Bush's Preemptive Self-Pardon: Pardon Me, Congress?
Jerry Seib, executive Washington editor of The Wall Street Journal said on the Diane Rehm Show on NPR last week that he expects Bush, Cheney, and their subordinates to be prosecuted for torture. This expectation is spreading.
As we approach W's last day in office, on which I'm willing to bet you he issues some sweeping pardons of crimes he himself authorized, an act already recommended to him by various voices in the corporate media, we also approach, of course, the dates before and/or after those pardons on which congressional committees may hold hearings to whine about the matter.
I actually think Congress should hold hearings, and hold them as soon as possible, but not just to speechify, rather to take serious steps to prevent something brand new in American government: a president pardoning himself and/or pardoning his subordinates for crimes he instructed them to commit, crimes for which they have, in most cases, not yet even been charged, much less convicted and sentenced.

S. 3930 The Military Commissions Act of 2006
Signed into law October 17th, 2006
The Military Commissions Act of 2006 suspends Habeas Corpus, permitting someone to be held forever with no charges and allows convictions based on evidence literally beaten out of a witness. Especially scary since FEMA, in conjunction with Halliburton, is current building detention camps all over the US and the fact that H.R. 1955 defines a homegrown terrorist as anyone who disagrees with the US government. Bush also snuck a provision into this bill that pardons himself from prosecution of any war crime, creating immunity retroactively.
Luckily, it would seem we won one, as this act was struck down by the Supreme Court on June 12th, 2008. It's a shame something as unconstitutional as this was, has to go all the way to the Supreme Court to get thrown out. Of course, I must cynically say that the same bill will probably get passed through Congress again, but maybe with a better name and new pork.
The first Bush already essentially did that...
And then the Clinton administration -- with the justification of "moving on" and "not dwelling on the past" basically canceled all of the remaining investigations into any wrongdoing by the Bush gang (and family).
Similar things occurred with the changeover from Clinton to Bush II.
The same will happen again this time.
If you hold your breath waiting for investigations and prosecutions... you will undoubtedly self-asphyxiate.
