The Battle in Nevada
You may recall, but before our convention was "recessed" against the rules, three state delegates each, from two of Nevada's congressional districts had been elected. The third congressional district's ballot count was almost finished when the state GOP saw that the RP faction was winning & pulled the plug. Well, last Friday, they announced they had "appointed" (I call it "anointed") the state delegates from Nevada to the national convention. If any of the RP congressional district candidates has been anointed, I know we would have heard. Even though the state GOP has anointed delegates, they haven't announced them as they, "wanted sufficient time to contact each one of them individually first." Last Friday, we were denied jurisdiction in court when we tried to use an injunction to stop the anointing. Something still has to be done about the fact that all of our caucusing, all of our efforts to be elected precinct delegates, then elected county delegates, then to get to our state conventions was for nothing! What also meant nothing were the elections of the congressional district delegates in April, & the election of the delegates at large in June. The state GOP committee of Nevada just went into a back room & anointed delegates to the national convention, which is totally against the rules. If they get away with this, there is precedent for EVERY state committee to do the same thing. They can then nominate whomever they want! Do you get it? We need a GOOD/GREAT/SUPERLATIVE/FIGHTING MAD lawyer to help us.

If I remember correctly, the judge stated the GOP was a private entity and therefore had no jurisdiction in the case. So if I take that literally, then he has ruled that our form of government is not "We the People", but a private group of individuals who run the country? Would his ruling be in direct violation of the Constitution?

with enough members in your corner you should be able to change, rules, bad members...

It was really uplifting reading the comments. I will pass them on to the group of people who are trying to work on this. I was disappointed though that when I posted this last night around 11:30pm, it was not even on the masthead this morning. This issue is the MOST important thing happening right now in our country. If we allow this to stand, our system is totally corrupt. What if we had taken over state committees & just anointed RP people rather than had elections? Do you think judges would be saying, "That's a party squabble, go work it out amongst yourselves!"
A member of our group, Marla, suggested that if every one of the 327 people who attended the June 28th convention, chipped-in $31, we'd have the $10,000 to get a lawyer going on the case. We've already had almost $3,000 pledged.

Let's compose an open letter and post it nationwide...
... in search of the best legal minds and patriotic hearts to volunteer their services in a coordinated effort to hold the NV GOP accountable... in the press, in the courts, and in the arena of public approval. This is a high profile civil rights attorney's dream... to represent a case with this much notoriety and historical importance.
The NV GOP has certainly tried to smear us with their repeated lies and misrepresentations and there is so much video evidence to prove it. We should be introducing it to the public ourselves by doing a side-by-side presentation comparing the video truth of what actually happened at the convention to the official party statements which will be openly exposed as lies and slander.
We should organize our efforts into three primary areas:
1. Legal recourse
2. Party recourse
3. Public Relations
These are all specialized areas that when organized into a single common effort can become a far more effective and powerful tool for fighting corruption. I know that I have personally read articles and reports from all over the world about the Nevada Convention and what is happening here. We have to seize this opportunity NOW while the public is still fully aware of our plight.
SAVE NEVADA... and you just might help to SAVE AMERICA!

What governs the Nevada GOP? Do they have a charter or articles of incorporation? Does their tax free status depend on this? They must have some governing documents and they are bound by law to follow them or to change them according to their published procedures. Obviously the leaders need to be replaced. Hopefully there is a procedure for that too!

In their minds...It's about the candidate... not the party.
The NV GOP claims it is broke and is constantly begging for money yet it just had the biggest influx of new members in it's history here in NV and the NV GOP was even offered a FREE CONVENTION to reconvene and they turned it down in favor of a scare-tactic mailing explaining that the NV GOP would be charging more money due to the need for added security, if and when, the convention were to be reconvened.
McCain was here in Reno on Tuesday and raised over $500,000 at a private luncheon at Lake Tahoe. These people don't care about their party... they care about their candidate and their power structure and they use the two-party system to insert their choice into the predetermined slot reserved for the NV GOP.
The ACLU should be ALL OVER this opportunity to expose such an obvious and public corruption of our political and electoral process. We certainly have enough video evidence to support every claim we have ever made about the abuse occurring in Nevada. Even the Judge has stated that the April convention proceeded in an orderly fashion until the abrupt recess was called... which is NOT what party officials were reporting to the press... they were knowingly and intentionally LYING about the events in order to sway public opinion and slander our reputations as duly elected State Delegates.
I agree... we need a legal hero to step forward and publicly take the lead and present this historical case to the courts... and to the people... for all to see.

for each elected delegate to file charges in the county courts against the GOP? wouldn't it be great to have the same number of lawsuits against the GOP as there are congressional delegates.

I've also wondered about many, many small claims court cases against the GOP from State delegates asking for a refund of monies paid, plus travel expenses. People worked hard within their counties to become a state delegate to have the right to vote. I doubt that the NV GOP will release names of the appointed delegates before the convention even. It is all part of their plan to "protect" their own. Something else I wonder about. Ron Paul personel had asked for the list of delegates to the State Conventon, which Sue Lowden refused to release, although at one point someone at headquarters said they would sell it for $10,000 (extortion?). Protection organization, RICCO....all kinds of legal terms come to mind. Do we now go to Republican meetings and state "I'm a card carrying member of the GOPFIA."

Small claims might be something to try at some point. They committed fraud if they advertised a convention with rules and did not provide it.
However, first, this must go through the judicial committee(s) (state and/or national) of the GOP. I assume they have one at each level. Judicial committees are usually filled with fair-minded people because it's a low-profile, rarely used group that interprets rules and the delegates never know which side of which issue they'll be on, so they should be electing reasonable people to it.
It won't work to go to a government judge until after you have followed the party rules and remedies by appealing through channels to the GOP's own judicial system. Only after that fails will a regular judge do anything.
Even then, be careful what you ask for: what you want is for the federal government to use force against a private club that has voluntary membership and the right to make and/or break its own rules. Unfortunately, if you get it, it's a power that can just as easily be used against you.
The case you need to be making to the GOP is that if they don't shape up and treat the members fairly, the members will walk or take the party over. That's free-market.
The Libertarian Party has openings for political activists and delegates, for example. ;) And they follow their own rules.
Anyone who lives in Nevada and is a GOP member should absolutly try to be in town for the convention. Attendance may be low, and the delegation may have a change of heart and be willing to fill slots with anyone who shows up. If they don't, then there might be something else to do nearby.

Bush for Murder...now that I think of it, if he did take on this case, the free publicity for his book sales would be Enormous!
Also, if you watched him at the Dennis Kucinich impeachment judiciary hearing a few days ago, he is absolutely NOT AFRAID to speak out. In fact, it appears that he loves a good & righteous fight. He is the lawyer w/ the balls of steel you need.

I worked in L. A. Superior Court as a...
court reporter primarily doing felony trials when Bugliosi was the the Deputy D.A. trying the Manson case. He thereafter became the head District Attorney of L. A. County District Attorney's Office. He is a criminal attorney and not a civil attorney. It's like asking a cardiologist to do gynecology.
It's a great Idea, but this issue needs someone who understands the law as it applies to this situation. Bugliosi, IMO, wouldn't be the guy for this job. Just chiming in!

Also, the GOP committee here in Nevada commited a criminal act when they went into a back room & anointed delegates to the national convention, which is totally against the rules. Others may not see it that way, but it was a crime.
As well, even if Mr. Bugliosi didn't take this on, I am very sure that his network of lawyer associates/colleagues/peers/, whatever you'd like to refer them as, is more extensive than we can imagine. Bugliosi would be perfectly qualified to refer/recommend & co-counsel with this one. IMO.
***FYI - a cardiologist is qualified to practice gynecology if absolutely necessary; he'd just confer with a GYN colleague, (or refer), should he run across something he questioned.

The Annointed need to think carefully about their acceptance
Ausscyn, you are not an undelegate, you are one of the true delegates and if I were one of the appointed delegates I would be ashamed to take the position from a duly elected delegate. What do you call somebody who is knowingly involved in someone else's criminal act, an accessory, a co-conspirator? But, this is the GOP, and they don't have to follow the rules and they appear to believe they can "buy" their seat in a convention hall....you know, donations, attend little fundraiser parties, rub elbows with the party regulars, etc. Bob Beers has indicated that if we are good little party goers, we might be able to participate more fully in 10 or 15 years.
Personally, I believe the annointed know...they have known since before the convention, but unfortunately I have no proof of this. I've exchanged many emails with the powers that be and several statements have indicated this knowledge to me. Not only party rules, but laws have been broken and this needs to be remedied.
