FBI criminal record

Would a suspected dui arrest that ended up being a wreckless driving charge put you in a FBI criminal database? (basically I wrecked my car)
I applied for the census about a month ago and got a letter today saying there was a tentative match between me and an arrest in the FBI criminal history index. WHAAAT? It gave me some options of what I can do (at my own expense) to prove my record. Wich there is nothing but what I stated above. Is this a big deal? Would it be normal for the FBI to have a file on me for wreckless driving in 2000. And if so that should not keep me from getting the job. I worked the census in 1990 and 2000 and knew others there with numerous traffic violations and other misdemeanors.
The options they gave me were; A.If you do not dispute the identity of the arrest record in question,provide OFFICIAL COURT documentation on any and all arrest(s) and/or conviction(s) in your past.

B.If you wish to dipute the identity of the arrest record in question,you may provide a set of original fingerprints. Calll 1-888-360-5561 to obtain a fingerprint card and return envelope from the office in wich you applied.

How am I supposed to know what I am disputing? They ask you your criminal history on the application and I told them so I don't know what they are talking about.

But, there are just too many different courts that are not connected (thank god) and too many criminal records to put into the system with the appropriate information.

Chances are the record found for Chonk123 was matched by name only and instead of that record being cross-referenced with the docket, the Census Bureau simply sent out the automated letter to Chonk and will assume if he does not contest the charge of a Federal Criminal Record it is his.

Almost all of these databases have no identifiers on the criminal records other than name. Typical Federal government too lazy to go and assure the record is indeed that of Chonk and now it is up to Chonk to dispute it accordingly.

Criminal Records, Courts, and the FCRA

I work for a background screening company for pre-employment purposes and a DUI wreck would not be a Federal Offense by itself. You would have had to destroy your car while intoxicated and damaged Federal property, crossed-state lines, or had Federal agents involved in the arrest somehow or another. If you were arrested by your local police department for the DUI wreck and convicted, it would be handled in the common-pleas court and would not be a Federal matter.

Chances are there is someone with the same name as you and they have a Federal criminal record. Hence the possible record, so now they have to probably go through the docket to find identifiers on the record beyond name; date of birth, address, or social to clarify whether or not the record is yours.

The funny thing is that I have been in the pre-employment background screening industry for over 10 years now and I have had a nice inside look as to what is recorded on criminal records, how it is recorded, and other nuances. I often laugh when conspiracy theories come about regarding the "all knowing" government. The reality is that the records are being maintained by people that put their pants on one leg at a time like you and me and these criminal records are spread out over thousands of different courts. There are different county courts (one court for each county of each state), municipal courts (dozens of these courts per each county), Federal courts (at least 2 federal jurisdictions in each state), and different databases of every shape and size. Not only that, but whoever is doing the criminal records search has to know where you have lived in the past (which can be located through a Social Security search through the credit bureaus) and have to know which of these many different courts to search depending on what information is being sought.

So if we have the whole story that you wrecked your car in a DUI and that was all, it should not be a Federal offense.

Under the Fair Credit Reporting Act, any employer who decides not to hire you because of a criminal record has to notify you that they are taking adverse-action based on your criminal record and then MUST give you a period of time ( 30 days I believe) to dispute this supposed criminal record prior to making their final decision. If you are sure you have no Federal criminal record (which is what they are suggesting), then ask, in writing, to see a copy of the criminal record in question so that you can dispute that record.

weak Matching Code - New Databases

A lot of the different judicial records are being put into new databases and then the states are running shoddy matching routines and forwarding results to many other systems such as the FBI / DOJ. Many of these state records have never been in electronic format before. the programming I have seen in some of these system is very very shoddy.

I found one system where the state defaulted to all traffic accidents were DUI reports on any error of processing. The original report had to have perfect data or else a DUI charge would be filed with the DOJ. So if the officer typed in NONE in the accident report teh computer program errored becase it could not interpret the string NONE for zero or 1 sot he program assumed that the driver was arrested for DUI.

So I would expect to see more and more of this as time goes on. After 911 there was a ton of money released to get all the states to standardize on new data transmission standards that conformed to FBI DOJ and Interpol standards so that the feds could monitor and share information more easily.

Here's what I think.

I think that they already have the people in mind that they plan to hire for the census, and if you are not on their list, then you get "the letter" which basically pushes you away from getting the job, with gov't red tape.

I surmise that all the census employees will be members of ACORN or SEIU or other "preferred union thugs" or "community organizers".
And if you are not "them", you ain't gettin' the job.

FBI Criminal Record

I received the same letter. The only thing in my entire 67 years was a misdemeanor DUI in 2001. I didn't want to bother with the procedure necessary to see what was going on, but I now have decided to file a request with the FBI with my fingerprints and the $18 they require . My wife said it may be a case of identity theft and that got me worried. If anyone out there has found out anything more on this feel free to contact me. drdandragon@gmail.com

Misdemeanor and Felony arrests go to the FBI

The FBI does not have a "file" on you, per se. It's more like your Criminal History record which is a digital record. It's law that anyone who is arrested for a Misdemeanor or Felony offense be fingerprinted and that information become part of their criminal history record.

get some more insight from my friends here. I find this letter disturbing and can't imagine the FBI would have a record of my one boo boo. And even more disturbing one that I do not hide on any applications and what were my options again?? fingerprints? OFFICIAL COURT documents. Now how can I provide official court documents for something I don't know about? By the way I'm supposed to do this within 30 days at my own exspense and it will not guarantee me a job. Wonder what will happen if I just call the FBI. Hey guys what do you have on me? I wish I could believe this was just a wreckless driving charge they have snoped up. I live in the country, was a stay at home mom,did some pet sitting, a few part time jobs here and there. For the most part a recluse until the r3volution. I don't

actually work for them yet. Probably won't considering the time and hassle it will take to straighten this mess out considering the are (from what the media says) ovewhelmed with applicants. I'm almost afraid to open this can of worms. Then again afraid not to. Dam government!!!!!!!!

On a side note, I wonder if expungements travel back up the chain as quickly as convictions? Is anything ever literally expunged these days anyway?

You are

prabably right on the first acount and the second it seems if you are in "the club" there is nothing to be expunged. Just brush it aside and move up and out of danger and create danger for those who are not in the club. Hell at least when they are accussed they know what for.

I was

a crew leader in 2000 ,kinda like the supervisor of the guys that go out and fill out the forms with people. One of my crew had a gun pulled on him. I have done just about all parts of field work including what you are speaking of and had already decided I won't take that job. I can't do the kind of driving it would take (epilepsy) I could be a crew leader and work in the office setup mapping ect. Although I really liked being an enumerator in the past. Even back then people were weary of the gov. especially out here in the country but I seemed to be able to convince them or they could just see I am one of them. Made some friends. Some of it was scary having to go down a four mile dirt road to a houseful of drunk guys a woman alone. You aren't supposed to but I often took someone with me.

but I am not all that sure what I have is epilepsy. I don't have grand mal siezures and I'm not clear if what I have are even petit mal but I know I have neurological problems that are disorientating and at times very painful. I am trying to be mindful of triggers but there are usually so many of the suspects going on at the same time. I strongly suspect dairy and some tomatoe based products.Definately chemicals ,cleaners air freshners, most perfumes. Put me in a pig pen full of poo and I'll be ok. put me in a sanitary bleach,amonia, even just perfumed home and I will be ill. You know how people gripe about smokers in restruants? I can't stand to go to a restraunt and smell peoples strong perfume while I try to eat. I think they should have a perfume section! LOL Can't we all just get along?

My dear friend had her entire identity 'stolen' by a young

woman she hired as a nursing assistant in an 'assisted living' home she has run for many years.

This young woman broke into her desk, the safe, stole her ssn, credit cards, her checks, her address, and proceeded for many months attempting to get loans in 'her name', almost daily. This went on for months. She reported everything to police special investigation. Built up a file yay thick until finally after 8 months the police made a raid and arrested her in the 'act'.

My friend has suffered a kind of post traumatic stress over this because in many cases since this was reported and her case put into motion, she was subsequently treated as 'the guilty one' when she had to get a loan. Her own bank brought this 'into question' and would not allow the loan until way after the 'bust'. Her credit score was and is a nightmare.

We simply cannot take our identities for granted and guard it with all our care.

That would be my concern too.

Identity theft IS a possibility. However, my husband and I adopted a child years ago and had FBI fingerprint clearances done and were told that *everything* will show up on them. For starters I would get a copy of your police record. I think you have to go to the county court house and it's probably a few dollars but that will show everything that is on your record.

2. check your credit reports

I went through some BS when I went to get my liscense renewed a couple years ago. They sent me a letter saying something didn't match up and they wanted me to release my social security info to them even though they could not say if that is what did'nt match. I just went back a few weeks later without the letter and renewed my liscence . no problem. Before that they told me all kinda crazy stuff like I might need to legally change my name because some things had my full middle name and some my middle initial. Nothing that pertained to them of course. Just everything I could dig up to prove who I was. From BC diploma Marraige liscence ssc and statement. It was unbelievable. Nothing had changed in 25 yrs prior for me getting my liscense renewed to be a problem and when the wanted me to give them permission to let them get into my social security I said heck no. Your too incompetent. DMV the best argument against real id

I think there is some confusion...Working for the Census is a FEDERAL job, therefore they run their check through the FBI. They cant run your check through one of the states.

The NCIC is the Federal DB.

It's what the FBI (and the US Treasury) uses, and it's a compendium of all the reported states.
