ADVICE PLEASE

I have a situation I would love to have some advice on. While it doesn't have anything directly to do with Ron Paul, it does have everything to do with liberty.
I have a family member who was arrested last week at his home on 5 counts of indecent exposure. He has been having some issues with a neighbor and is assuming that it was her that called. He was walking around in his house without clothes, but NEVER left his house. He still doesn't even know for sure that it was her. He has not seen a complaint filed by anyone, and when he went to the courthouse and asked for it they told him that he would have to waive his rights before they would release that info to him. Or to hire an attorney and they would release the info to his attorney. He also called the Commonwealth Attorney (we live in Virginia) who told him the same thing.
Now, he has court in a few weeks and they are expecting him to defend himself and he doesn't even know who, where, and exactly what the charges even are. Furthermore, assuming it was the neighbor can you be charged for this for walking around naked in your own home, and someone seeing you through the window?
I know in the constitution it says you have the right to face your accuser, and to due process. Does anyone have any suggestions on how we can make them do this?!?!

UPDATE:
My nephew has just received notice from the company he works for that he is being fired because of being incarcerated and being in court a couple of days he missed work. All of this and still he doesn't even exactly what he did yet. I'm absolutely shocked on this one!!

When in court ( at some later date ) he ought to ask whomever it was that supposedly saw him prancing around nude, " Just how close were you when you looked INTO my window"?
"How often do you look into other peoples windows"?
"How long did you look?" " Can you describe in detail just what it was that you saw"? If they cannot be very precise in their description, it should be deemed as not true.
Maybe it was the man's 6 foot screen Television set that was on and he was watching something with nudity in it and THAT is what she saw.
What was she doing on his property if she was and if not, could she really have been close enough to see what she said she saw?
Just when do you again plan on looking into someone elses window maam?"

Is she a lesbian who hates men and THAT is the reason she is complaining?

These are very valid questions I believe, and lastly, I must conclude that this very long nosed peeping woman must be working for the corrupt present snooping despicable government.
Wonder what she would have said if it were Rep. Barney Frank she saw?

If she can be very precise in the description maybe she is the guilty one. Does your head not turn? Do your eyes not close? Do your curtains not close? Sounds like the nephew has a lawsuit of his own. With the accussor and the courts. Make sure there is no gold trim on the flag in the courtroom. Make them pay for your lawyer when you win. The judge wo'nt let him talk . Are you kidding. He has to get a lawyer or he's toast. I'm in Va. too. Hope your not in hanover.

Actually, I'm in Newport

Actually, I'm in Newport News, so we are pretty close. This incident was in Tazewell County though. But let me tell you, Newport News is about as corrupt as you can get. I had a Yorktown deputy tell me that he used to work for NNPD and that they handed out over 48,000 tickets per year and that was years ago. It's a mess here. I'm ready to move back to the country. Of course, seeing how this is in Tazewell Co. I guess the country is just as bad.

It's happening in other places, too

There was recently a news story about this very kind of incident, and I've been trying to find it for you, but to no avail (sorry). Basically, someone was wandering around inside their own home au naturel, someone from outside the house was able to see, charges were filed, and...the person in his own home got slapped with indecent exposure. And it's not just one story; I've seen such stories from the U.S., Japan, and England off and on.

If you're not deliberately trying to put on a show in your picture window for the neighborhood to view, it makes no sense to me that you should be punished for other people's nosiness. But as you well know by now, today's laws and courts have very little to do with sense.

hot spring nudity laws... what I know

The Forest Srvice posts "clothing required" at very public hot springs, but the rule they use for if you have made a reasonable effort to assure a private location, is to put a suit on if someone requests. they cannot come up, find you naked and file a complaint of indecency. If you REFUSE, then they can. Now, this is for out in PUBLIC, it seems to me he should have at least that much right in his own home. Staying indoors IS a reasonable attempt at privacy, if neighbors are somehow unable to avoid seeing him, they ought to be obligated to at least attempt to remedy the situation with a simple request: "Mr. Smith, my three year old stares at your house all morning asking me why you are naked. Would you mind putting up a curtain?" would probably remedy the problem and save the taxpayers all that needless litigation expense.

Have him tell the fine "peace officers" that he will be forced to represent himself, and to cough up the friggin' charges. I mean, respectfully request permission to face his acusers. He also needs to begin the entire defense with a request to throw out the charges based on ANY violation of his rights. If they don't ever say who filed the charges, use that. If they give him that, use anything else he can - did they "Miranda rights" him? If they really did it all "by the book" then ask for the charges to be dismissed as a frivolous waste of taxpayers money, that a simple set of curtains will remedy the problem and a simple request would have resulted in the purchase of said curtains.

To be honest, I can't

To be honest, I can't understand why anyone would willingly leave their windows uncovered at night, allowing people to see into the house in the first place.

Where I grew up, in Michigan, it would have been considered strange if not outright bizarre to NOT cover your windows with shades, curtains or blinds once it got dark enough outside to allow people to see in. In fact, not doing so was basically unheard of. But here in Alaska, I see many people, with huge picture windows and doorwalls, who leave them utterly uncovered in any way at night, allowing any casual passersby to see their every move inside their home. I find this distasteful and frankly unnerving, and have to wonder: Don't they give a damn about their own privacy?

I leave my "huge picture window" curtainless for a variety of reason: Curtains look stupid on big picture windows, the whole idea is for the window to be a picture... Also, a curtain that size would weigh a hundred pounds, I would have to put steel girders up to hold the curtain rod... And, a curtain that size would cost a lot of money that I can spend in MUCH more useful ways.
I also moved out to the boondocks to enjoy the luxury of a window view worthy of a picture, and know that my neighbors value privacy in general enough to look away should they catch me on a midnight streak for a glass of water. And, as someone else mentioned, I thought peeping was the crime, not existing. Being offended by nakedness is silly enough, making it a crime is truly absurd.

I never advocated or suggested that anything here should be a crime --- I merely stated that I am disturbed by the willingness of others to have their privacy invaded by allowing (if not inviting) others to see into their homes at night.

But as with cell phones, most people are just sheep, and are perfectly willing to give up their privacy for the sake of some minor convenience --- I can still remember when we had telephone BOOTHS, as it was a given that one would want one's telephone conversation to be private. But not today!

Why should we complain when the government follows where the people are already leading it: to ignore privacy?

I'm no attorney, but I'd say he is getting the short end of the stick! I can't believe walking around naked inside your own home would be illegal. People can simply not look! If you have a balcony and you go on the balcony, that may be another story, but to say that you must ensure your house has curtains, and walls etc. for no visible access to your body being naked or otherwise is ridiculous.

As far as waving his rights, that sounds like a load of BS as well. How in the world can you waive your rights for asking to see charges against you? The best advice I can give you, not being an attorney, is to search google for indecent exposure cases/laws.
