National Service Corps Bill Clears Senate Hurdle

Following overwhelming House passage last week, the Senate tonight voted 74 to 14 on a procedural move that essentially guarantees a major expansion of a national service corps, a cornerstone of volunteerism that dates back to the era of President Kennedy. It’s akin to a call to arms by President Obama, who has harkened back to those early days to demand giving back by those who voted for him.

In fact, Senator Edward M. Kennedy, the senior Democrat from Massachusetts whose battle with brain cancer has oft kept him absent from the Senate these days, appeared on the floor to welcomes all around as he cast his approving vote as a co-sponsor.

From President Kennedy’s days to the creation of Americorps by then President Bill Clinton, the notion of public service has become a rallying cry. Tonight’s vote, propelled by President Obama’s urging of an expansion, would mean a growth in such work from 75,000 community service jobs to 250,000.

According to the Congressional Budget Office, the cost of the Senate bill at least would be an outlay for the fiscal year 2010 of $418 million to about $5.7 billion from 2010 through 2014.

It’s an historic vote in the sense that a national service corps, an army dispersed to help with education, health services and the environment, would vastly enlarge the notion of “community organizing,” and allow, as Senator Barbara Mikulski, Democrat of Maryland, said tonight, for about 7 million people to be engaged in such work.

The bill enjoyed extraordinary bipartisan support, including namely the major co-sponsor, Senator Orrin Hatch, Republican of Utah, who tonight even recommended reading the biography of R. Sargent Shriver, relative by marriage to the Kennedys and who directed the original Peace Corps from 1961 to 1966.

In addition, Senator Hatch mentioned that the Rev. Rick Warren, the evangelical minister of Saddleback Church and author of “A Purpose Driven Life,” was an enthusiastic supporter of this effort, as was Senator John McCain, the former Republican presidential nominee. The latter’s support, to Senator Hatch, demonstrated the exceptional bipartisan backing of the expansion.

Eleven senators did not cast a vote. The 14 Republicans, some of whom cited the cost in voting against the proposal, are: Senators Sam Brownback of Kansas, James Bunning of Kentucky, Tom Coburn of Oklahoma, Michael Crapo of Idaho, Jon Kyl of Arizona, James Inhofe of Oklahoma, John Ensign of Nevada, Mitch McConnell of Kentucky, Jim Risch of Idaho, Pat Roberts of Kansas, Richard Shelby and Jeff Sessions, both of Alabama, Tom DeMint of South Carolina and John Thune of South Dakota.

House Bill is H.R. 1388, the Senate is S. 277.

The problem is that the bill leaves open the option to vote in into being MANDATORY for every able bodied person in the US, including school-aged children. Under the guise of being volunteers, the reality is that when you are forced to act in a group, it’s no longer voluntary.

In H.R. 1388, in section 6104 there is a subsection called (b). In it, the newly formed Congressional Commission on Civil Service is tasked to explore some interesting concepts.

(6) Whether a workable, fair, and reasonable MANDATORY service requirement for all able young people could be developed, and how such a requirement could be implemented in a manner that would strengthen the social fabric of the Nation and overcome civic challenges by bringing together people from diverse economic, ethnic, and educational backgrounds.

In addition to everybody being forced to join these groups, members are STRICTLY PROHIBITED from participating in the following activities:

(Note: these are NOT exclusive to group participation, but expressly prohibited TOTALLY )

H.Amdt 49 to H.R. 1388 Prohibits Organizations From Influencing… Legislation, Protesting or Petitioning.
SEC. 1304. PROHIBITED ACTIVITIES AND INELIGIBLE ORGANIZATIONS.
Section 125 (42 U.S.C. 12575) is amended to read as follows: `SEC. 125. PROHIBITED ACTIVITIES AND INELIGIBLE ORGANIZATIONS.
`(a) Prohibited Activities- A participant in an approved national service position under this subtitle may not engage in the following activities:
`(1) Attempting to influence legislation.
`(2) Organizing or engaging in protests, petitions, boycotts, or strikes.
`(3) Assisting, promoting, or deterring union organizing.
`(4) Impairing existing contracts for services or collective bargaining agreements.
`(5) Engaging in partisan political activities, or other activities designed to influence the outcome of an election to any public office.
`(6) Participating in, or endorsing, events or activities that are likely to include advocacy for or against political parties, political platforms, political candidates, proposed legislation, or elected officials.
`(7) Engaging in religious instruction, conducting worship services, providing instruction as part of a program that includes mandatory religious instruction or worship, constructing or operating facilities devoted to religious instruction or worship, maintaining facilities primarily or inherently devoted to religious instruction or worship, or engaging in any form of religious proselytization.
`(8) Providing a direct benefit to–
`(A) a business organized for profit;
`(B) a labor organization;
`(C) a partisan political organization;
`(D) a nonprofit organization that fails to comply with the restrictions contained in section 501(c)(3) of the Internal Revenue Code of 1986 except that nothing in this section shall be construed to prevent participants from engaging in advocacy activities undertaken at their own initiative; and
`(E) an organization engaged in the religious activities described in paragraph (7), unless Corporation assistance is not used to support those religious activities.
`(9) Conducting a voter registration drive or using Corporation funds to conduct a voter registration drive.
`(10) Such other activities as the Corporation may prohibit.
`(b) Ineligible Organizations- No assistance provided under this subtitle may be provided to the following types of organizations (including the participation of a participant in an approved national service position under this subtitle in activities conducted by such organizations) or to organizations that are co-located on the same premises as the following organizations:
`(1) Organizations that provide or promote abortion services, including referral for such services.
`(2) For-profit organizations, political parties, labor organizations, or organizations engaged in political or legislative advocacy.
`(3) Organizations that have been indicted for voter fraud.
`(c) Nondisplacement of Employed Workers or Other Volunteers- A participant in an approved national service position under this subtitle may not perform any services or duties or engage in activities which–
`(1) would otherwise be performed by an employed worker as part of his or her assigned duties as an employee or by another volunteer who is not a participant in an approved national service position; or
`(2) will supplant the hiring of employed workers or work of such other volunteers.’.
Mandatory involvement in this group ensures that it’s members WILL NOT be allowed to legally teach religion to anyone (believers and non-believers alike), preach a sermon, build church facilities, maintain church buildings, and the like, in addition to trying to influence people politically.

This membership is a 3-year one, so far.

Yes, I too, have been wondering this

although I agree with anyone here that the whole thing is a horrible idea and a fiasco and a terrible waste of taxpayer money, I still havn't seen anything in it that would show it to be mandatory. (which would be far more horrifying). Anyone?
