If you believe in "State Sovereignty", make sure that you bug the hell out of your representatives to pass legislation like this. Also in your letters make sure that you call attention to the efforts of these states. Make them feel that their is a strong movement towards enforcing sovereignty outside of your individual state. That will give your representatives the feeling that their not totally leaving the herd. We need to make a firm push to get these bills actually passed- I'm not talking passive action...I'm saying assert your own personal authority as a citizen of your state. The power of your state derives from you, just as the Federal government's power derives from the states. It is long since past time that we reassert this authority. State Sovereignty will give us back our greatest line of defense against oppressive Federal government! From there we really can reverse all the harm that has been done to this Republic!!!!!!

I also say abolish the Fed forever if it's not salvageable. Let all people see what the Fed does, then see if it is at all worthwhile or if we were duped.

Right of Sovereignty

The 10th amendment to the US Constitution is sweeping through the states, and plans are being developed for more concerted action among the states, to ensure that the federal government abides by the Constitution in the future. The 10th Amendment states that all rights not given expressly to the government are reserved to the states, or the people. Granted, this should apply to payday loan regulations, but not a whole lot of people take that view. Tax Day Protests are beginning and the 10th amendment is being used to reject any stimulus funds directed to states, if the state governments aren't willing to accept them. It seems that segments of the people are not willing to get short term loans on 10th Amendment grounds.

Has there been any national news coverage on the states

working this legislation through the state houses? It doesn't seem like it has gained any traction. Any thing about the national tea parties? These are two big events that combined could prove to be huge news.

we will look into it. NC used is split these days and quickly turning pro big govt as the three liberal universities brainwash the folks in the triangle area into believing the big govt lie.


Just emailed my state rep again in NC to look at what the other

states are doing. NC is slow to the table. Anyone else on the DP and living in NC please contact your state rep's. We need everyone to get them to sit up and take notice to what other states are doing. I would think someone from the western or eastern part of the state will be the first to introduce. The triad and triangle are heavily liberal now and dependant on the govt because of the university status.

"To me that means that FIRST the citizen owes allegiance to the constitution - that is also the 9th and 10th! So I don't see any problem. Also, the states are not trying to secede - they are just reminding the Federal Government that their powers are limited and that they are breaking constitutional law. The Federal Government can be abolished with having to secede.
Is this the loop hole we need?

LIVING the 10th Amendment

This is more than just charging windmills. It's a show of force, that their's strength in numbers, and we need to pass these.

1) The "Notice and Demand" and "Cease and Desist" language is just that--the equivalent of a legal letter of reprisal. It opens the door to 10th Amendment court challenges in the future. And if you've got 20 or 30 states, that's a lot of lawsuits. (Or just one: it doesn't have to be New Hampshire vs. United States, you can have a docket with 'a whole bunch of plaintiffs vs. United States')

2) A simple majority of state legislatures in 2/3rds of the States can bypass the Congress and Governors both with an Article V--a Limited and Defined Article V to Repeal the 17th for example. While saber rattling (we'd better be VERY certain of the language and contracts we put the delegates under), this cannot be lossed on Washington.

The California (my state) resolution was dated 1994. I doubt it still has any life in it. But I can hope the recent statements introduced in other state legislatures will continue to inspire this great trend.

TN just put out a bill by Representative Susan Lynn. It's HJR 0108/ . It already has some co-sponsors and supporters. Let's continue to get behind this and support all states that push for sovereignty.

Ohio Liberty and Sovereignty Resolution

The Tenth Amendment provides that "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

It is our belief that the federal government has consistently over-stepped it's constitutional boundaries and usurped the powers reserved to the states, and therefore the people.

The Ohio Liberty and Sovereignty Resolution will remind the federal government of it's proper role and place. Our goal is to have this resolution adopted and passed by the Ohio State Legislature during this calendar year of 2009.

Is Ohio alone in this movement? The answer is no. There are no less than 8 states that have introduced similar legislation, and it is expected that no fewer than 20 are considering similar action. The state sovereignty movement clearly arises from the belief that the balance of power has tilted too far and for too long in the direction of the federal government and that it's time to restore that loose balance.

So, would you please join us in support of The Ohio Liberty and Sovereignty Resolution by signing the petition? All signatures will be delivered to the Ohio State House in early to mid-March after Congress finishes up the state budget and committee appointments.

This is all fine and dandy

This is all fine and dandy but is it charging windmills? Pretty near everything done by the so-called federal government since way back when is null and void. The states don't need to "declare" the 10th amendment - they need to LIVE it - as do we.

"An unconstitutional act is not law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is, in legal contemplation, as inoperative as though it had never been passed." Norton, 118 U.S. 425, 6 S.Ct. 1121 (1886).

Standing up to the feds and exerting sovereignty takes action, not words. Every state could pass a bill declaring their state animal to be a unicorn and the feds wouldn't care. States say, "by the way please respect the 10th ammendment" and the feds don't care.

We need actions. This starts with me. For example, we received the FEMA Flood Insurance Study. It's about an inch thick and calls for meetings and appeals. It also says, "... your community must adopt new floodplain ordinances or modify existing ordinances as necessary to reflect any changes in the DFIRM or FIS report ...".

We must adopt new ordinances? OR WHAT? I am not going to do it.

Please call your city council and county commissioners and ask to look at this report and the included letter. It's public info. Then ask your councils to politely ignore all of it.

By the way, it looks like FEMA has a person's name for the "community floodplain admistrator". Start with that person locally.
