INTRODUCED BY M. MORE

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA AFFIRMING STATES' RIGHTS AND CONDEMNING ENCROACHMENT OF THOSE RIGHTS BY THE FEDERAL GOVERNMENT AND EXECUTIVE ORDERS.

WHEREAS, The Constitution of the State of Montana declares that the people of this state have the sole and exclusive right to govern themselves as a free, sovereign, and independent state and that the people of this state shall exercise and enjoy every power, jurisdiction, and right pertaining to that right; and

WHEREAS, that right may never be expressly delegated to the United States Congress; and

WHEREAS, The Constitution of the State of Montana declares that the people of Montana solemnly and mutually agree to form a free, sovereign, and independent body politic, or state, by the name of "The State of Montana"; and

WHEREAS, the people of the State of Montana agree that all powers not expressly delegated to the federal government in the United States Constitution and Bill of Rights must be reserved and exercised by individual states; and

WHEREAS, when Montana entered into statehood in 1889, that entrance was accomplished by a contract between Montana and the several states, with Congress and the President concurring and acting as the agent for the several states, a contract known as the "Compact With the United States", archived as Article I of the Montana Constitution; and

WHEREAS, a contract, compact, or treaty must be implemented consistent with the terms and understandings in place at the time it is entered into; and

WHEREAS, the protection of these states' rights is enumerated in amendments to the federal Constitution and Bill of Rights, which state that "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people".

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

(1) That the several states of the United States are not united on the principle of unlimited submission to general government, but by ratifying the federal Constitution and Bill of Rights, they constituted a general government for special purposes and delegated to that government certain definite powers, while reserving all other rights.

(2) That when the general government assumes undelegated powers, its acts are void and of no force.

(3) That the government created by the federal Constitution and Bill of Rights was not granted the right to determine the extent of the powers delegated to itself, since that would have made its discretion, and not the federal Constitution and Bill of Rights, the measure of its powers.

(4) That the federal Constitution and Bill of Rights delegated to Congress a power to punish treason, counterfeiting of the securities and current coin of the United States, piracies, felonies committed on the high seas, offenses against the law of nations, slavery, and no other crimes.

(5) That all acts of Congress that assume to create, define, or punish crimes, other than those enumerated in the federal constitution and Bill of Rights, are void and of no force.

(6) That the power to create, define, and punish other crimes is reserved by the states.

(7) That power over the freedom of religion, freedom of speech, and freedom of the press remains and is reserved by the states or the people, allowing states the right to judge how far the licentiousness of speech and of the press may be abridged without lessening their useful freedom and how far those abuses, which cannot be separated from their use, should be tolerated, rather than allowing the use to be destroyed.

(8) That states are guarded against all abridgment by the United States of the freedom of religious opinions and exercises and retain the right of protecting the same.

(9) That all acts of Congress that abridge freedom of religion, freedom of speech, or freedom of the press are not law and are void.

(10) That power over the freedom of the right to keep and bear arms was reserved to the states and to the people, allowing states the right to judge how far infringements on the right to bear arms should be tolerated, rather than allowing that exercise to be defined by Congress.

(11) That states and the people are guarded against all abridgment by the United States of the right to keep and bear arms and retain the right of protecting that right.

(12) That all acts of Congress that abridge the right to bear arms are not law and are void.

(13) That Congress's interpretation of those parts of the federal Constitution and Bill of Rights that delegate to Congress a power "to lay and collect taxes, duties, imposts, and excises, to pay the debts and provide for the common defence and general welfare of the United States" and "to make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the government of the United States, or in any department or officer thereof" has attempted to destroy the limits of its power.

(14) That those parts of the federal Constitution and Bill of Rights, detailed in subsection (13), must not be construed to give unlimited powers to the federal government, and that Congress's inappropriate interpretation must be revised and corrected.

(15) That if Montana accepts these inappropriate interpretations and continues to allow Congress to exercise unbridled authority, it would be surrendering its own form of government.

(16) That the people of this state will not submit to undelegated and consequently unlimited powers.

(17) That every state has a right to nullify all assumptions of power by others within their limits, and that without this right, states would be under the dominion and power of anyone who might try to exercise that power.

(18) That it would be a dangerous delusion to silence people's fears for the safety of their rights.

(19) That this state calls on its costates for an expression of their sentiments on acts not authorized by the United States Constitution.

(20) That the rights and liberties of Montana and its costates must be protected from any dangers by declaring that Congress is limited by the federal Constitution and Bill of Rights.

(21) That any act by the Congress of the United States, Executive Order of the President of the United States, or Judicial Order of the United States that assumes a power not delegated by the federal Constitution and Bill of Rights diminishing the liberty of this state or its citizens constitutes a nullification of the federal Constitution and Bill of Rights by the government of the United States, which would also breach Montana's "Compact With the United States". Acts that would cause a nullification and a breach include but are not limited to:

(a) establishing martial law or a state of emergency within a state without the consent of the legislature of that state;

(b) requiring involuntary servitude or governmental service other than a draft during a declared war or pursuant to or as an alternative to incarceration after due process of law;

(c) requiring involuntary servitude or governmental service of persons under the age of 18 other than pursuant to or as an alternative to incarceration after due process of law;

(d) surrendering any power delegated or not delegated to any corporation or foreign government;

(e) any act regarding religion, further limitations on freedom of political speech, or further limitations on freedom of the press; or

(f) any act regarding the right to keep and bear arms or further limitations on the right to bear arms, including any restrictions on the type or number of firearms or the amount or type of ammunition any law-abiding citizen may purchase, own, or possess.

(22) That if any act of Congress becomes law or if an Executive Order or Judicial Order is put into force related to the reservations expressed in this resolution, Montana's "Compact With the United States" is breached and all powers previously delegated to the United States by the federal Constitution and Bill of Rights revert to the states individually.

(23) That any future government of the United States shall require ratification of three-fourths of the states seeking to form a government and shall not be binding upon any state not seeking to form a government.

(24) That the Secretary of State send copies of this resolution to the President of the United States and to each member of the United States Congress.

I spoke to Larry Parks

He and Dr. Vieira testified. Dr. Parks said it went very well. I don't think G. Edward Griffin got a chance to speak, but he was on the line and was very pleased with Larry's presentation. More information will be forthcoming soon. Good things in the works.

Who is Larry Parks?

I posted a five part series here on the Daily Paul by Dr. Larry parks a few months ago. It is still available at http://www.constitutionalmoney.org.

Dr. Parks is the Executive Director of the Foundation for the Advancement of Monetary Education (FAME), whose Board of Advisors includes Dr. Paul and many other heavy-hitters who advocate honest money. These are the important bills for Montana:

Note Bill HB 639 Ewin Vieira and G. Edward Griffin, and James Turk, and Larry Parks will all be Testifying before the Montana Legislature as expert witnesses for a sound money system.

1) HB-246 - Exempt Montana-Made Firearms and Ammunition from Commerce Clause (also a State Rights issue) – SUPPORT

Call and leave a message for all members of the House Appropriates Committee, asking them to support HB-246, and that you want HB 246 released by the Appropriations Committee for a 3rd reading on the House Floor.

This is all about state's rights, and more clearly drawing the line on the separation of powers between the Congress and the states.

HB 246 declares that any firearms made and retained in Montana are not subject to ANY federal control or regulation under the power of Congress to regulate commerce among the states (the "commerce clause" of the U.S. Constitution). The purpose of HB 246 is to set up a legal challenge in federal court to Congress's commerce clause power. If we win that legal challenge, then we get to make our own guns here in Montana unfettered by any federal rules. HB-246 passed the House on Second Reading by a vote of 64-36. However, HB 246 was re-referred to the House Appropriations Committee to consider the Fiscal Note attached.
In that Fiscal Note, the Attorney General said he'd have to hire outside legal counsel to being the vetting lawsuit in federal court required by HB 246, at a cost of $60,000.

This despite that there are 252 attorneys working for the Montana executive branch, with about 50 attorneys working for the Attorney General.
The House Appropriations Committee will hold a public hearing on HB 246 Monday morning March 9th, at 8 AM. Be there if you can to speak in favor of HB 246, or call and leave messages to Committee members.

2) HJ-26 - Urge Protection of States Rights (Montana State Sovereignty) - SUPPORT – This resolution is NOT dead, and is perhaps the most important piece of legislation this session.

DON’T LET UP ON THIS BILL. Continually contact the Dem’s on the House Judiciary Committee until we get heard.

Leave a message for House Bob Bergren that he has acted unethically, ignoring the people of Montana and his oath of Office.

Leave a message for all committee members, that if they vote NO on HJ 26, they will have voted against the will of the people and have voted against their own oath to the Constitution.

Remind legislators that many of them voted for the bill last session to reject federal Real ID. HJ 26 is just the next step after rejecting Real ID.
We only need to turn ONE Democrat on the House Judiciary Committee to get HJ 26 sprung and moving. These representatives are your assignment. Get to work.

This is scheduled for hearing Thursday, March 12th, 9:00AM, Room 455 of the State Capital Bldg.

Call and leave a message for all members of the House State Administration Committee, telling them to support HB-639.

Constitutional expert Dr. Edwin Vieira crafted the New Hampshire Sound Money Bill which was used as a template for HB-639.

Dr. Vieira has been consulting with us and has introduced us to Dr. Larry Parks and James Turk (internationally recognized monetary experts) to provide additional expert testimony at the committee hearing.

It is up to us to create the groundswell support to get this Bill out of Committee and onto the Floor for discussion and action. We have it in our power to send the Legislator's on the State Administration Committee a clear message of overwhelming support for this important legislation.

HB 639 will provide an alternative to the privately owned Federal Reserve fiat monetary system for the State of Montana. If you read this bill, you will realize that it does not force or mandate it's use it by the State or citizens. It merely creates the framework for a system of "sound money”. This system will be set up using the State Tobacco Tax as seed money to fund the account and can be expanded when the Federal Reserve System and their accomplices at Treasury intentionally collapse our (their) existing monetary system. 4) HB-228 - Citizen Self-Defense and Firearm Rights – SUPPORT

This is Montana Shooting Sports Association’s flagship legislation. It's not yet time for an avalanche of messages to committee members, but soon. It’s scheduled for Senate Judiciary Committee Hearings on 3/17.

Put a note on your calendar the day before (3/16) and call to leave a message for all members of the Senate Judiciary Committee, telling them to support HB-228.
HB 228 clarifies a number of gray areas in Montana law about when and how a person may possess and use a firearm for self defense without fear of prosecution.

5) HB-455 - Big Sky Rivers Act (property rights issue) - OPPOSE

Call and leave a message for all members of the House Local Government Committee, telling them to oppose and kill HB-455 in Committee.

This bill will do what the Missouri River Monument did (basically) to the rest of the rivers in MT.

This bill says that anyone who has land along a river and wants to build their home there, must provide 250 ft. for the river to grow. They are not allowed to build any structures on this land, and it must have vegetation to help prevent erosion. There is no compensation for the land owner not being able to build on their land, and is another unconstitutional land grab without any compensation. Part of the additional problem is how streams in Montana are defined. If water flows for a few hours during spring run-off, it is then considered a stream in Montana, which any thinking person would realize should not be treated in the same manner as the Missouri River.

6) HB-30 – Youth Election Judges - OPPOSE

Call and leave a message with all members of the Senate Administration Committee to vote NO on HB 30.

“Minor Children should not be in charge of Montana’s Elections”. Also if you Senator is not on the committee, ask to leave him a message as well.

Most likely it will be a couple of days after the hearing before the final committee decision will be made, so if you can’t call before the hearing, call as soon as possible.

This is a House bill to dramatically change election laws in Montana, it is called the student election judge bill. This would allow half of Montana’s official election judges be minor children.

On the surface most of us are very excited to see kids take a serious interest in our government. However with authority also comes responsibility and that is where this legislation becomes very problematic.

If minors aren't old enough to vote, how is it that they are old enough to be Election Judges? HB 30 would put the teachers union in the position to indirectly choose half the election judges due to the requirement that these minor children have to receive the approval of their school principle . . . discriminating against homeschoolers and private school students by not specifically including them in the Bill. HB 30 is part of a much bigger plan that originated out of Chicago, and being pushed by a liberal non-profit organization to further weaken the safe guards against voter fraud nation-wide.

HB 639 "Sound Money Bill" is being heard before the House "State Administration Committee" on Thursday, March 12th at 9:00 am MDT. This bill creates a template for a return to the "sound money system" outlined in: Article 1, Sections 8 & 10 of the United States Constitution and in use prior to The Federal Reserve Act of 1913. We are now operating under a monetary system that unconstitutionally turned the control of our national monetary policy over to privately owned (for profit) banks that loan every penny of our money supply to us at interest after they create it out of thin air. Much of the stock of The Federal Reserve is owned by foreign banking interests. HB 639 creates a framework for an alternative (strictly voluntary) gold and silver backed trust account funded from Tobacco Tax receipts. This account will be available for conduct of State & Political Subdivision financial transactions in gold, silver and/or electronic gold currency as an option to transactions using Federal Reserve notes. This bill does not mandate the use of gold and silver in State and personal transactions, it merely provides the State an alternative monetary policy in case the Federal Reserve system fails. Any funds or precious metals backing this system can be liquidated at any time and should the Federal Reserve system straighten out their problems, this alternative system could be terminated at any time.

DON’T LET UP ON THIS BILL. Continually contact the Dem’s on the House Judiciary Committee until we get heard.

Next - You should also call on Monday (and everyday) and leave a message for all members of the House Judiciary Committee, as well as House Speaker Rep. Bob Bergren (D).

Tell them you expect them to allow HJ-26 be brought to the House Floor for proper debate and vote.

Leave a message for House Bob Bergren that he has acted unethically, ignoring the people of Montana and his oath of Office.

Leave a message for all committee members, that if they vote NO on HJ 26, they will have voted against the will of the people and have voted against their own oath to the Constitution.

Remind legislators that many of them voted for the bill last session to reject federal Real ID. HJ 26 is just the next step after rejecting Real ID.
We only need to turn ONE Democrat on the House Judiciary Committee to get HJ 26 sprung and moving. These representatives are your assignment. Get to work.
