Homeless man sentenced to 10 days in jail for eating fish from stream
A 23-year-old transient was sentenced to 10 days in County Jail on Wednesday for catching and cooking a federally protected steelhead trout from San Luis Obispo Creek.
Victor Manuel Silva was convicted of illegally taking and possessing wildlife. Wildlife officials said the poaching was a blow to the species because the fish was an egg-carrying female that was killed before she had a chance to spawn. Her eggs were strewn along the banks of the creek.
Silva was arrested Sunday at 5 p.m. at the Elks Lane Bridge over San Luis Obispo Creek. Warden Teri Hickey had responded to the area as a result of a tip.
When she arrived, she found a group of three or four homeless men camped out beneath the bridge, cooking a large fish over a fire and getting ready to eat it.
“They had slices of lemon and a loaf of sourdough bread,” Fish and Game Lt. Dean Hileman said. “It was almost a meal fit for a king.”

How does that equal individual freedom? I'm not attacking just want to see where your coming from. I get that your concerned about having species continue and game laws being enforced.
But, with all the screwed up things government has done, what makes you believe them when they say a certain fish or mammal needs protecting and you can't fish for sustenance out of a public water way. We the people own that, not the government, no matter what they say.
Would you really have a man be a ward of the state rather than fend for himself? Below I made a satirical point about, if I were him what I'd do, but seriously, if a person is hungry and has the know how to procure food for themselves, without becoming dependent on the rest of us which is better?
If me or my family is hungry, then the heck with artificial game and fish laws, written and passed by folks that have never even seen a fish that wasn't already cooked.
An example of government conservation laws: Last time I went deep sea fishing in the gulf of mexico, the feds had lowered the creel limit on Red Snapper to 2 fish per person, we left at 7 am, by 8:30 everyone on the boat had reached their limit, we spent the next 10 hrs catching snapper and throwing them back. The limit was artificial, not saying the trout thing is, but why believe the government?
As a rule of thumb it would seem prudent to actually find the exact opposite of any government rule or regulation and instead do that.

Individual Freedom
His individual freedom is the right to buy a license and follow the rules.
I pointed out in a post below, I too have issues with fish and game.
I believe our government lost its way when they went off a conservation agenda and onto an environmental one, UN Agenda 21..

I disagree I believe the government (in this aspect) lost their way when they decided they knew better how to run people's lives, what they eat, what they wear, what the grow, where they go, etc. than the individual.
I agree whole heatedly with you on the UN, but I take it a step further and leave it up to the people. To provide for their life, liberty, and pursuit of happiness.
I also agree with you on he/she/them have no business on private property, that is trespassing and definitely poaching. But notice I said private property.
If I am in the middle of my 75 acres, my family needs the meat, and the best time I can get a deer is 1 in the morning in the middle of summer, that is no business of the government. If I am on another persons property that means I have violated the rights of that property owner.
As far as public property I can see where discharging a firearm could be very problematic, however if we the people are hungry, we the people have a natural right to catch a fish, or somehow trap, stun, or otherwise procure food on public land, it is our land. Should we butcher all the game and dynamite the lake? Of course not. I see where you are coming from to an extent, but I believe that mans natural right to life, liberty, and the pursuit of happiness trumps his "right" to buy a license, or become a ward of the state.
From a standard of conserving resources, I can guarantee that guy could eat fish for every meal for the rest of his life, and not squander near the resources, natural and otherwise that the government would waste on keeping him for those 10 days.

I think it would be wonderful if man's natural right to persue life, liberty and happiness was possible, but it is not because the system that has been placed before us finds there is profit in making misery, not happiness.

Good thing the men on the frontier didn't have these problems or most of early America would be sitting in jail. Is that we have a system designed to fail, We do not have a wise and frugal government. Mary Croft says we haven't had a government since the federal reserve bank took over. I can believe that.
We have a corporation running this country that would rather shoot all the buffalo to control an native indian population and then blame the indians.
So what I'm saying is, while I think and belive, it would indeed be a blessing to have a government by, of and for the people, and our elected actually stood for the principles in the constitution and bill of rights, they don't. They are nothing but armed IRS agents doing to US what they did to the American Indian Natives before, but on a much larger scale. The eye in the sky isn't imaginary..
Ron Paul has a sign on his desk, "Don't steal, the government does not like competition". That is exactly what this is about, and what's going to happen with this news is the CA government is going to make sure everyone knows... no fishing, no hunting, no gleaning,... they have approved the FEMA camps, so fishing because youre starving is going to put you and your family there. Is that right? NO! That is the way it is, and I don't know a soul who voted for it.
Least we forget the pioneering Donnor party, where they had to eat each other after being caught in a raging snow storm and trapped in the Sierra/Tahoe for months.

You think that nature is there to benefit you. You find out the government has already laid claim to nature and you may only use it at their discretion.
You may hunt/fish so long as you purchase a license and stay within the government's rules of how much/how big/how many of each you are allowed.
When your family is starving, do you really care what passes in front of your muzzle? Do you still take out your trusty ruler when you land a fish? Hell, if you can afford a license you probably don't need to hunt or fish.
What a dumbass system we've built.

If I was him I'd catch a trout every 10 days all through winter
and cook it on the fish and games front porch. That way he gets a good meal and a warm place to stay for 10 days at a time.

Good for Fish & Game
Like most hunters and fishers, I have issues with fish and game. I have allot of issues with fish and game.. they make cojo endangered and that's all I pull up for example.. And some of them have no dockside or roadside manners, so to speak, but we have rules and I appreciate the rules being implemented especially when it comes to poaching and those who don't bother to get certificates and licenses and trespass and leave trash, and more... when it comes to homeless hispanic men in CA, many Californians who are outdoorspeople know they are pot growers, who are destroying our national forests and parks... which wouldn't be happening if cannabis was legal, which shows it is the system, this war on drugs which is destroying the environment, the wars on people for their natural reources, including their labor as a commody, the WMD like HAARP... Also in CA, SLO a college town, there are plenty of food banks and shelters. What these men did, homeless or not, was immoral in this day and age. It would be another thing if it was a mistake, as I would feel it was an expensive lesson, but it was no mistake. They know what the laws are. The great outdoors has so many armed federal agencies LAOs, I bet they were told about the fish before whoever told them tipped F&G where they were.

Sorry Granger, I couldn't disagree with you more. Buying a permit or license is asking the State for permission to hunt and fish, which is a natural right, but they have this twisted idea that it's a privilege. Personally I despise the DEMOCRACY where the majority tell me how, where, and when I should get my food. Purchasing expensive licenses are just a form of heavy taxation on food. Sounds to me that in California your having a problem with litter and trespassing, and to that I say fine the litterbugs and shoot at the trespassers. It's not immoral in any day and age to feed yourself, but making laws against it is.
