Overview of the Issue: - [Take Action]
Members of the Republican caucus in the Ohio Legislature have decided the time is right for a Constitutional Convention (Con Con). A new resolution House Joint Resolution (HJR) 8 has just been introduced which petitions the US Congress for the calling of a Con Con. In the resolution the purpose is ostensibly to bring before Congress a balanced budget amendment to the US Constitution. Indeed, the resolution is crafted with a limitation on Con Con members which only permits them to discuss a balanced budget amendment and forbids any other discussion. On its face it appears to be a noble effort. ....................

The companion resolution to HJR8 was just introduced in the Ohio Senate the afternoon of December 9. It is SJR9.
The Senate co-sponsors are Keith Faber (lead sponsor), Tim Schaffer, and Bill Seitz.
It has not yet been assigned to committee.
Once again, these are all republicans. Someone from each state needs to check their legislative rolls to see if their state has anything on the books reflecting the same thing Ohio is doing. There is a motivation for this happening right now, during a lame duck session, right before the holidays.

I'm back from testifying.
I'm back from testifying. There were 10 or 11 of us who spoke out against it, ZERO who spoke in support. After seeing all of us show up, they changed their mind and decided not to vote on it today, but Teri thinks it'll probably be voted on during the 2nd committee meeting, so we need to keep watching. The Senate version was introduced yesterday as well, but last I heard it hasn't been assigned to a committee yet. Still another thing to keep an eye on.
Everybody's testimonies were GREAT, we plugged so many issues that related to the dismantling of our Constitution. I plugged RP's HR 2755 and suggested they support that instead if they really want to worry about federal spending.
The committee had some questions (they interrogated Teri, poor girl) and voiced some concerns, enough that I definitely think we have a good shot and getting this defeated!! Robert heard some hopeful comments that hopefully he'll share with you all soon (check the Ohio Freedom Alliance forum.)
Anthony from We Are Change Ohio recorded all of our testimonies and hopes to have a video put together by Friday, I'll post it as soon as I get it.

Still has to be ratified...
Even if they propose a Con Con with some crazy amendment then it still has to be ratified. The shortest time between proposal and ratification for any amendment to the Bill of Rights is about 3-months (26th amendment). In addition, according to Article 5, US Congress decides if the state legislatures or state conventions ratify the amendment. So I'm not worried about this one yet. We've still got the 2nd amendment.

I think you are referring to the usual amendment process (initiated by congress) rather than a constitutional convention.
A Con Con is not "ratified" it is called; and once it is in session ANYTHING can happen. Amendments made by a Con Con DO NOT need ratification.
They ARE the LAW.

We would actually have to go through the process of REPEALING the amendment (which is darn near impossible).

What is the process?
So when did 32 states call for a Con Con? Do they just hold on to each and every request till they have enough to dismantle the Constitution? Which states are on board with this and do their constituents know? I don't understand Ohio's motivation, because, as someone else pointed out, an amendment would address the narrow questions at issue.

Take a lesson from Vatican II
This is the Catholic Church equivalent of the Constitutional Convention. When the second Vatican Conference was held, the pronouncements that issued from it were considered to have the force of Canon Law, even though those pronouncements were never legally promulgated. It is the same tactic always used by the left to bury opposition to their agenda:
1. Agents infiltrate the organization at all levels
2. Call for "dialogue"
3. Feign respect for tradition
4. Introduce and insist on radical changes "for the common good"
5. Announce controversial issues have been agreed upon and have highly placed media report new status quo, thereby stifling all future debate.
Whether one agrees with the outcome of Vatican II or not, there can be no question that the innovations it introduced were never legally authorized by Church law. In much the same way that our lawmakers quietly undermined our Constitution, Modernist forces within the Church disseminated their views and undermined the faith of Catholics. They challenged orthodoxy and invited rebellion in every area of dogma until it seemed to many that there was no more unity of purpose and the scourge of "Ecumenism" has now decimated Catholic teaching. In other words, relativism rules and truth is what men make it.
Our Constitution, once opened for revision, will cease to exist. We will be told it was all democratically decided. Our last line of defense will be gone. God alone will be able to help us, because the elite will have free reign to make any law they please.

but why a convention ?
Amendments can be added without a convention.
Not sure Ohio can legally call for a convention...
The possibility exists that they aren't legally a state in the Union. Do some research on this. The last attempt to bring it about (according to my friend who has done extensive research on this) was in the 50's. One problem with this:
They made it retroactive. They had to in order to keep all the possibly bogus laws passed with the votes of the reps and senators from Ohio on the books. However, retroactive laws are forbidden due to the ex-post facto provisions...
My friend has never steered me wrong on anything and his research has been accurate every time I've looked into it. Check it out for yourselves.
After looking into it briefly just now, my feelings are that Ohio became a state as soon as they passed their Constitution per the enabling act of Congress as does the writer of this piece:

However, they really clouded the issue in 1953:
"Republican Congressman George Bender- who hailed from the appropriately named town of Chagrin Falls- was concerned enough to introduce a bill on the floor of the House on 19 January 1953 that would retroactively admit Ohio to the Union as of 1 March 1803 (the date the Ohio General Assembly first convened, thus formally instituting State government in the State): this proposal would allay any fears regarding the legitimacy of Ohio's status as an American State and also officially declare a specific date as the date Ohio became a State (conveniently, as well, this date would also so clearly make 1953 the State's Sesquecentennial year). The House passed it viva voce on 19 May and the Senate followed suit on 1 August (though the relatively slow progress of Congressman Bender's bill probably well indicates the rather low priority it had amongst all the policy initiatives of the new Eisenhower Administration); President Eisenhower signed it into law on 7 August 1953 (which also happened to be the anniversary of the Northwest Territory Act of 1789; perhaps this, too, had much to do with the delay in the bill's making its way through the 83rd Congress)."
There was no need to do this with this bill. Does it nullify the previous laws setting forth the the terms under which Ohio was to be admitted (which Ohio satisfied IMO when they drafted a state constitution)? You decide.

Let's use and enforce the one we have!
This would be a great rallying point for state organizations to work to stop or rescind calls to a Constitutional convention.
This would help spread the word of how many of our problems are often due to our ignorace of Constitutional principles.
This would be our chance to establish a good reputation with our friends and neighbors. The goal is to show them that indeed, "Fox News sucks!" by being passionate yet rational supporters our Constitution.
From that base we can move forward by supporting people and reforms as supported by the law of the land.
