Paul Supporters Lead Fight to Restore State Sovereignty in Oklahoma
"State House to consider historic bill to take back state's rights under the 10th Amendment to the Constitution"
Oklahoma City – For far too long, the 10th Amendment to the U.S. Constitution has been known as the forgotten amendment. With power grab after power grab, Congress has slowly eroded the rights of states to keep powers not specifically granted to the federal government.
As more and more citizens and state legislators across the country begin to realize that this loss of states rights is at the core of many of our nation's problems, those legislators have set out to stop the out of control Congress and restore some sense of sanity and constitutional protections to the individual states.
On February 11th, Oklahoma became the first state to act on legislation to do just that. This action was directly brought about by a Ron Paul supporter, and it is Campaign for Liberty members that will see this battle all the way through.
You see, the 10th Amendment in our nation's Bill of Rights has long been despised by our big government foes. That amendment was drafted to enshrine in the Constitution what the Founders and the original states already knew: any power not expressly given to the federal government is kept by the states and the people. Although a lot of freedom-minded individuals have long fought for full compliance with this amendment in modern times, there has been a void of leadership and a lack of focused action - until now.
That void has been filled by the formation of Campaign for Liberty, which was born from Ron Paul's galvanizing 2008 Presidential campaign.
Campaign for Liberty is fighting in state legislatures across the country and in Congress to preserve and restore constitutional rights to all citizens, to subdue an out of control federal government, and to win back our lost freedom.
The fight in Oklahoma is a great example of the kind of battles we face in the next stages of the Ron Paul Revolution.
With the support of Dr. Paul's activists throughout the state, the Oklahoma legislature has taken up a vital bill to put Congress in its place and to remind it that there are limits to federal power.
This past Wednesday, the Oklahoma House Rules Committee unanimously supported House Joint Resolution 1003 (http://webserver1.lsb.state.ok.us/2009-10HB/HJR1003_int.rtf), which expresses the sovereignty of the State of Oklahoma and clearly calls for an end to unconstitutional federal government mandates.
Representative Charles Key (R-Oklahoma City), the sponsor of this bill, has spearheaded a national movement to put the federal government on notice that the separate states are sick and tired of having their actions dictated by Washington, D.C.
Rep. Charles Key is a supporter of Dr. Paul – in fact, he was the first elected official in Oklahoma to endorse Ron Paul's candidacy for President (http://www.youtube.com/watch?v=aa5sCO-3ly0) because of Dr. Paul's strong support for the US Constitution.
Oklahoma IS an example of how the R3volution is leading the battle to restore constitutional rights and freedoms to our citizens. The fight to reclaim our Republic and restore our Constitution is just beginning, and, with the continued efforts of Campaign for Liberty members all across the country, it is a fight that we can and will win.

I think I need to clarify a couple of points.
Oklahoma has 2 Joint Resolutions moving through the legislature.
One is HJR 1003 by Rep.Charles Key. He is the original author of this bill that was passed overwhelmingly in the House last year. Unfortunately it died in committee before ever reaching the Senate so it was not passed into law. This year he submitted HJR 1003, same bill. It has advanced through the House of Representatives as of 2/18/09 and should be scheduled at any time to be heard in the Senate. If it passes in the Senate-It will be law! Representative Key crafted the bill so that no approval is needed by the Governor. The goal is ultimately to have the Senate use HJR 1003 as the final bill
BUT
SJR 10 by Senator Randy Brogdon, is also a Tenth Amendment Resolution. I have noticed that some bills have “twins” or an extremely similar “sibling” working from the opposite chamber. I suppose this is to increase the chances that an important piece of legislation will make it through the entire process and be adopted into law. SJR 10 would have to be signed by the Governor.
Senator Brogdon and Representative Key are both Champions and we are extremely blessed to have two such staunch Constitutionalists working in our State Legislature. I am also happy to say that from what I have seen I believe they are not alone.
Senate Vote on SJR 10 and SJR 11 3/04/09
I had the pleasure today of sitting with a number of other Constitutional advocates in the Oklahoma Senate gallery for the purpose of watching the proceedings as our Senators cast their votes on SJR 10 and SJR 11. SJR 11 by Senator Randy Brogdon (R-Owasso) is a bill designed to rescind Oklahoma’s previous calls for a Constitutional Convention (put forth in the 70’s and one in the early 80’s if I am recalling correctly). We have 32 states that have issued a call for a Con Con . There are 32 states that have called for the Convention. A minimum of 34 states must issue the request for a Constitutional Convention to be held and it is unclear as to whether or not a formal call to rescind will have any effect but Oklahoma and other states are trying to stave off the possibility by passing legislation such as SJR 11 which did pass the Senate today unanimously. What is a Constitutional Convention and why should we worry about having one?

There has been only one Constitutional Convention in the history of the nation - that was in 1787. At the time, the nation was held together by the Articles of Confederation. The states were having a difficult time with commerce among themselves. So it was decided to hold a Constitutional Convention to simply discuss how interstate commerce might be better organized. As the delegates were selected, some were given specific orders by their states to discuss nothing else beyond the commerce issue.
However, as soon as the delegates arrived at Independence Hall in Philadelphia, they closed and locked the door, pulled down the shades and met in secret for a month. When they were finished, they had created an entirely new nation. We were very lucky that the convention was attended by men like Ben Franklin and James Madison. They produced the most magnificent document ever devised for the governance of man.
Today, we have Nancy Pelosi and Harry Reid. Do you trust them to produce a document of such magnitude? Or would they at least take care of the present one? We live in an era when the Supreme Court looks to foreign laws to assure our own are worthy. We live in an era when many believe that the Constitution is out of date for our times. They are itching to get their hands on the old parchment. And as history has shown, they can do anything they want to it, including writing a completely new document.
SJR 10 also passed but unfortunately did not prove to be as wildly popular as SJR 11. SJR 10 by Senator Randy Brogdon is the Senate version of HJR 1003 which is authored by Representative Charles Key. Both measures are Joint Resolutions claiming Sovereignty under the Tenth Amendment. It seems to be common practice for there to be very similar bills coming from the House and Senate at the same time and the purpose appears to be to give the measure every opportunity possible to pass.
Although Senator Brogdon did a great job explaining and defending this measure, it was subject to quite a lot of debate. I will go over my notes and share with you the arguments that were offered against the Tenth Amendment Resolution later. I would like to do the debate justice. The bottom line is that although it passed, it was not by a wide margin. Final count was 25 yea to 17 nay. I am again disgusted that we have this many lawmakers who have difficulty saying yes to the Tenth Amendment which is established law.

Currently, HJR 1003 has passed out of committee and now the resolution will be heard in the House (maybe this week) then in Senate Committee (where it got stuck as 1089 last year) then it goes to the Senate. Tuesday morning SJR 11 will be calls for rescinding applications for a Federal Constitutional Convention. A Federal Constitutional Convention would potentially allow the entire U.S. Constitution to be opened to amendment, including the first ten amendments, known as the Bill of Rights.
I see the Tenth Amendment Resolution as being foundational to the 11 bills Oklahoma has working their way through the process to stop any "Real ID" type biometric or other personal information collection, retention and sharing.

The Stop Real ID Coalition and The Constitutional Alliance has labored as individuals and as a group for literally years relentlessly battling Real ID and any similar legislation that disrespects the rights of Americans. Oklahoma would not be where it is today without the work that these organizations have done.
Here is what they are doing right now;
“We have been busy continuing to go state to state to ensure our legislation opposing the Real ID Act 2005 is filed and introduced in as many states as possible. We have also included Representative Charles Key's, State of Oklahoma, Tenth Amendment legislation that stands up for states' rights.
In some states we have gone much further. We have proposed legislation that would forbid the collection of biometric samples, biometric data and social security numbers. The only exception to the collection of social security numbers is when the social security number is needed for income or wage reporting purposes. The legislation applies equally to state agencies/departments and to groups/organizations. Further, legislation opposing the use of RFID technology in identification documents and participation in AAMVA's (American Association of Motor Vehicle Administrators) DLA (Driver's License Agreement) which would create a single jurisdiction of the United States, Canada and Mexico for the sharing of citizens information contained in motor vehicle databases has been filed.

Senator Randy Brogdon's SB 289 passed committee on the 11th also. This bill prohibits collecting, obtaining or retaining of any biometric data in connection with motor vehicle registration or driver licensing.

It is important to note that there are many groups and individuals in Oklahoma working together for the cause of Liberty. This surprisingly diverse collection of advocates for freedom are working together, amassing great reserves of wisdom, talent, skill and enthusiasm along with a generous measure of patience to do exactly what it is that we came to accomplish -keep government small and the practice of Liberty growing and growing. Yes, Oklahomans have a reputation for being dogged in their conservative views but many understand that the common cause of freedom spans widely. The times have demanded that we work with our allies where we find a common intersect and that we put petty differences in their place. The common desire for freedom has encouraged false boundaries to be dissolved and the results are renewed courtesy and an opening of dialog between factions that would make the Founders proud. I'm in northern NH.....the southern border with MA has lots of yuppies from MA. They have turned the border towns into liberal suburbs, but go north of Manchester, and it is all different. A storm is brewing.......the conservatives have had enough...... We just had a liberal education committee chairwoman try to change the homeschooling laws to the most restrictive in the US. The turnout at the statehouse was ENORMOUS! There was standing room only, and the chairwoman was frazzled. She was asked about the Constitution, and could not answer! It was amazing!!!! Made me have incredible hope for our great nation! NH's motto is "LIVE FREE OR DIE"....... it is still alive folks.....thank you God!!!! "

One problem in that text.
It says:
"the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States ..."
Which can be taken as implying that Oklahoma's sovereignty is granted by the constitution, which it most certainly is not. The constitution is a delegation of powers by the people, not the source of our rights, whether as individuals or as states.
