Our grandson taken from us by Alaska Office of Children's Services
Hello, my wife and I are desparately trying to find help in getting our baby boy back from the Alaska Office of Children's Services. He was given to us by our oldest daughter the day he was born. He was 8 months old when they snatched him away. He got sick one day and had to be flown to a nearby hospital for emergency treatment. After three days in the hospital, two people claiming to be from the Office of Children's Services came to the hospital room where my wife and baby were and told my wife that they were taking emergency custody of the baby and that if she tried to stop them, she would be arrested and jailed. She refused to give up the baby, they came back with a policeman, my wife, fearing jail, gave him up. We had court, but the court found ruled that we lost Indian Custodianship when the mother "suggested" that she wanted the baby back (when in fact, our daughter wrote an affidavit and power of attorney for me to take care of baby david's affairs, she told the courtthat she wanted our son to return to us, they ignored her completely. Now the case is transfered to another jurisdiction, we smell something awful here and we need assistance, we cannot afford an attorney, but birdman is helping with the Indian custoy issues. Welcome to our great state! Soon you will realize that the police state is very active here, especially in the villages. Their strategies are very deliberate and recently, a couple lost their baby boy due to drinking, but we did not see the Office of Children's Services take their children away! In our case, our baby boy got sick from "Water-Intoxication,not CPT-1A, as we fed him and he still threw up his food. In the meantime, he is grownig up without us and we really would like him back...we miss him. Thanks for posting. Banjo

Why would they come to take the baby in the 1st place? It had to be because the hospital called them in. Did the hospital call them to report suspected abuse?
It is unusual that Children's Services would pick a stranger to care for the baby --- they normally try to pick blood relatives & family first to cut down on state costs, that way they don't have to pay fosters.
The hospital is not always right in these matters, but it would be more helpful to know why C.S. showed up.

They took the baby from the hospital and from my family because they claim that my wife said that he was not fed for 36 hours, not true, he was not given similac for about a day and a half because he ran out of similac and also, he could not hold his food, as he was also fed baby food and soups that we cook, as in beef soup. The OCS agent came up with that 36 hours, noone else. Then, they found out that he might've been sick from "Water-Intoxication, as we fed him water and sugar when he ran out of similac that weekend. Now, they are backpeddling as fast as they can by disenfranchising us as "Indian Custodians" and transfering the case out of our hands and jurisdiciton. And some cops and social workers would be utilizing hospital services. You should find out where he is and go take him. If anyone gives you any trouble, kick them in the face.

Mistake #1..you gave the child up without a court order...you shouldnt have done that....So they kidnapped your child..with your permission.
I suggest you find a lawyer who works with Constitutional law.
You also need to find the childs father..and have him demand a blood test in family court...When he is found to be the father he can sign his rights over to you...it needs to be done in a legal way..tell him if he refuses you will seek half of all the bills from the moment of birth till the day he was taken from you.
You need to file a complaint against the cop for taking the child w/o a court order.
You might need to go pro se and if so get a copy of Blacks Law and see what you need to do..just remember this..with every document you file..file a copy of the Constitution with it...when you go to court..make sure you have copies of the Constitution for yourself..each person on the other side..and the judge...and make sure they get it too. Your daughter also needs to file charges against them all. She still has legal custody?

If what you say is true you need to go before a judge and ask them to show cause for taking the baby away and ask the question, Based on what authority to you kidnap a child who is NOT a ward of the state? If that does not work, I'd immediately file suit against the state and name CFServices in the suit and remember (a lawyer will steal your settlement money away from you).

Yes she does, but they say on their report that she is incapable of taking the baby and that she has to go through parenting classes before they can even determine anything at this point. He is with a black lady in Fairbanks.

Are there no legal aid offices in Alaska?
I thought every state had multiple free legal aid services. You may want to check and see. They should be able to help you and suggest an attorney who will not charge (at least that's the way it is here in Virginia).

The court offered us legal aid, but our observations tell us that it is state attorneys and we know how the state attorneys will help. They negotiate. We have sixth amendment of counsel, his name is Kevin Ramey, but the court says he's not a B.A.R. attorney, therefore, he cannot represent us. It is not about representation, we appeared in court pro per and sui juris, then we challenged jurisdiction, the court or state never answered our greivance on this issue.
