Pastor Arrested cuffed During Sermon ** ME!** update it's over I win!

Well after a long fight toward jury trial they over played thier hand. They kept calling the cops on me with no action taken. Then the D.A. Tried to violate me of my bond to create a crime. I filed a 32 page motion in oposition filled the courtroom with my friends only to have them withdraw their motion and reduce the charge to an infraction.

I filed a motion to bring a stenographer in as normally they don't have them in infraction court.

I served the chief of police because I found out he was possibly involved (can't say more this is public) he was no show. But he got a foia comming.

Well the trial was Monday 13 July and they put the head D.A. against me. I wasted them. Get this!

The wittness said she never said something that was found at the bottom of the statement that the arresting officer typed and had her sign.

Alot of other good stuff. Now I will sue the city and the mug who called on me no less then 6 times for dumb crap like using a public bathroom in a building I particialy own.

I beat em without a lawyer! Me. What joy!

Had my infraction Hearing for the Friday 5 Sept 2008 simple trespass charge. The first step in this travesty.
NOT GUILTY!
and I did it all by myself with out a lawyer.
I cross examined the Cop and asked him if he ever attended law school. Then I asked him if he knew the definition of dicta.
Then I asked him to explain how 4 sentences (3 favorable 1 intelligeble) in a 21 page particial civil transcript of a trial (that i was the plantiff) that took 6 hours be the major issue in the case.
Showed him a picture of a Picnic table asked "do you see the table in the picture?" I replied "Thats used for picnic"
So stupid! My jury trial may be in Feb 2009.
Oh, had my civil lawyers request the video of the supposed harassment 1 day after the event, Had Judge order them to provide it to prosecuter and 3 days later they said they errased it.
But what a pain in the arse this is.

I am currently fighting this charge. But I want to sue the police for violation of my civil rights can anyone help me Know who to contact. My Philly attorneys (my sis) does not want it.

Pastor cuffed during sermon
NORWALK

A local pastor arrested in his
own sanctuary is alleging malicious
prosecution by the police
department in the wake of a civil
suit filed against his church’s condominium
association.
The Rev. Paul Juchniewich,
head of Cavalry Chapel at 25 Van
Zant St., pleaded not guilty to a
breach of peace charge in
Norwalk Superior Court
Wednesday.
Juchniewich was arrested
while conducting services in the
chapel Sept. 7 by two Norwalk officers,
who called him from the pulpit
and handcuffed him while his
congregants watched, a congregant
said. The condominium association’s
manager told The Hour
he had called police after a staff
member received a complaint
about Juchniewich from a parking
attendant. Paul Endri, a Cavalry
Chapel member, said the
congregation was surprised
and “depressed” to have
their worship interrupted
and their leader taken away
in handcuffs.
“We were singing when
the two cops came in and
they took him in the back
and talked to him for about
five or 10 minutes, then
handcuffed him,” Endri
said. “We had to abruptly
end the service, and the
kids were screaming, ‘Why
are they arresting Pastor
Paul?’”
The manager, Winthrop
Baum, a real estate broker
who is also a board member
and the majority owner of
25 Van Zant St. Condominium,
Inc., said his staff
member had received a
complaint that Juchniewich
was creating a disturbance.
He declined to give
any details about the disturbance,
which he said he did
not witness, and did not ask
for details from his staff
member before calling the
police.
“The police came and
made a determination that
he was causing a disturbance,”
Baum said. “It was
their decision to arrest
him.”
Juchniewich said he had
gone to ask a parking attendant
for the Norwalk
Seaport Association Oyster
Festival if he could pay the
$8 fee to park in the lot at 25
Van Zant St. before beginning
morning services. He
was fearful that his car
would be towed during services
because the lot is normally
rented out to the NSA
Oyster Festival and the
association had not supplied
tenants with passes as
it usually does. The attendant
did not sell him a parking
ticket, and that was
apparently the basis for the
disturbance he had created,
Juchniewich said.
Two days prior, on
Friday, Sept. 5, Juchniewich
had been issued a summons
for trespassing in the parking
lot during the festival.
He did not intend to fight
the charge, but his car was
pinned in for more than 30
minutes, he said.
Juchniewich claims that
his summons and onsite
arrest are at the direct
behest of Baum because he
had recently won $510,400
in a civil settlement. That
money was awarded to
Cavalry Chapel after inadequate
repairs to the common
areas of the building
caused a flood on Sept. 12,
2002, that ruined the interior
of the sanctuary and the
office. Court records show a
jury found in 2007 that the
association had violated its
bylaws and acted unfairly.
Juchniewich’s attorney,
Veronica Saltz, said the
flood devastated the congregation’s
ability to function,
as they were without a
space for more than seven
months.
Juchniewich said the
congregation, which is nondenominational,
was growing,
so he viewed the 25 Van
Zant St. location as ideal
when it moved there in
August 1999 because it was
three times the size of previous
locations for a cheaper
rent. However, the congregation
has since dwindled
to about 15 members.
Juchniewich refused to
pay common charges and
assessment fees to the association
incurred during the
flood because he could not
use his space, and the damage
was not the church’s
fault, a letter from Saltz to
Baum’s lawyer states.
The association’s
response was to file a foreclosure
action based on
nonpayment of those fees,
Juchniewich said.
That action is still pending,
Baum said, and is
based on nonpayment of
other fees as well as interest
on the nonpayment. Baum’s
lawyer, Brian Smith,
refused to specify the exact
amount of the lien, but
Saltz said the association is
seeking $110,000, which
Cavalry would like to reach
a settlement agreement on
rather than face eviction.
The settlement is hindered
by the association’s resistance
to disclosing financial
records regarding repairs
and taxes on the property
dating back to 2000, Saltz
said.
An incident report
detailing the arrest was not
available at Norwalk
Superior Court Wednesday.
Sgt. Andre Velez, a
spokesman for the Norwalk
Police Department, said the
department was not
required to file a report
until 14 days after the incident,
but a report filed Aug.
14 indicates that Baum complained
to the police and
attempted unsuccessfully to
use court transcripts to
have Juchniewich charged
for walking in the hallways,
instead of using a separate
outside entrance to get into
the chapel.
Police Chief Harry
Rilling could not be reached
for comment Wednesday.
