I guess I'm indifferent to this protest.... in my view, marriage is not a right. The only rights are life, liberty, and pursuit of happiness + the Bill of Rights. You don't have a right to job- nobody HAS to give you one.... same thing goes for money, house, food, water, etc. While many of those are essential to live, I don't believe the government must provide you for them. That's your job.
I don't think there should be any form of government marriage. I think it's sort of insulting.... marriage shouldn't be a political issue. It's private.... it's a social issue and a religious one (whatever your religious beliefs are...).
If gay people want to be married (and there was no government marriage) all they'd have to do is agree to it between each other. Problem solved. As long as it doesn't effect other people, which it wouldn't if government wasn't involved, because then it'd be more private.
However, since marriage has been thrust into the political sphere, I would say the best solution is to let the states decide. Again, I don't think this should really be an issue for any government.... but, under the Constitution, if a state or local government wanted to make a decision on the issue, then it's in their right to do so.
I don't really have any sort of personal view on gay marriage... but I would say, the people of California and other states where similar gay marriage bans have passed were given a choice. Both sides had the chance to get their views out and campaign. People voted. Their voices were heard.
You might say, "but I don't want the mob/majority to vote my rights away...." Well, I agree, but again, I don't see marriage as a right.

But, you are right. Marraige is simply a agreement between two people.
Personally I think Homosexuality in Most cases is a genetic issue with the purpose of not passing down a potentially defective gene sequence. It is self evident that the family unit of a man and woman is for procreation and raising of children. So that it is a morally neutral question and gays should be allowed to be recognized as "married" by the state, allowed to adopt but not procreate.
But this does not detract from the fact that at the heart of the "issue" is the gay communities dire need to get a stamp of approval by society for their lifestyle. Because if one looks at it they already can through other legal channels achieve all the legal rights and even better of a legal partnership called "marraige" through other means and not mess with the accpeted definition of marraige since the beggining of time.
They are only asking to change the definition of a word since that has been the same since the dawn of mankind... Not a huge request at all.

the whole debate about gay marriage is they want it recognized in order to be treated the same under "laws" and "taxes." Our taxes should not even be the way they are, they are fighting the wrong angle. The laws, there are ways for gays to get around those.

In order to benefit from the "laws"...government has to be involved. So the gay agenda is not to keep government "out" of marriage...but for government to "control" marriage (to their benefit of course).
Sure, they could address the issue by attacking our current "tax" system...(and as a result help the heterosexuals as well) but they tend to be more selfishly interested in their "gay rights" and figure they will win easier with the "minority" rights approach...that seems to be the hot topic of today.

here is my question...
what exactly IS marriage? who came up with it, who defined it and who cares? after two divorces and alone time well spent, i finally hooked back up with my best friend and lover (i happen to be "straight") and he asked me to marry him. i said "no" and the reason i said no was and is because i DONT BELIEVE IN MARRIAGE. thats right. when i was finally faced with the real question, i realized that marriage is a man made law, enacted for the good of the coffers of the state, the IRS and the churches. Funny how the older i get, the more i want to be left to my own!! screw marriage. it is but a measure for others to judge if you are a "sinner" or not. I prefer to be an individual in love with an individual!
i feel perfect about this whole situation now, and it is only a situation as on my mamas side of the family, there is a christian sister, a penecostal sister and a catholic sister while my mom is more spiritual. cant wait for thanksgiving!! LOL i am taking my individual lover with me!!

You hit the issue squarely on the head. I believe that anything we do as humans is a human right as long as it does not harm, infringe on other peoples humans rights, kill, or result in theft from others. But, I do not feel we would want to obtain any of these rights from government because government abuses and gets corrupted. We should have the right to have the ability to survive as humans blah blah blah.
Having said that I will NEVER get married because obtaining a marriage license has become a contract with government. Government gives you the "permission" to marry with the license. This is why in order to end the marriage (contract with the state), a person must end this contract in a court of Maritime law. We are no longer under common law as the Constitution created. We are now under Maritime law that was created in 1873 when the "United States Corporation of America" was formed. I believe 48 of the 50 states are also now corporations that use Maritime law. This is why we are required by the state to obtain permits, licenses, registrations, etc. to practically do everything now a days. They are all contracts with the state.
My reasoning for not marrying is obvious. I do not want to be in a binding contract with any form of government. I have seen time after time good people who are impoverished after divorce court. When I tell my family I will probably never get married they have assumed that I am gay. I am not homosexual but I am heterosexual. If I tried to explain this to them that it is nothing more than a legal decision, they would either think I was a kook, gay, or perhaps a threat since I do not kiss the governments ass like they do.

There are 2 kinds of Law
There are 2 kinds of Law practiced in this country concrening marraige. Common Law and Statutory Law. Common Law is the Law of old, it is Law of the Constitution. Statutory Law is law written by the Government. It is a Government Privledge, and comes with strings, as do all privledges. Marriage under Common Law does not require a License. Divorce under Common Law requires that one go to a Court of Common Law. Unfortunately, all the Common Law courts have been closed. So the Government has made provisions in the Statutory Court for disolving Common Law marriages. This is why people of Common Law marriage find themselves in Statutory Courts, following Statutory Law for Divorce. And the only way you can demand a Common Law Court for a Common Law marriage is if you've not entered into Contract with the Statutory Jurisdiction (you've claimed your US citizenship).
The Government likes marriage, if you've noted it is a "manufacturing" contract for future workers. That's why you get a tax deduction for marriage. It is the Government's investment in future tax payers. They know that the tax break they give the parents will be returned in the first several years of tax collection on their new tax payer. This is also the reason the Government is against Gay marriage, it provides a tax deduction for people whom are not able to produce new tax payers.

have! The right to marry anyone one of the opposite sex. Instead of fighting for their individual rights ( which they let slip right by them ) they want something that deviates from the norm, hell, they will fight for that. Meanwhile the government steals more of their liberties while they fight for something that is not a right. Whats next man boy love marriage? A fifty year old marrying a ten year old? People hooking up with farm animals? Comeon damit, if you chose the lifestyle, understand that you HAD the same rights everyone else had, so deal with it.

The government
should not even be involved with marriage. We also shouldn't be taxed for being married. One of the articles about prop 8 complained about following the Constitution. Hello, why should we just follow the Constitution for this. We should already be following the Constitution. I believe if government weren't involved this wouldn't even be an issue.
