Sovereignty Bill - Need Some Help ASAP.

here is a bill I put together it is actually a compromise bill it was much more comprehensive but our Reps thought it was too long to fly in our statist Legislature so I am trying this.

What I need is a couple to check spelling punctuation and grammer for me as I am terrible at it. I proofed it as best I can but when I am on the computer my mind auto completes letters and even whole words that are not there, and my W key only works half the time

My local fellow freedom fighters seem to all be off line and I need to submit this tonight so they will have it in the morning. So if you guys could help me out here it would be greatly appreciated:

TO THE PRESIDENT OF THE UNITED STATES, THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF IDAHO IN THE CONGRESS OF THE UNITED STATES

We the House of Representatives and the Senate of the State of Idaho assembled in the first regular session of the Sixtieth Idaho Legislature in the spirit of Jeffersonian principles do hereby respectfully represent that:

WHEREAS the Constitution of the State of Idaho, Article 1, Section 1, reads as follows; that all men are by nature free and equal, and have certain inalienable rights, among which are enjoying and defending life and liberty; acquiring, possessing and protecting property; pursuing happiness and securing safety; and

WHEREAS the Constitution of the State of Idaho, Article 1, Section 2, reads as follows; that all political power is inherent in the people. Government is instituted for their equal protection and benefit, and they have the right to alter, reform or abolish the same whenever they may deem it necessary; and no special privileges or immunities shall ever be granted that may not be altered, revoked, or repealed by the legislature; and

WHEREAS the Constitution of the State of Idaho, Article 1, Section 15, reads as follows; There shall be no imprisonment for debt in this state except in cases of fraud; and

WHEREAS the Constitution of the State of Idaho, Article 1, Section 21, reads as follows; This enumeration of rights shall not be construed to impair or deny other rights retained by the people; and

WHEREAS the Ninth Amendment to the Constitution of the United States reads as follows; The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people; and

WHEREAS the Tenth Amendment to the Constitution of the United States reads as follows; The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people; and

WHEREAS the Second amendment to the Constitution of the United States reads as follows; The right of the people to keep and bear arms, shall not be infringed; and

WHEREAS today in 2009 the states are demonstrably treated as agents of the Federal Government; and

WHEREAS the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and nothing more; and

WHEREAS the scope of the power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS the United States Supreme Court has ruled in New York v. United States, 505 U.S. 144 (1992), that congress may not simply commandeer the legislative and regulatory processes of the states: and

WHEREAS the Federal Government has failed to protect and allow a sound monetary system as mandated by the constitution, thereby allowing private banking interests a monopoly control of our money supply, forcing an unstable currency on us resulting in economic peril;

NOW THEREFORE BE IT RESOLVED by the members of the first regular session of the Sixtieth Idaho Legislature, the House of Representatives and the Senate concurring therein, that the State of Idaho hereby claims sovereignty under the Ninth and Tenth Amendments to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United states.

BE IT FURTHER RESOLVED That the Governor of the of the State of Idaho, the legislature and all officers of the state, the counties, the cities, and all political subdivisions and municipalities thereof are hereby directed to cease and desist all support or compliance with all extra constitutional agencies, and policies, that are outside the scope of the constitutionally delegated powers of the federal government.

BE IT FURTHER RESOLVED That all County Sheriffs being the only Law officers duly elected by the people of the state of Idaho are hereby directed to enforce the law and protect their constituents from, and prevent the exercise of any assumed powers under color of law by the Federal Government or it’s agents, that are outside its scope of constitutionally delegated powers.

BE IT FURTHER RESOLVED that this serves as notice and demand to the federal government, as our agent to cease and desist, effective immediately, mandates that are beyond the scope of their constitutionally delegated powers

BE IT FURTHER RESOLVED that all compulsory federal legislation beyond the scope of constitutionally delegated powers that directs states to comply under threat of civil or criminal penalties or sanctions, Or requires states to pass legislation or lose federal funding, be prohibited.

BE IT FURTHER RESOLVED that any act by any branch of the federal government that assumes powers not delegated to it by the Constitution of the United States, such as, but not limited to, martial law, involuntary servitude or draft except as prescribed by Constitutional law, surrendering power delegated or not, to any corporation or foreign government, any act regarding religion, free speech or free press, any infringements on the right to keep and bear arms including prohibitions of type or quantity of arms or ammunition; that they are beyond the scope of delegated powers and are null and void and of no force whatsoever.

BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representatives be, and she is hereby authorized and directed to forward a copy of this bill to the President of the United States, The President of the Senate, and the Speaker of the House of Representatives of Congress, and the congressional delegation representing the State of Idaho in the Congress of the United States, and the Governor of the State of Idaho.

It is too late in the Legislative Session to introduce new bills. I contacted both of my Reps. and here the response of Rep. Matt Wingard-Congressional District 5-Clackamas County. What a joke these Reps. are!

I don't know of any legislation on this issue that has been introduced in Oregon. Unfortunately, the deadline for asking for most legislation to be drafted has passed for this Session.

I share your concern on this issue. I am watching with interest what is going on in other states on this.

PROPOSED House Resolution

A resolution to affirm Oregon's sovereignty under the Tenth Amendment to the Constitution of the United States and to urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.

Whereas - The Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people";

and Whereas - The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more;

and Whereas - The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states;

and Whereas - Today, in 2009, the states are demonstrably treated as agents of the federal government;

and Whereas - Many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States;

and Whereas - The United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states;

and Whereas - A number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States;

Now therefore, be it Resolved by the House of Representatives (the Senate concurring), that we hereby affirm Oregon's sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

Furthermore, we also urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States; and be it further Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Oregon congressional delegation.

I contacted my state reps and though they said the same thing about missing the deadline here in FL, it might be possible to piggyback another pending draft...?? HOW CAN I HELP?

I would like to do whatever possible to help with this Bill. Please let me know where it stands and if there are any more contact persons I may get in touch with. Once people hear about it, they're 100% for it. But the major press won't say anything.

I am from Idaho and have been trying to find out if we had done one of these yet. Thanks for being on it...but do you have any updates? Have we passed it, still in the works, etc?

Well, I've read through the entire document and believe I only

have one suggestion on the placement of a comma. In the second "WHEREAS" paragraph after the word "reform". Other than that, I'd say it was set to go! Looks REALLY good to me and I must say it's likely the first thing that I have ever proofread with only one suggestion! :-)

Hawk, I know you put a lot of work into this, but

Why don't you just copy one of the other State's Resolutions and substitute, "Idaho" for whichever you choose? I've been in government, it's very commonplace to "boilerplate" legislation or other things from other governments.

Yours is good, no doubt, but why invent the wheel when there's at least 8 sets of goodyears in easy reach.
