UPDATE:

In case you haven't been reading down the thread for updates, here's the news: Maryland House of Delegates BIll HB311, the Freedom of Association and Assembly Protection Act of 2009, passed the House of Delegates on March 24th. Great victory, DPers, but we aren't done yet...this has moved on to the Senate, where this is Senate Bill 266 with the same title. Currently this bill does *not* show up on the MD General Assembly website, but according to a staffer at Delegate Curt Anderson's office, this bill passed its first reading 45-0. No idea when a final vote is coming.

Scroll down the original post to find the link if you don't know who your state senators are, and call them to tell you support our freedoms of association and assembly! In the meantime, I will post an update when I discover S266 is coming up for a vote.

This is in response to Liberty Belle's original post on Maryland HB311,the Freedom of Association and Assembly Protection Act of 2009, which was introduced in response to inappropriate surveillance by the Maryland State Police of peace activists and other dissidents. I got a legislative update-type email from Delegate Maggie McIntosh (43rd District, MD) today, and this is what she says about this bill:

"The last bill I'd like to give you an update on is House Bill 311, the Administration's bill for addressing the inappropriate surveillance activities by the State Police that targeted peaceful protest groups. I received numerous emails and phone calls urging me to support House Bill 182, which would have put strong limitations on the permissibility of surveillance by any law enforcement agencies in Maryland. Unfortunately, that bill was voted down in the Judiciary Committee, and never came to the floor of the House of Delegates where I could have supported it.

After H.B. 182 was given an unfavorable report, however, many of its provisions were amended into H.B. 311, such as the requirement of a written finding that a covert operation is justified, the applicability of the law to all law enforcement and not just the State Police, a prohibition on not just the unjustified collection but also maintenance of irrelevant information, a protection of citizen information request rights, and requirements for reporting results of the bill to the General Assembly. The bill is still not as far-reaching as H.B. 182 would have been, but it is certainly a step toward establishing the necessary explicit protections against any violations of our rights to peaceful protest, and if passed will give us a firm foundation upon to build yet stronger protections in the
sessions to come.":

This bill (HB311) needs to pass the Maryland House of Delegates before the end of the day on Monday, or it won't cross over to the Senate for consideration. I was on the phone today with staffers from both Maggie McIntosh and Anne Marie Doory's office (both are delegates from District 43) and they agree on this point. Anne Marie Doory's staffer also told me that there is a small chance that it could go the Rules Committee after Monday, and go to the MD Senate anyway--but again, our best bet is to act on this piece of legislation RIGHT NOW.

Take a moment and try to call your delegates...the General Assembly is in session today, tomorrow, and Monday. Neither of the staffers seemed to know exactly when this bill will be brought forward for consideration.

You can love me or loathe me for what I am trying to do. I agree that the edifice is crumbling because things have, in fact, become fundamentally flawed in government. Many chisels, if placed strategically and deftly enough, will cause all to come tumbling down. I am also waiting for the implosion.

In the meantime, things are not so dysfunctional that bills are not being passed. If laws are not being followed, we still have ways to deal with this too. Why do nothing when the socialists are passing laws as fast as they can concoct them?

There not going to abide

By this. It won't matter. hate me if you want, call me arrogant, say what ever, but it's them against us. For crying outloud, they passed, the Patriot Act! They stood idly by while we lost Habous Corpus. The voted for FISA and the Bailouts! They're nationalizing!! The whole system is crumbling before your eyes. Do you think they will abide by another law? It's like having a AA meeting in a bar. Get prepared for war people.

to write a letter and make a few calls... why knock it? Personally, I can't sit idly by and have the attitude that everything is futile. Every voice that raises a shout has the potential to wake up others! 'Let it not be said we did nothing!' We all choose our battles and on this maybe YOU see no point... fine...but others do! If you can't encourage ..why spend the time to knock others efforts?
I would rather spend 5 minutes to at least have my voice heard and perhaps get a few reps to recognize that citizens will demand they protect our 1st ammendment rights ... than spend it dreaming of launching pumpkins at the white house...so what?
Yes, I'm preparing for the worst... but until then I still feel the personal responsibility to fight tyranny when I can!

Not much left of this state. I believe the only one left in congress that MD. people can count on is Roscoe Bartlett and even he gets shaky on some things. Seems MD. is just an extension of the the district of criminals.

But not far enough. We have the state of taxes on everything and they raised them too. One of the worst on just about every freedom you can imagine. Gun laws are ridiculous, traffic fines and stupid seat belt, helmets, emissions, just pick one and they can make a law to make it worse and take more money from everyone. They have priced the poor people out of everywhere but the city and I would rather live in a tent then any city. This small town is bad enough for an old farm boy. You speak of PG. county? Over the years I have watched tons of people leave PG. and make their way out because they couldn't stand it there any longer. But once out of there, they brought it with them. They move in next to an old farm and then complain about the odors and the mud and want to pave over it all. Well I am on the market and they can have what's left of it. If at all possible, I will leave the state where I spent a truly wonderful youth in search of place that has the same charm I remember. I am tired and haven't the heart to fight for this god forsaken place. It was once a country side of beautiful rolling hills with a bounty of everything that was great about America. In fact, it was always referred to as America in miniature. It had it all. From the mountains to the beaches and everything in between. Now it's just highways and buildings. Cookie cutter houses, wal-marts, and burger kings. Generica!

I am passing this along to everyone I can think of that will matter here in MD. and we'll light up the phones. But Mikulski and Carden are not know for their great voting record. Please everyone hound them until they can't stand it. Maybe for once they'll do the right thing.

HB 311 Passed!

I called Curt Anderson's office (a district 43 delegate) and they say HB 311 passed on the 23rd! I will update the post as soon as I get what I believe to be an accurate answer about S 266...

The House version of the bill passed after its 3rd reading on 3/24/09 with the final vote: 136 - 0. Thats right ... not one dissenting vote. We need to focus our efforts on our state senators to get the cross filed SB introduced and voted on. It has not been scheduled to date and its getting late in the session. I'll be on the phone to Senator Munson's office Monday am.

Another update...conflicting info (but keep calling)!

I just got some conflicting info...the bill might have passed on Friday afternoon. But why did staffers at Delegate Doory and Delegate McIntosh's offices not tell me this? One of them even began to tell me the bill got an unfavorable report, but I prompted her and she said she meant HB 182--the old bill.

I tried my third delegate, Curt Anderson, and no answer today. Hopefully I will hear back from him on Monday. He's a cosponsor also.

Even though my rep. is doing the right thing, most certainly doesn't mean the rest will. I have been hounding them about everything for a long time now.
I only hope they are so sick of me that they will act appropriately just to shut me up...heh heh heh .

Action needed in Maryland!! ASAP

Please help by calling the reps in Maryland and ask they support this bill -HB 311!! This is another chance to help curtail the abuses of our civil rights and make this as public as possible!! The fusion center in Maryland is MCAC.
