*Texas* Bill Reasserts 10th Amendment Rights

Authored by Texas State Representatives Brandon Creighton, Bryan Hughes, and Leo Berman, H.C.R. 50 has been introduced to the Texas House to reassert Texas’s rights of sovereignty under the 10th Amendment of the US Constitution.

RESOLVED, That the 81st Legislature of the State of Texas hereby claim sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States; and, be it further RESOLVED, That this serve as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers; and, be it further RESOLVED, That all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or that requires states to pass legislation or lose federal funding be prohibited or repealed....

RESOLUTION = ZERO!!!

It means absolutely NOTHING... NOTHING...

I suggest someone in the other states make the succession document and the state law that changes the states constitution suceeding from the union. Reasserting something does NOTHING! I will be providing the correct document that Berman needs to submit.

Excellent! We just need every State in the Union to

re-ratify its sovereignty, then we will see what kind of power the Federal Government has.

Jim Jackson is Working on "Real Bills"

My rep. Jim Jackson said that he is working on "real bills" and that he doesn't think that it would ever reach a vote on the floor. This is what we are up against. Many state legislators still think that what they are doing for their respective states stills matters when the feds take over.

Texas has a long history as a sovereign.

Texas, like the original 13, is a state that staged a revolution to break away from another country (in this case, Mexico), ran on its own for a time, and joined the US by treaty.

Some Texas not-so-trivia:
- The treaty allows it, unilaterally, to split into 5 states and have 10 senators.
- Their revolution was not just Anglos: Lots of Spanish-speaking Spanish-heritage Mexicans were involved, too, both in the revolution and the post-revolution power structure. (Check out the names of the Alamo defender casualties.) It was about being ruled and milked by a corrupt regime, not about language, race, national origin, ...

I notice that this one directs the clerk to send copies to (among others) the Texas congressional delegation with a request that they read it into the congressional record.

I bet that, if it passes, Ron Paul will be glad to do that for the House. B-)

Unfortunately

The Northern War of Agression just a few years later proved that treaty worthless. Texas you like us here in Florida are concured property of the US Federal Government, and we'd better not forget it. Remember what they did the last time we tried to peacably withdraw from this tyranny.

It's a good start. It's not proposed as a law, but it's a good

beginning with which to send an affirmative warning to the federal government. Of course, I'll be urging my representatives to support it. I hope other lone star residents on this forum will consider doing the same thing.

It's a long way between drafting a bill, passing the bill and enforcing the bill against the Feds.

Frankly, I love it. I love anything that kicks the Federal Government into submission. But will it work? I don't think so. Sorry.

If we know anything about our Federal Government it is that they are ruthless bullies who get their way 99% of the time. They have the firepower, the ability to declare Martial Law in any state they chose and can send U.S. or NATO troops to quell any disturbance.

There was a post a while back about State Militias. If Texas has one then that might be a good thing - for a while. I don't see this kind of 10th Amendment assertion lasting for long, even if it passes. But still, I do a little dance when people with backbones tell the Federal government to get stuffed.

we will be strong enough to enforce it. They have been stepping all over us and ignoring the older ones. It is about time for the next step. What will it be??? Surely we don't jump from this to seceding. As more join, the Fed. Govt. will think twice before doing something, maybe. But enforcement is what it is all about. If we don't enforce, it quickly, quickly becomes meaningless. We can't just bluff. They will bluff back. We have to call their bluff and take the next step. What is that? I don't know.

A second bill with slightly different wording will be introduced either tomorrow or first of next week by my state senator Leo Berman representing SD1.
If we can get Debra Medena elected Governor and oust Globalist Slick Rick Perry she would put some teeth in these bills.

so globalists don't totally infiltrate the State governments too.

I am all for this but,

how serious are the state's positions? I looked up the definition of this resolution and I'm not quite satisfied that it is much at all.

An action of Congress passed in the form of an enactment of one house, with the other house in agreement, which expresses the ideas of Congress on a particular subject.

A concurrent resolution does not have the legal impact of a joint resolution, which has the force of official legislative action. It is more commonly employed as a method of expressing an opinion on some question. Commendations to victorious sports teams and statespersons and petitions from state legislatures to Congress or the president are examples of concurrent resolutions.
