Ralph Nader Urges Courts to Challenge Constitutionality of Corporate Personhood
The word "corporation" or "company," or the words "political party," do not appear anywhere in the U.S. Constitution. How then can these two excluded corporate institutions have such power over Americans who, as "real people," are the only "persons" protected and given rights under our Constitution?
Corporations are artificial legal entities. They are not human beings. They do not vote. They do not breathe. They do not have children. They do not die in Iraq. Why have they been given all the rights under our Constitution, except for the right against self-incrimination under the Fifth Amendment, and why did they obtain these rights from judges, not from the legislature?
I put these and other questions in writing to Justice Antonin Scalia -- deemed an extremely conservative judge who believes in "originalism," or strict interpretation of the Constitution.
Recently, Justice Scalia and I caught up together on the phone: I asked him how the application of the Bill of Rights and related constitutional protections to the artificial creations known as corporations can be squared with a constitutional interpretation theory of "originalism?"
Justice Scalia said he had not put much thought into unconstitutional corporate personhood, but if a case was brought before him on the topic, he would be happy to delve into it.
Unconstitutional corporate personhood is the central issue that prevents equal justice under the law and provides privileges and immunities to corporations completely outside of the framers' frame of reference in that large hot room in Philadelphia during the summer of 1787.
The $700 billion blank check bailout of Wall Street is the latest manifestation of private corporate domination of our national government, a situation that Franklin Delano Roosevelt foresaw as "fascism" in a message to Congress in 1938. The relentless decline in the livelihood of America's working families and growing unemployed reflects the radical concentration of power and wealth in a few hands.
To turn back this tide, the first step is for someone among the legal community -- the sooner the better -- to bring a case centering on unconstitutional corporate personhood to the fore on the floor of the Supreme Court.
And then, perhaps, Justice Scalia's originalism can be brought to bare on restoring justice and allowing the Constitution's words "we the people," to once again ring true.

That if a corporation were a human, it would be a psychopath.
I think that this corporation "personhood" idea was pushed by psychopaths so they could legally protect themselves from being held accountable for their own psychopathic behavior. If a corporation does you wrong, you must try to sue the corporation - no individual that made the decision to harm you can be held responsible. Does this make sense? I would venture to guess that most *big* corporations were founded and are controlled by psychopaths.

IF you look up person in blacks law 6 th edition, the second definition is a corporation.
If you look up natural born person, that is a different thing all together.
If You look up person in 26 usc 7701 (a) you will see that there is no mention of a living person.
IF THEY MAKE the artificial person/corporation unconstitutional, then NO AMERICAN WOULD HAVE TO PAY INCOME TAXES.

So is that why we have to pay income taxes? In the same section that you referd to it also says "to preserve for the people the full benefits of the currency provided for by the Congress"
I am at work so I can't look it up in Black's law dictionary of what Benefits is, but online I found
"benefit 1) n. any profit or acquired right or privilege, primarily through a contract. 2) in worker's compensation the term "benefit" is the insurance payment resulting from a fatal accident on the job, while "compensation" is for injury without death. 3) in income taxation, anything that brings economic gain. 4) "fringe benefits" are rights from employment other than salary or wages, including health or disability insurance. 5) v. to gain a benefit. In other words if we accept Federal Reserve Notes as payment then we are accepting the contract and we have to pay our part of the contract. TAXES! So how do we not participate in the contract?

If you do a search there for his name you will find lots of other good info. In a nutshell, he has discovered that by the mere use of FRNs you are in effect operating as a branch office of the Federal Reserve; you are a Federal Reserve bank! You must therefor pay interest on the credit extended to you by the Fed in the form of "income tax". However, you can redeem your deposits in U.S. Notes (remember, JFK put them back into circulation and they have never been formally removed) by citing Title 12 USC, ss411, and avoid the "interest" (tax) altogether.

While I agree with the premise...

The Constitution doesn't GIVE us any rights. The Constitution acknowledges that we have inalienable rights and lists a few. The constitution is supposed to bind government to those specific things outlined within. Our rights were not granted by the Constitution, but by our Creator (think higher authority).
You don't have to believe in God to embrace this idea.
It is important (now more than ever) to recognize that we have these rights with or without the Constitution. But we only have the rights we know about and are willing to claim. And finally, we have many more rights than are listed in the Constitution. If you don't know what they are you don't have them.

Someone asked "Where is the attorney...?"
The attorney is shaking their "expert" head, for they took an entire class called "Constitutional Law" and the silly people just don't understand.
It is the high cost of becoming an "expert" - it comes with blinders. You HAVE to believe the information that made you an "expert" is correct.
What is your area of "expertise?" How often do you tune out "stupid people" who dare to question you on it? Think I am wrong - try asking your AMA member doctor if you can take colloidal silver for say, strep throat. They will go apoplectic on you, and spew a bunch of fearmongering nonsense... the "expert" information they were taught.
Truth exists, and it deserves to be cherished.

I really like this post and wish I had this last year because many conservatives don't "get" Nader because they've been brainwashed by MSM. They think MSM only lies about Ron Paul I guess. I have a beautiful US Constitution and Bill of Rights Nader campaign sent me for 2004.

This idea IS an outrage.
Government has done some bonehead things in the past, but equating a CORPORATION with an INDIVIDUAL ranks up there with the very worst.
Consider this re-statement: "We hold these truths to be self evident, that all men and corporations are created equal." Ridiculous.
It's the same mindset that voted for FDR's plan to permanently fix the number in the House of Representatives at 435.
This is the ONLY branch of government which SHOULD have grown with the populace. It represents the PEOPLE. But governments don't want much control or influence by the citizens.
The founders wanted 1 representative per 30,000 people. Today we have 1 per 700,000 people.
The Communist FDR knew that it is much easier for politicians to bribe a smaller group to do their wrongdoings than a larger group of representatives.
And it is working like a charm!!!

Nader is proving to be a courageous and
original thinker. I hope his constitutional arguments help people, especially on the political "left," rediscover its importance. It would be very interesting to see the Supreme Court deliberate this issue.
