IN THE HOUSE OF REPRESENTATIVES

January 6, 2009

A BILL

To provide for the implementation of a system of licensing for purchasers of certain firearms [All Handguns and semi-automatics] and for a record of sale system for those firearms, and for other purposes.

SECTION 1. SHORT TITLE;

(a) Short Title- This Act may be cited as ‘Blair Holt’s Firearm Licensing and Record of Sale Act of 2009’.

SEC. 2. FINDINGS AND PURPOSES.

(a) Findings- Congress finds that--

(1) the manufacture, distribution, and importation of firearms is inherently commercial in nature;

(2) firearms regularly move in interstate commerce;

(3) to the extent that firearms trafficking is intrastate in nature, it arises out of and is substantially connected with a commercial transaction, which, when viewed in the aggregate, substantially affects interstate commerce;

(4) because the intrastate and interstate trafficking of firearms are so commingled, full regulation of interstate commerce requires the incidental regulation of intrastate commerce;

(5) gun violence in the United States is associated with the majority of homicides, over half the suicides, and two-thirds of non-fatal violent injuries; and

(6) on the afternoon of May 10, 2007, Blair Holt, a junior at Julian High School in Chicago, was killed on a public bus riding home from school when he used his body to shield a girl who was in the line of fire after a young man boarded the bus and started shooting.

(b) Sense of the Congress- It is the sense of the Congress that--

(1) firearms trafficking is prevalent and widespread in and among the States, and it is usually impossible to distinguish between intrastate trafficking and interstate trafficking; and

(2) it is in the national interest and within the role of the Federal Government to ensure that the regulation of firearms is uniform among the States, that law enforcement can quickly and effectively trace firearms used in crime, and that firearms owners know how to use and safely store their firearms.

(c) Purposes- The purposes of this Act and the amendments made by this Act are--

(1) to protect the public against the unreasonable risk of injury and death associated with the unrecorded sale or transfer of qualifying firearms to criminals and youth;

(2) to ensure that owners of qualifying firearms are knowledgeable in the safe use, handling, and storage of those firearms;

(3) to restrict the availability of qualifying firearms to criminals, youth, and other persons prohibited by Federal law from receiving firearms; and

(4) to facilitate the tracing of qualifying firearms used in crime by Federal and State law enforcement agencies.

SEC. 3. DEFINITIONS.

(a) In General- In this Act:

(1) FIREARM; LICENSED DEALER; LICENSED MANUFACTURER; STATE- The terms ‘firearm’, ‘licensed dealer’, ‘licensed manufacturer’, and ‘State’ have the meanings given those terms in section 921(a) of title 18, United States Code.

(2) QUALIFYING FIREARM- The term ‘qualifying firearm’ has the meaning given the term in section 921(a) of title 18, United States Code, as amended by subsection (b) of this section.

(b) Amendment to Title 18, United States Code- Section 921(a) of title 18, United States Code, is amended by adding at the end the following:

‘(36) The term ‘qualifying firearm’--

‘(A) means--

‘(i) any handgun; or

‘(ii) any semiautomatic firearm that can accept any detachable ammunition feeding device; and

‘(B) does not include any antique.’.

TITLE I--LICENSING

SEC. 101. LICENSING REQUIREMENT.

Section 922 of title 18, United States Code, is amended by adding at the end the following:

‘(aa) Firearm Licensing Requirement-

‘(1) IN GENERAL- It shall be unlawful for any person other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to possess a qualifying firearm on or after the applicable date, unless that person has been issued a firearm license--

They never seem to stop trying. If it's not firearms, then

it's ammunition or ammunition components (lead, brass, bullets, primers, powder). I'm surprized that they haven't started seeking registration of presses and various dies/molds, etc. No doubt they'll want to require Federal approval for load-data published in various books.......in order to insure our "safety". We seem to be following in the footsteps of the U.K., more or less, in terms of restricting private gun ownership. I recently read about one fellow there who had taken to converting so-called "replica" guns (made so that no bullet could pass through the barrel) into working models.....much to the dislike of the authorities.

Unconstitutional drivel.

Violations:

1. Second Amendment. Infringement on the right to keep and bear arms.

2. Tenth Amendment. Infringement upon self-governance of the states.

3. Ninth Amendment. Violation of natural rights retained by the people.

Why can't such garbage be quashed before it is written into a bill and voted upon? The Patriot Act made it into Law, despite being a plain and obvious violation of the Fourth Amendment. It has yet to be overturned, except for piecemeal nipping around the edges.

I wonder if such a thing as a Constitutional Oversight Committee could be formed in Congress?

When these bills are

When these bills are introduced they go on to a committee, in this case the 'house judiciary'. Govtrack has some good links on each bill to follow and explanation of subcommittees, etc. Seems the subcommittee for 'Constitution' should be #1??? Perhaps there's something we could do to make them change this and explore how/who on appointments to this committee?

Remember Waco and Ruby Ridge?

To name a few government murders of innocent people? The ATF and FBI both got their asses handed to them. There are going to be more of this kind of crap but I think the people will stand their ground as they have nothing left to loose anyway.

How did the ATF & FBI lose anything from Waco or Ruby Ridge?

I remember hearings, but no ass-handings. And none of the innocent people were revived. These were the moments that should have started the real revolution, but everyone sat and watched it on TV.

The whole purpose of the Koresh massacre was to scare people.

One good thing about

One good thing about financial collapses and bailouts is they make it less likely our benevolent overlords will want to spend political capital on side issues like this. While Geithner, bigO et al are busy roaming through our wallets at behest of their New York banking buddies and sponsors, we get to stock up behind their backs...

Didn't Britain require all sorts of gun registrations and licenses some years prior to the complete ban of guns there?

Sort of sounds as though what they really want to do is make a list, so they know who to look for when time comes to hand in the guns......

We have to have a firearm permit to buy handguns, too. Not rifles or shotguns yet.
