, suprising- many of them dont know much about the constitution. I think doing this would solve so many problems.
Opening these classes up to the citizens we can monitor the training and make sure the constitution is not being perverted. If every city was pushing for this, I think it would have a major impact on our nation.

Actually, I'm surprised that since the Constitution is the Supreme Law of the land, and our society is founded upon law, that High School students are not given at least a basic class on law, rights, and the Constitution.

It's like public education is throwing us out into society blind, not even telling us what the rules are.

The public schools have been dumbed-down since I was a child. I am confident that this is no accident, they WANT the kids either stupid or drugged up so they can more easily influence behavior. That, on top of other issues (globalism, everybody's way of doing things is OK, Anti-Americanism, socialism-taking your new crayons and dumping them all in a big box for everybody to use, etc.) is why I homeschool. (My daughter is 7, and we will be teaching her about the Constitution this year :)

Seeing the video really clears up, without a doubt, that the police invaded your home with no justification at all.

Your house is set back from the street, along with your garage, and the door into your house is all the way at the back of the garage.

The police would have had to walk onto your property and enter your garage to even see that the door was ajar. Even at that point, they would have been going too far.

Maybe they suspected they would find something inside your house that they could have busted you for...

I wonder what the outcome of the investigation would reveal? I am sure the police would have said that their execu.... accidental shooting was justified.

Police have a difficult job and I would not like to do it and I appreciate what they do, however, they could have called dispatch and had them call the home before they went in. A police siren is also a good wake up alarm.

Yeah, there are too many ways this could have ended up badly. The police shooting the homeowner, the homeowner shooting the police, the homeowner diving off the stairs tackling the police and defending his family and home from these intruders, the owner sending 3 angry mastiffs or other dogs downstairs to "see who that was", etc, etc, etc.

If the police officers would have been bitten or injured in any way because they were mistakenly identified as intruders, we can be sure that the public would be paying for all their related expenses and the homeowner probably would have been up on some sort of charge. Heck, if a thief who falls through a skylight while breaking in and gets cut on a knife sitting on the counter (instead of being stored in the knife block) can win a judgment against the victim/homeowner - who knows what they would have done to the homeowner in this case if it had turned out badly in any way for the police.

I agree with you that the police have a difficult job and they should be appreciated. And I also agree that they should have handled this very differently.

I imagine that if you had, with only good intentions, entered an officer's house (or hey, the White House) uninvited in the middle of the night, those residents would not take kindly to it. And for good reason.

It is sometimes difficult to stand up for what is right. It is often easier to let things slide until they get to be "too much."

Easier is not necessarily wiser.

The REAL problem

The REAL problem here is that our government has a set of rules and they don't follow them. They do whatever and we are the ones that end up paying. The police should follow the rules and other government officials should follow the rules also. WE THE PEOPLE need to remind the Government who is the REAL boss. The Government is there to PROTECT OUR RIGHTS. Not to do whatever they come up with at the time. All policemen should be experts in Fed Constitution and State Constitution rights.

I agree 100% with that. And not just for police officers but anyone who swears an oath to uphold, protect and defend the Constitution. That includes police, members of the military, judges, politicians, etc.

Two friends of mine, one recently became a police officer and the other recently joined the military - both swore oaths to the Constitution. Studying the document that they both swore an oath to was not included in their training. Not a single minute of training/education! Neither of them knew much at all about the Constitution before and even after they swore their oaths to it!!!!

I mean, I understand why you're worried about cops coming into your house, but the way you put it, it just seems they were trying to be friendly, concerned neighbors rather than cops bent on violating your rights. I mean, your door was open apparently, the garage was open and your car with keys in it unlocked. Plus they said they tried knocking on the door and ringing the doorbell. I understand being a little worried and pissed about waking up at 3am, but seriously I think you're taking this too far. The cops were just trying to be good people. You're lucky two cops came in your house, rather than the wrong people noticing the same thing the cops did and having them come in. Sure, they messed up, and even might've gone a little too far, but I wouldn't go as far as this. That's just my 2 cents.

you shouldn't crucify them because they decided to be try and be friendly rather than follow SOP...i mean, what do you want to do? put them out of a job? a simple complaint would suffice imo. The bigger picture is what if they accidently got shot? or you pulled a gun thinking someone broke into your house and YOU got shot. I don't think they walk into houses looking for shit to steal, though..or looking to start problems.. it's not like they're a part of some conspiracy to expand the rights of cops and trash the Constitution..it was an mistake, but a well-intentioned mistake...i'd be pissed, l.....it'd be nice to hear the cops side of the story as well..
