A Constitutional Question?

After analyzing the Constitution I've reached a perplexing question regarding how the presidential electoral process is carried out. In Article 2 Section 1 of the constitution it states: Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President.

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

Could someone clarify the meaning of the above section of the constitution. And; could someone answer this question- Is our government currently adhering to this electoral process or is the government using a Democratic(de facto) electoral process.

Several ammendments were made that modify that section

check out the 12th amendment instance.

But as to the above section, the parts that aren't altered via amendment are followed fairly well. We still use electors and how they are allocated is up to your state. Most states, Maine being the only exception I can think of off the top of my head, allocate their electors in a 'winner take all' fashion -- meaning that the candidate with the most votes gets automatically gets all of the electors. This is why you tend to see a blowout on the electoral map every year despite the fact that the Democratic and Republican candidates had around the same number of votes.

De-facto? That's an understatement. You think the CONstitution pertains to us? I wish. Three reasons it does not. First and most important reason IS.. YOU DON"T GET YOUR RIGHTS FROM A STINKING PIECE OF PAPER!! YOU RIGHTS ARE INALIENABLE FROM THE CREATOR. Whether it be GOD or pond scum. Second, the court systems here do not recognize it. You for the most part, are not in a constitutional court. You are in a UCC court. Uniform Commercial Code, which is the law of commerce. Also known as maritime law and admiralty law, thus the yellow trimmed flags in these courts. Does commerce have CONstitutional liberties? NO. You can be held in contempt and cited for even mentioning it in these courts. They call it criminal trespass for citing a document you were not privy too. Third, you were not privy to it, meaning, if you were not one of the original signees or one of the 50 states. IT DOES NOT APPLY TO YOU AND IT NEVER HAS. Defacto electorial process is putting it mildly.
