California to Legalize Weed for Everyone
There is an initiative in the works that could end up on the November ballot that allows for marijuana to be sold to anyone, and anywhere that already sells alcohol. Its being called The Inalienable Rights Enforcement Initiative. From the full text of the measure:
This initiative will amend the Constitution of California to defend and safeguard the inalienable rights of the People against infringement by governments and corporations, providing for the lawful growth, sale, and possession of marijuana. Marijuana will be taxed through a system of stamps and licenses--a $5 stamp will be required for the sale of an eighth ounce of marijuana and a $50 annual license will be required for the growth of one marijuana plant.

I'm inclined to agree with this theory.
Personally, I don't smoke it but I don't see the big deal with pot as long as it's used responsibly (ie don't smoke and drive, operate equipment, etc) and it should probably treated similar to DUI because of its effects. I think a little prudence in its legalizing should be considered, similar to alcohol. I don't know how many people agree with me here on that aspect, but it's just my take on it and I would think that's a reasonable and fair way to look at it.
That being said, I can well imagine that given California's track record with anything it doesn't like (gun laws for example), if they begrudgingly legalize it, expect it to have the shit taxed out of it to make it hard for people to sell or buy it on the market. They'll regulate the hell out of it the same way they do firearms I'm sure.
Good luck to CA- I hope you make some progress with this initiative. Maybe it'll ease some of the drug-runner shootings up here on the border.

The state is in a budget crisis and the Governator is paying government employees minimum wage until the legislature comes up with a budget.
So this could be an ideal time to institute a new tax in order to get government employee support.
Of course, it's possible that if the plan passes, the California courts would uphold the legality of marijuana, but find the tax illegal.
We have a law that says any new tax in California requires a 2/3 vote by voters.

Is 10,000 plants/year reasonable? $500,000 to grow, plus the tax to sell.
I'm not hip to a tax to grow/produce, but the sales tax does follow existing rules for alcohol.

these people won't be growing what we in Oklahoma call "home grown". These people are going to get A LOT of weed out of their plants...fifty bucks a plant to make a statement and do it somewhat legally... priceless. I can see the quality of our smoke getting better and better.... YEAH!!!!!!!!!!!

I would gladly pay $50 a plant to be able to grow legally. And I'm sure there are many many others who would agree.
A good plant will give you 2# of dried product. I'm gonna say $25/quarter oz plus $5 tax...so $30 a bag. I would honestly challenge anyone to find the quality smoke we would be able to grow, on the market currently for that price...it would be impossible. So I think I am seriously underestimating the potential. Anyway back to the numbers.
2# of product equals 128 quarter bags at $25 apiece which equals $3200.
1# of product equals 64 quarter bags at $25 apiece which equals $1600
1/2# of product equals 32 quarter bags at $25 apiece which equals $800
So to make it even better, lets take your 99 plant scenario and kick it up a knotch to 100 plants just to make the numbers easier. Here's your potential.
PPA (Per Plant Average) 2# = $3200 X 100 = $320,000
1# = $1600 X 100 = $160,000
1/2 # = $800 X 100 = $80,000
So where exactly is $50 outrageous? Granted it would be better to not have a tax, but I'll take the $50 charge over prison any day.

Yeah the tax is pretty high but it is worth it i guess. An ounce here is 120 of some mids. And i kno Cali will sell the really good stuff with it being legal so i wouldnt mind a 5 dollar tax

$5 for an eighth of an ounce TAX?? Shhesh! Dunno who would want to buy it legally, then. Since it is only about $100 an oz in this state, that would raise the price by over a third. CA taxes much too much to begin with, but there is no reason that a tax BEYOND state sales tax should be collected when selling it.
