Violence only gives law enforcement an excuse for their violence. The quiet stands that African Americans took for themselves in the 60's gave police no excuse for their violence only exposed the crimes they were committing against innocent people. That is why it worked. Between this incident with reports of "bandana" rioters turning a peaceful demonstration into a riotous mob, the man in New Orleans, the undercover's trying to incite riot at the RNC and confiscating journalists equipment, Army "stationed" in US, Marines "patrolling" in Cali, the constitution free zone, border patrol stopping us for no reason, threats of Marshall Law... is it possible they want an excuse to inact Marshall Law? Don't give them an excuse for violence by committing it yourself. Am I wrong?

...this is an unfortunate incident at its foundation. Lots of humans have been and will be directly and indirectly affected. Of all of them there are no innocent victims; so they are as we could be presented with the same happenstance. There are no exceptions only deviations producing the same pattern in a different way.
Record and communication are definitely the most important concepts of the day still. If this were 20 years ago...
Be wary of snap judgments and reactions. Don't put aside empathy either in either case.

Jean Charles de Menezes was unarmed and offered no resistance. Jurors were not permitted a verdict of unlawful killing but based on evidence presented they came to an open verdict. Fellow travellers statements were very damning. Jean Charles had absolutely nothing to do with the bombings. An innocent passenger. There were some apparent attempts at cover-ups as well. I am sure the officer involved did not get out of bed intending to shoot and kill someone that day. They were following orders..... However, there has to be a point where police recognise that there is no resistance, the person is not armed and that shooting to kill is not an appropriate reaction. Passengers in the 7/7 case said they were not even aware that they were police officers. I realise that 7/7 was a completely new and stressful situation but does this mean that we are sitting ducks even if we offer no resistance?

States that one of the officers tried to confiscate the camera. This folks, is crookedness at it's finest. Not only did they just participate in a murder, but they also tried to cover it up by confiscating visual evidence.
I hope they spend the rest of their lives in misery.

Condition Black is an un-official term used in police wellness training that suggest hyper emotional break-down.
What happens is you resort to training -- you can perform complex actions without any awareness that you are doing it -- its a state of functional deep fear.
Officers train 1000's of times to draw their gun, but rarely train to draw their Taser.
The other officers in the video stand-up and move back as they would when a taser is being applied -- Merhsele draws his gun and fires. Then looks shocked as did the other officers.
This is a classic stress reaction -- I doubt seriously he left his house thinking he was going to kill someone that day. Regardless a whole life was lost and they will need to make an example of him while they continue with their failed policy of piss-poor screening and drastically reduced altnernative training.
A retired police officer and I put on wellness, stress management, fitness/nutrition, and conscious-sleep training for all emergency servies personnel and our program is highly successful -- when the departments deem it relevant to send their personnel.
The problem is 97% of police budget goes toward tactical training while 3% goes toward "wellness" -- 98% of all their lawsuits are stress and health related (workmens comp, psychiatric, and lastly shootings). It's no wonder these things happen.

But, really there can be none. From the footage of this incident we can clearly see that any "threat" the police claim to perceive is completely unfounded. Not one among the entire group of hoodlums is even making any effort to engage the police.
Besides, no police training of any kind can eliminate one's basic responsibility as a human being. In fact, the use of a taser in this situation would have been just as egregious, if not as deadly. These police officers should all be tried for murder, because they all enabled it and were in a position to prevent it.
I understand your loyalty to the blue line, but its time for Americans to stand together and denounce this abuse of power. Thugs with a badge are still thugs and they do great damage to the reputations of legitimate law enforcement officers.

at least not the actual shooting and I have only ever done a little target practice with an ancient rifle so I do not profess to have any detailed knowledge about the use of guns etc. However, if someone is pinned to the ground in the manner shown then how on earth could he have been a threat? But above all a taser gun must instictively feel very different in your hands to a gun and in any case wouldn't a taser shot at close quarters also have severe risks? I can't understand how anyone could use the word "accidental" Please! I just have to add this: I am a middle-aged British woman with no experience of any of this stuff. I'm an artist and a teacher. But if contributors make me heave a sigh of frustration at the low level of reasoning on this topic then they can be assured that they couldn't possibly fool anyone else.

1st Degree Murder:
First-degree murder is defined as an unlawful killing that is both willful and premeditated;
1) Officers are taught only to draw their weapon when there is the necessity of using deadly force. When using deadly force you always aim for center mass, or to kill. Deadly force is never used to injure or disable a person, i.e. shooting in the arms or legs.
2) This person was already restrained on the ground when the officer decided to use deadly force, drawing his weapon and excuting him. Obviously he didn't know there was a camera recording everything, or he never would have even drawn.
3) That is premeditated murder. The officer drew his weapon intending to use deadly force, and he did.
This officer deserves the death penalty, even more than a normal citizen does, because he is trained professional and knew what he was doing.

And the video doesn't support the notion that it was a volatile situation. The subject had surrendered and there were no other parties offering resistance or any threat to police. A premeditated act doesn't require that the victim is known to the murderer, only that the intention was formulated prior to the act. Clearly this killer had time to formulate the intention as well as the knowledge that the victim was entirely helpless and at his mercy.

I think it's obvious what happened after viewing the incident on video. The accidental shooting could have been easily dismissed by the police officers involved as something else. All this entire incident illustrates is that more video cameras on citizens is a good tool to ferret out the lies, misrepresentations and CYA that normally occurs on both sides of these things.

although the suspect was face down and handcuffed the officer with his knee on the suspect neck was not applying enough pressure and this was noted by the officer (shooter). He should be given a medal for saving everyone that day...
