Drive and light up in Monroe County, and you'd better not have
a child in tow. Anyone smoking with kids 13 or younger in the
car will now be breaking the law. The ban got the green light
from commissioners in a 2-1 vote.

I just spoke with the county commissioner on the radio
and he admits that they'd like to eventually make this
law even tougher. Calling smoking with children "child-abuse,"
he admitted that it was an "interesting question" if parents
should be reported--and if children could eventually be removed
from parents. I'm really speechless right now....

As a kid
I remember Loving to ride with my dad because he smoked. I liked the smell. Still do. Wasn't sick as a child, except for the scarlet fever once. But whatever. Those that want to control, or have a different experience know better. I guess because I have no interest in controlling what offends me and others, do.

Not yet,but it's the responsibility as a parent for the safety of THEIR children.

I hate government, and I hate laws, but I also hate abuse of others and ESPECIALLY of children who cannot have a choice. It's a shame that people smoke around their children and it makes me cringe with anger every time. Forcing a child to inhale your smoke is WORSE than hitting.
Smoking in your home or car is not a crime. Threatening the health and well-being of others IS.
However, we don't want laws like this to get out of control. It would be scary if there was policing of what food we give our kids. But cigarettes are not like food, because there are many foods and only one tobacco, which is proven dangerous.

You know what You people are getting all hot and heavy over Your constitutional rights. Did You for one second ever think about someone else rights? You have a choice to smoke in Your car but Your child does not have a choice wheather or not You smoke in a child. Yes I do smoke and guess what second hand smoke is dangerous. Why not just learn some consideration for Your child and other people instead of bitching about some new stupid law. Also are You so weak that You can't pull over for 5 minutes and smoke in a parking lot?

The point is, the cops have no right pulling you over for it. Getting mad about a law on principle is good. It doesn't matter if you like the intention, does the government have any right to intercede should always be question #1.

I smoke and thats one thing I do not do. I will not smoke in the car with my child or my old lady. It takes a total asshole to smoke inside the car with a child. You might have a choice but that child does not. So no I am not going to get mad at this law because people that do it need a good dose of respect.

Motorists who light up in the car with passengers 10 and under would be subject to a fine of up to $100, according to a bill that passed a Senate Committee Wednesday.
The bill, which passed the Senate last year and died in the House, would allow law enforcement to pose a fine when there is clear evidence someone ?has been? smoking in a car with young children.
The bill's chief sponsor, Sen. Darrell Jackson, D-Richland, said the bill is intended to protect children from second-hand smoke.
The bill is still expected to have opposition in the House. Some members who helped kill the bill last year saw it as a slippery slope that would begin to ban smoking in private venues.
My 12 year old is the same height as my 10 year old....So are policy enforcement officers gonna stop and check papers of every car with the "clear evidence" of smoking? How does a policy enforcer make this determination while driving and observing? HINT: They can't. (I can only see this issue getting bigger, more intrusive and so as not to "burden" enforcement: Why not just saddle the steering wheel with "smoke detector breathalyzers" that call the sheriff? Or perhaps insist upon "chip and swipe" technology so the State Troopers can simply zoom by, swipe and make an age determination?....C'mon people THINK!)
Anyone in SC knows it's much more dangerous to drive (and breathe) behind a South Carolina school bus than it is to smoke a pack of cigarettes all at once, closed up in a car....sigh....hypocrites!

I'm practically speechless
I'm practically speechless too. If this had been the law when I was a child, all four of us kids would have been in foster care. My mom smoked like a chimney in the car and insisted on keeping the windows rolled up. None of us are smokers and we hate cigarette smoke. However, I believe in an individual's right to choose and right to privacy, even parents'. I was far better off inhaling a lot of second hand smoke then I would have been had I been sent to foster care over this or the many other big brother issues that dominates parenting today.
I have mixed feelings about this...
I almost feel that smoking in cars with kids infringes on their right to life.
My mother smoked, smoked, smoked with us in the car in the '60's and it was really bad. We were captives to it.
This is one of the FEW things I think where this type of legislation may be warrented.
But it is sad that idiots have to be forced by the government to not force this onto their kids.
The world is full of absolute idiots.
All I can say to justify this law is that it IS a proper role of government to protect our liberties which means our rights to LIFE, LIBERTY and THE PURSUIT of HAPPINESS.
I think this law falls under this category.

I'm open minded and maybe I'm wrong on the above post, but I hate smoking beyond words so my judgement may be clouded (pardon the pun) on this issue.
Remember, I fully believe in anyone's choice to smoke...
The issue here is a disrespect for the air around those who don't smoke or more importantly, those who are too young to excercise their choice to walk away from a situation they cannot control.

Feeding kids cokes and McDonalds
is child abuse. Childhood obesity is going to be the number one killer in this country. Children born today are going to die sooner than their parents because of their "crappy" diets. Forget smoking. Lock them up for feeding them garbage. I get so sick of people trying to "rescue" the children with all the seatbelt laws, smoking laws, child porn laws, don't touch a kid at school laws when they are killing them off every time they put something in their mouths. Give me a break!

Neglecting their children's nutritional needs and ignoring their growing obesity from feeding them junk food (proven to cause liver damage in a under 30 days if meals are eaten daily at McDonald's! -- ref: "Supersize Me") is apparently okay.
Where is the "health risk" tax on McDonald's, Burger King, et al.? (If you're still eating at McDonald's, you need to see the movie "McLibel")
Tobacco has become the scapegoat for just about everything -- meanwhile legal pharmaceuticals and junk food are killing billions!
McDonald's doesn't really cause obesity, though.
Sitting on your behind, and not exercising, is what causes obesity.
I agree that the fast-food diet of America is pretty base, tasteless, cheap, and full of cholesterol, but the problem is lack of exercise. I've met lots of fat people who eat nutritious food and don't lose weight. I've never met any fat people who jog, bicycle, or fast-walk at least three days a week who don't lose weight.
The government will likely codify the anti-fast food crusade soon..it won't result in thinner people. Just more lost freedoms.

I teach Human Nutrition and require my students to do a nutritional analysis of a fast food meal. It is the rare individual who can eat this stuff on a regular basis and not gain weight. The amount of calories and fat in this unbelievable. However, the combination of not exercising and eating this junk on a regular basis are two major forces driving obesity.

That is interesting. Planned Parenthood runs an abortion clinic a few blocks from county courthouse. Apparently the county commissioners believe smoking in a car with children is more abusive of children than killing them.

I'm a smoker, and anyone with the tiniest bit of intelligence would not smoke in a closed in space with children. Understood. Maybe there are morons who will smoke in the car with kids, it's not my place to criminalize them. What's next, no leaving your child in the bathtub alone til he/she is 8? Give your children the exact USRDA or be arrested? Let your child go outside in 55 degree weather without a coat and be investigated by DCF? Give your kid too many chicken nuggets and off they go to Homeland Security Fat Farm? The kid eats a little play-doh and the attorney general has to be involved? It won't end here.

Personally, I can't stand being around smokers and feel sorry for their captive children.
My dad and mom smoked their fool heads off, dad died at 39, massive coronary thrombosis (I was 14). Mom stopped later, and died at 75 with pancreatic cancer. Her sister who never smoked just passed at 90 (blood infection). I never smoked and I'm 66, but my 64 y/o sister does, and she had a quintuple by-pass early '50's. My daughter-in-laws uncle quit at 65 and died of lung cancer 75, they should of had a closed coffin funeral for him, it only took weeks after diagnosis for the guy looked like an Auschwitz victim. The daughter-in-laws 67 y/o dad can't walk 10 feet without being out of breath with emphysema.
Everyone gets what they deserve, except the kids.

child abuse than smoking anywhere in your home, in public ect. will all be child abuse. I say if cigarettes are really so evil than why are they legal.
They could just reclassify them and make them illegal or do they just use them as a tool ? Giving them more regulatory power and us less personal freedom ?
If you have ever seen the movie Demolition Man we are getting very close to that sort of mentality that the government knows whats best and you must obey, everything is illegal. If you could possibly do any harm to or endanger yourself it is illegal. Salt is bad and is now illegal. sex is dangerous and is illegal. eating red meat is bad and is illegal. How far are those who agree with this reg willing to take their argument ?
