Drug raid "drill" at middle school...
Submitted by ri_liberty_guy on Mon, 03/30/2009 - 14:26
I found out today that the middle school here is conducting a "drill" consisting of police from all over the state, including state police and drug sniffing dogs. I am greatly disturbed by this. I mean, if they find marijuana, they should not be able to prosecute due to illegal search and seizure. I just wonder if they actually have a search warrant. Even so, a warrant has to be specific. I never watch the news, but I think I will tonight to see what happens. What do you guys think about this?

As the school is public property,
and I'm sure the government agreed to have it searched by the government, they most likely do not need a warrant.
As to what I think... any criminal charges that result from the search are absolutely ridiculous-- we're talking about kids here for the love of god.
That being said, kids probably shouldn't be screwing around with drugs and we all know they have no rights, so, if the purpose of the raid was to find out 'who was smoking dope between classes' and then letting their parents know about it so that they could take appropriate action, I'm not all that P.O.ed about it.
the purpose of the raid
"if the purpose of the raid was to find out 'who was smoking dope between classes' and then letting their parents know about it so that they could take appropriate action, I'm not all that P.O.ed about it."
the purpose of the raid is to condition the kids to a police state.
they will let their parents know they are in jail and that he/she is being charged with multiple felony's and are going to be suspended for the rest of the year and their kid will need to repeat the year.

Agreed
the purpose of the raid is to condition the kids to a police state.

Perhaps it's a "polite raid"
My elementary school child told me last week that her school had an "Intruder Drill" where all the kids piled up in the teacher's office and locked the door while some stranger roamed the halls....
Your comment reminded me of this incident where SC students were given no warning or "drill"....

Sounds like an interesting civics lesson being taught at that
school. Up against the wall children.

it doesnt matter in a public
it doesnt matter in a public school. they can do whatever the fuck they want because they are the government
Think for yourself, question authority
public property gives the invitation for the dogs...
...and the dogs provide the probable cause for the search. Sorry, but these things are very legal and very much, not new. They were a very regular occurance in my schools (Middle and Sr. High) during the '80s'. "If" this were a private school and "if" the School Admin. denied the police access or their dogs (unlikely), then you might have a case.
If there is no warrant it's an unlawful search raid....
Alert the community, administrators and Judicial authorities to the unblemished fact that an illegal kidnapping raid is in process.
That's what it is unless sound cause is proven before hand, our "LAW" is infallible and must set the school straight.
I don't think it's that Simple, Sam
In a public school, or any public building, I don't believe a warrant is needed to search. Only the consent of the administrator/school official.
The thought is, if it is in a public building, it is 'public property'. Even a storage facility (locker) is the possession of the facility, not the end-user.
Basically, tell your kid not to keep anything he/she wouldn't want to get caught with in a public locker.

by that logic
anyone in public housing is subject to a search at anytime. how about p.o. boxes?
