If You got to re-write the federal constitution what would you change?
Obviously our founding fathers did a great job with the constitution, and since they knew they couldn't do a perfect job they allowed amendments to be put in there to make it even better (that has backfired some) so my question is in hind sight what would you do to make our fair constitution better?
I would Limit the number of federal laws allowed on the books to 500.
I would Limit the length of a bill to be no more than 1000 words
I would either set senate terms as two years or make it only one term of six years. I have not made up my mind which is better but since I am still ticked gramnasty got re-elected I am leaning toward the latter.
I would not allow the federal government to do anything with school. No money, no advice, no test, no nothing, ever since washington got involved in our schools in 1959 we have became dumber and dumber as a nation!
Presidents should be allowed to be voted out with no confidence votes.

Are we talking the very first version of the constitution? If that is the case then I would...
- put in an amendment saying that another human being cannot be considered property
- put in something that includes breaking up all of the representatives into districts. For example, 1 representative for 1000 people would be at the precinct level, 1 representative for 10,000 people would be at the county level, 1 representative for 100,000 people would be at the state level, 1 representative per 1,000,000 would be at the house of representatives, 1 representative per 10,000,000 would be in the senate and 1 representative per 100,000,000 for supreme court justice. That works out to 300,000 precinct reps, 30,000 county reps, 3,000 state reps, 300 house reps, 30 senators and 3 supreme court justices. Then we would have 30 states instead of 50 and the borders would have to be redrawn. My whole point is that then you could have it all. Grassroots power and no bureaucracy at the top.
- Following the above, I would make it so that the people directly elected precinct reps and then those precinct reps would vote for the county reps and so on up the ladder. Kind of like what we are supposed to have as a republic.
- If a representative doesn't vote constitutionally, that can be challenged in court and if the courts decide they voted unconstitutionally, they are immediately impeached and new elections must take place.
- Force can only be used in opposition to force.
- I would put something that guarantees the right to privacy from the government as long as you have not committed a crime.
- I would put something that says the government can only collect revenue from those who do not have the rights guaranteed in the constitution such as people who commit crimes. That way it would control government spending and the only people getting their property stolen from them (taxes) would be those who had broken the law (such as speeding).

A non-amendable clause in the constitution that goes as follows ....
Only the states have the power to coin money.
(In this day and age there should not be an issue with 50 different currencies. Additionally, for all you chess players, it would be quite difficult for the federal government to collect any taxes beyond what a state would be willing to give.)

rewrite the constitution
1. limit the pardon power somehow (it seems to get abused)
2. say that the each member of the house should represent no more than 60,000 people (thirty-thousand.org)
3. say that any pay raises voted in would not take effect until the next congress (thirty-thousand.org)
4. i would make the executive branch have 3 co-presidents (that would help ensure nothing gets done. (on the back of a cereal box, i read that this was considered)
5. would have definitely got rid of that 3/5ths crap.
6. would make it sure it says "man" when it means male and "person" for gender neutral. (ie let women have the right to vote straight off the bat)
7. i would have made every law to be passed have to be by super majority (again, make sure nothing gets done)
8. created a secession clause to provide a way out of the union
9. created a 'acquisition' clause to proved for louisiana purchase sort of things.
10. would say that all laws set by congress have to expire after 5 years and must be renewed as if a new bill (again keep them busy from screwing things up)

Terrorists attacks
All terrorists attacks or incidences that are recognized as such and occur within the United States, shall go through a full investigation.Those incidences shall be investigated before any pursuit or military engagement is declared by congress on any individual or country. No procedures can occur until a full investigation has completely occurred. (perhaps set a time frame? full investigation is defined by how?) Any evidence showing knowledge prior or conspiracy in the help of a false flag attack by any government official and government branch shall be tried for treason. (Perhaps something explicitly stating the punishment for lying?)
This isn't that great, but it is a start for someone else to expound on or rework.
This makes for a fun game.
But the truth is, we already have as explicit a Constitution as we need. It is not being used, because it has no teeth.
The schemers figured out long ago that if you hold periodic elections and periodic trumped up wars, hire lots of cops and troops, and throw around bullshit about 'Democracy'--you can ignore and trample the Constitution as much as you like. What naked military power and ceremony can't cover can be fixed with corruption and ownership of the Press.
Bush is living proof. He is the most impeachable President in history and he's retiring to fashionable north Dallas in luxury, with the media and even Oliver Stone kissing up to him.

I would change the wording of the 2nd amendment
to: The right to bear arms is not a privilege but an absolute right for a Citizen of the US or any person lawfully living in the US. This right is not to be regulated and no one will be required to register their arms. Travel with arms across state lines is also an absolute right. These rights can never be removed by amendment or by any other means. Any law in conflict with these rights are null and Void and do not apply to these rights.
Further I would eliminate the fourteenth amendment. It was never ratified by the states. Congress illegally adapted it in spite and it created a new type of citizen with no rights.
Also the congress should not be allowed to give them selves raises.
Last but not least it should be a punishable crime to violate the constitution
with mandatory sentences.
It should also be illegal for officials of our government federal state or local to lie to the public. Also punishable with severe sentences.
The missing thirteenth amendment should be reinstated which would eliminate lawyers.
No income taxes on which would eliminate the IRS etc...

You are born with this unalienable (un-a-lien-able) right. It is NOT contingent upon you being a US citizen or where you choose to reside or live.
I see that you want to get rid of the 14th amendment, yet you use the citizen class that it created in your 2nd amendment revision....

17th Amenment - since they were not ratified, they have no business being there!
No elected offices, no public schools
1. Change all seats currently elected (President, Senate, House) to be instead selected at random as a kind of jury duty. E.g., for each seat, randomly select 50 people, and those 50 vote which of the group gets the seat.
2. Prohibit public education. Note that this is directly opposite of what Thomas Jefferson wrote into the Virginia Constitution guaranteeing public education. I think he got that one wrong.
A few ideas.
1. Supreme Court justices absolutely should not be nominated by the President of the United States.
2. There will be official recognition of the right to secession by the states, to be formally listed as a fundamental in Article I.
3. Remove the Commander in Chief status from the President. The entire military chain of command should answer to Congress, not the President. This may have the unpleasant side effect of making all future wars difficult to wage. (That's the general idea.)
4. Presidential Executive Orders are forbidden, along with Presidential Signing Statements. "Attempt to govern by fiat" should be officially listed in the Constitution as an impeachable offense,along with and in addition to treason or "high crimes and misdemeanors".
5. All federal police and national security agencies--regardless of their "importance"--must be permanently abolished.
6. Federal land should be limited to National Parks and military bases only, and should be maintained as no more than one percent of the nation's land mass. Any additional federal lands must be auctioned off periodically to the American people.
7. US military bases in foreign lands should be illegal, regardless of treaties or alliances. No military bases may exist anywhere other than the continental US, Alaska, or Hawaii. Military prisons are banned. Military tribunals are banned.
8. All federal laws automatically sunset every four years. They must be formally reenacted by Congress and signed by the President, or they will expire permanently. Federal prisons are abolished.
9. The Income Tax will be abolished at the federal level, and replaced with nothing.

I would add: The constitution means what it plainly says. It is written in English and needs no 'interpretation'. Jurors may consider the constitutionality of laws based on their understanding of the plain language of the document.
I'd also put something in there to the effect of:
Any and all revenue derived from taxation shall be used solely to provide funding for those activities which the federal government is explicitly authorized and commanded to undertake by the constitution.
Then I'd tighten up the language around the 'General Welfare' clause so that it explicitly stated that no citizen of these united states shall be compelled to participate in or contribute to any federal or state run safety-net/welfare program, etc.
And lastly I'd neuter the 'Interstate Commence' clause, making it explicitly state that congress may only regulate things DIRECTLY related to interstate commerce; that is to say items that have not been shipped, or that have already been shipped across state lines, are no longer the concern of the federal government.

Panarchic Constitution
This is a project I've been working on for a while, so forgive me if its a little long-winded, feel free to contact me at panarchist@rocketmail.com if your interested in this project.
When running for office, you can only promise plans that you can legally prove you would have the proper authority to enact. These promises would be held as a contract, with the people, and if you violated them, you would be impeached. The only trial would be to determine if you had broken your word. The runner up in the election would replace you. They would be held to the same standards, impeachment would continue until you were left with an honest officeholder.
If two members of the legislative branch both deem a law to be harmful, than it will not be passed as a law.
Their would be several competing government systems in a single area.
The federal government would only need:
to provide a currency exchange (based on the cost of living, which I'm currently working on determining more concrete terms for) in order to extend barter networks
a high court with representatives from each system in order to settle disputes between the competing government systems
a process to help the average citizen setup their own system if need be. This right would be held as sacred as the freedom to choose ones religion. This would include a library of resources and information on the competing systems.
One would be considered the citizen of the system that ones parents are, until they are able to pass a test demonstrating an understanding of the laws of a system that they would like to apply to. Once they can pass this test they would be legally allowed to sign a citizenship contract where they would voluntarily agree to the laws and taxes of the applied system. No punishment could legally be used on a citizen that they did not agree to in the first place. Except in the case of those who are under the system of their parents.
Contracts would last for no longer than 2 years, at which point a citizen could go to another system or renew their contract.
Since I want competing systems.
Since we are one state away from a constitutional convention, which would completely scrap the current constitution.
Since having a community that is independent of money and government is wise and prudent as a preparation for harder times,
I am trying to put this system together. I am writing the guidelines for a Panarchic (multi-system ruled) Society, and I will right my own constitution. As soon as I have enough people for my system to be sustainable I will live under the system that I choose. If the US government which does not represent me, tries to invade, and kidnap, they would be treated as criminals.
No need for any "ifs" go ahead and write it. If you have enough people who will agree to live under it, than live with that community.

When you create a monster, you will use up all your resources trying to reign in the powers of that monster. You will lose.
The solution? Don't create the monster. Or in this case, eliminate the monster.
There is nothing the state can do, which society needs done, that cannot be done far better by the market.
Mmmm 'providing for the common defense' and
basic 'fire fighting / law enforcement' duties ought to be done by the government. Market forces may foster efficiency, but certain activities require impartiality. Putting public safety considerations in the hands of organizations who are strictly concerned with their bottom lines and short term gains is not in our interests.
Government vs. Free Market
You said that certain services, such as law enforcement and fire fighting require impartiality and businesses are concerned with their bottom lines and not our interests.
It is precicely because businesses are concerned with their bottom lines that they will do what is in the best interest of the customers. They have to compete for customers so it's in their best interest to provide excellent services at minimum cost.
In a free market, law enforcement wouldn't be spending most of their time writing traffic tickets, they would be fighting crime, because this is what the people want and we can switch to a different security force if we are not satisfied with the services. As it stands now, government has a monopoly on providing law enforcement. No competition is allowed (Just like no competition is allowed on money because of the legal tender laws. Only the Federal Reserve can print money vs. having the free market decide what is money.)
Corporations are bad when government gives them special privileges - this is known as corporatism. Examples: Halliburton and Big Pharma. But these examples are not examples of the free-market at work. A good example of a free market is computers -- prices have gone way down and performance has gone way up.
Government, on the other hand, has very little incentive to provide the best service because they will get paid no matter what, through taxation. This is why government is inefficient and expensive.
Look at what happens when you remove the feedback mechanism that exists in the free market ---

If your amendments to the Constitution would undo evil, that means that the Constitution is a vehicle which allows evil.
Your changes will still allow evil because evil will find loopholes.
The problem is the structure. The structure that we have is rotten. It's not bad leaders or politicians, it's government itself.
We can vote all the bums out and then the next generation could be fooled and vote them back in.

Right now our government is infested with secret society members and sociopaths. If you can't see that then you haven't been paying attention.
As long as individuals with no conscience and secret loyalties are running the show, the Constitution means nothing and the government will not represent the people.
