Normally I sell (30.00) this info, but with so many of my friends here on daily paul needing it. I will e-mail it and HOPE that you will send me some $ for my effort. We are a family and we need to take care of each other. Anyone with a home loan, wether in trouble or not, needs this!!

I will try to send out the report to all requesters within 24 hrs of request. Even if you don't have a mortgage you can give this info to friends and relatives. It's a FREE service and if it 'saves' the home so much the better. No-one should be loosing their homes.

I am leaving my original post above for the moment. I have spoken with the owner of the company mentioned above and at his request have stoped sending out the report as it is mis-leading and was not approved by the company. I am waiting for him to call me today and will ask/invite him to make a post here for himself or give me perrmision to post an e-mail here that I recieved from him.

I called them after you sent me the information. I begged them to work with me. I offered 1000.00 down (I had it then now..I got less) and 500.00 a month till it was paid..They flat out told me..unless I had 5000.00 do not waste their time. Then I was told if people like me paid their bills and learned to save their money, I wouldnt be having this problem.
So now we are stuck.
The guide lines say my husband makes to much for a pro bono lawyer
..lawyers want anywhere from 500 to 2500 just to start..(we couldnt offer 50.00 right now)..we are leasing the house out and have tenants who refuse to pay..we dont have the money to file in court to kick them out..we cant get help from the court to get a discount on paperwork.
Between this tenant and the last one (I know your reading R.H.A and we havent forgot you) the bank is about ready to take the house back. We dont understand the law on this matter so I guess we are going to get screwed...bet they wont even spring for the Vaseline neither..bastards.

Response to pre-paying principle

The optimal approach, especially in the first few years of the loan. As of a federal law passed back in 1983, banks must except pre-payment of principle. The key and of vital importance (and this will determine whether this approach is of great benefit) is proper / explicit instruction to the lender in reference to pre-payment amount, where to apply pre-payment (which payment along with payment number), etc. Otherwise, without explicit instruction, lender will invariably apply pre-payment amount to the rear end of the loan (i.e. payment number 360 on a 30 year mortgage) whereby NO interest is paid down and only principle. This pre-payment approach by lenders has been going on for years now. Though 'legal' it is extremely deceptive and essentially of no benefit to the homeowner. This pre-payment money is literally going into that black hole commonly known as the lenders profit margin. NOTE: When pre-paying principle, be very cautious and most importantly learn all you can on this subject.

I would advise people to contact a lawyer in defending foreclosure cases or attempting to do a loan modification. I work for a public interest law firm and we handle defend 100s of homeowners in foreclosure cases each year. There are legal defenses that can delay the court case and in some cases (Truth in Lending Act), a borrower can rescind the mortgage if she meets several criteria.

Attorney General Bill McCollum today filed a lawsuit against a Miami company and its owner alleging the company is engaged in foreclosure rescue fraud. According to the lawsuit, Lincoln Lending Services, LLC targeted Hispanics facing foreclosure and charged up-front fees for loan modification services, both in violation of the Foreclosure Rescue Fraud Prevention Act.

“Our citizens should not be targeted when they are in a time of financial distress and are desperately trying to protect their homes,” said Attorney General McCollum.

According to consumer complaints, Lincoln Lending advertised for mortgage foreclosure assistance and rescue services. The complaint alleges that to get around the statutory prohibition against up front charges, the company would have consumers pay $2,700 for “forensic analysis” services, then sign a contract for alleged modification services. The forensic analysis fee was allegedly created to circumvent the new law, which the Attorney General helped create last year. Lincoln’s business of offering legal services, directly or indirectly, constitutes the unauthorized practice of law and violates FS 877.02(1).

The Attorney General’s Economic Crimes Division determined Lincoln Lending also forwards consumers to an attorney working under the business names of Florida Foreclosure Law Center, LLC and Florida Homeowner Assistance Center, LLC.

The lawsuit petitions the Court to issue a temporary injunction against the company while litigation continues. It also seeks consumer restitution and ultimately a permanent injunction prohibiting the company and its owner, Rita Gomez, from engaging in similar business practices.

Its threads like these that remind me just how much of a family we DPers are. I've never met any of you in person, and yet you're all some of the first people I'd help. As soon as I get some $ in my paypal account I'm going to pass it off to Michael Nystrom and the DailyPaul.

I'm 23 and my only "mortgage" is my mountain of student debt. I'm guessing those lenders also need to be held to the letter of the law or they conveniently forget some details, right? If anyone has some advice in that department (especially you Clay) I would be more than thrilled to hear it!

I got the web sites from you a month ago I believe..my problem..I do not understand 1 blessed word of it..it comes down to having an understanding of the law..some laws I understand this is all greek to me and have no clue where or how to start...Im sure there are many others that would be like me..Clueless....And I have checked with people who can understand it..ALL want money to help..Money is what I dont have.

Now..if anyone would like to buy my house and try it..go for it...I owe under 70,000 on it.

Don't try to make heads or tails of the report then. Call the # on the report and let them do all the work ! It is a free service to have the audit done. If they find enough mistakes they have been known to work 'pro-bono' All you have to do is find your mortgage papers, copy, and send them to them for the audit. Hope this helps.

interest only, not much help

Sorry, but I have to disagree with that. Paying interest only on a mortgage during a rough streak would not be much of a help at all.

For a standard 30-year fixed loan, the first years payment is mostly interest, probably 95% or 98% of the total monthly payment goes to interest. Your plan would only save someone 2% to 5% of the amount of payment, not very much.

For year 15 of the loan, probably 65% to 75% of the total monthly payment goes for interest. A more substantial decrease in payment but still a lot.

By year 25, you probably pay only 25% of the total monthly payment for interest. But by then, you have a substantial equity in the home and can refinance or sell it, no need for any of these financial gyrations.

A better offer is to pay principle only but I doubt if the banks would go for that.

All numbers are WAGs, I'll let the accountants post exact numbers if they want.

This service

has nothing to do with making payments. It has everything to do with holding lenders to the letter of the law (which they all break). And by doing so, drasticly reducing the amount you do owe, if not getting rid of the mortgage period.

I have a friend that I got this information for and have passed it along to other people I think it may help, but it is up to them to use it in the best way they can.
I don't have any good news from any of them yet, but after looking it over myself, I think it is extremely useful and my contact with livefree was positive and he is a stand up guy that is trying to help us battle those bastards, not a scammer. Hope that helps.

Just for the record, and very simply..most lenders will let you pay interest only on your mortgage if your times are tough. I have done this several times and it helps a LOT. You are paying nothing on the principle, but you can use that money for other things in those months. Most are happy to help..some even let you skip payments, and add them onto the end. You would be surprised how often lenders will willingly help you keep your homes..

Why on Earth would you pay

Why on Earth would you pay some one that you clearly don't owe and that has been robbing from you? You must be one 'brain dead' person or at the very least an uneducated twenty's- thirties person that knows very little about the banking system and won't take the time to learn. All the same it didn't stop you from requesting the report did it? And just how many copies have you made to give to others in need? Probably..none.

For me, it was two rounds of illness. Actually it was my wife.
She's doing much better now. The house is not. I had to give it up in May.
It's worth even less than the day I gave it back. I was willing to work with the bank. I was only two payments behind, and there was light at the end of our monetary problems. I would have been completely caught up in about 4 months.
But no, the bank would NOT even attempt to work something out.
Hours, and hours of phone calls. More than once we would reach a point where it felt like progress during the call. I would call to follow up, and there would be NO RECORD of the previous call. So I'd have to start over.
Finally I told them to take the house, I had gotten what I needed from it.
Which was equity to pay medical bills.
It is now their problem. It was a GMAC mortgage BTW, so crappy cars is not their only issue.
