Choose versus Chuse

In the Constitution they used the word that we now know as "choose", such as (not a real quote, but sample) 'the people shall choose blah blah blah'

Except in the Constitution, they spell the word 'chuse.' If the founders spelled it like that, then why is the government today allowed to spell it 'choose?'

If we were constitutionalists we would use the word chuse.
