Should President Obama have the power to shut down domestic Internet traffic during a state of emergency?

Senators John Rockefeller (D-W. Va.) and Olympia Snowe (R-Maine) think so. On Wednesday they introduced a bill to establish the Office of the National Cybersecurity Advisor—an arm of the executive branch that would have vast power to monitor and control Internet traffic to protect against threats to critical cyber infrastructure. That broad power is rattling some civil libertarians.

The Cybersecurity Act of 2009 (PDF) gives the president the ability to "declare a cybersecurity emergency" and shut down or limit Internet traffic in any "critical" information network "in the interest of national security." The bill does not define a critical information network or a cybersecurity emergency. That definition would be left to the president.

The bill does not only add to the power of the president. It also grants the Secretary of Commerce "access to all relevant data concerning [critical] networks without regard to any provision of law, regulation, rule, or policy restricting such access." This means he or she can monitor or access any data on private or public networks without regard to privacy laws.

The Cybersecurity Act of 2009 introduced in America seems to be yet another attempt by government to control internet traffic. But this is a bill that will probably keep rearing its head in the US and many other countries including Australia in one form or another. There is always enormous consumer and business resistance though to giving governments of any kind control over the internet which is a global commerce tool now. Shutting down any part of it could have huge unintended consequences. What government needs to do is regular penetrationtesting and just make sure no one can hack into its computer systems. This is the right way to approach the problem. Every day hackers are managing to find new ways to hack into government controlled computer systems. Shutting down just a part of the internet is not going to prevent the most ingenuous from developing new approaches.

An update of sorts...

I tried to relay this information in a separate post, which of course dropped off into cyberspace without comment.

I have my suspicions that cybersecurity will be revisited as an item of interest to the Obama administration. Here's why:

Melissa Hathaway, "acting senior director for cyberspace" and top contender for the position of "cybersecurity czar," has resigned earlier today for personal reasons.

In the meantime, in May a White House report on Cyberspace Policy has made it a priority to " to reconstitute the [White House Privacy and Civil Liberties Oversight] board" and "accelerate the selection process for its board members and consider whether to seek legislative amendments to broaden its scope to include cybersecurity-related issues." Oddly enough, this is despite the fact that ProPublica, a site which tracks changes in the White House website, noted in mid-July the omission of any mention of the Privacy and Civil Liberties Board. Civil libertarians are rightly concerned about the conspicuous absence of such a board.

Are these two news items related? Speculation is that Obama, dragging his heels over naming a Cybersecurity Czar, will use this resignation as an impetus to find someone who will effectively serve his agenda. And what of a board with funding, but no members, and no mention? What is going on behind the scenes?

S773 still has the same three cosponsors as of today. But if the Obama administration renews its interest in the cybersecurity issue, I would expect to see movement on this bill...and I intend to keep an eye on it.

This bill has had some action. It now has a number (S773) and cosponsors. The cosponsors are Senators Evan Bayh (D-IN), Bill Nelson (D-FL), and Olympia Snowe (R-ME). The sponsor of course is Senator John Rockefeller (D-WV). The bill was read and referred to Senate Committee on Commerce Science, and Transportation.

That they have all been bought out by the globalists and socialists...you are absolutely right in saying that the internet is the only "real" news source today, and now they are trying to take over that too. (Makes me want to pray imprecatory Psalms over them!)

Right now, there are three threads related to this. It seems the Swiss found the model to shut down the net by half. And low and behold, there are Senate and House bills introduced (436 and 1076, respectively) to try the model here. And of COURSE we got a cutesy anacronym for this, "SAFETY" bill... it is ALWAYS about our safety, and for the chillllldrennnnnn.....

Note that this bill does not have a number, and it does not have cosponsors. That's great news, as it means we have a chance to follow what's going on and to influence what eventually happens with this bill. I, for one, will do my darnedest to keep an eye on this and will bump this thread when needed.

My very first post, on HR1076 and S436, the Internet Stopping Adults Facilitating Exploitation of Today's Youth Act, went without comment and so was buried in obscurity. This bill would require all internet service providers and providers of WiFi--this means you in your household, your local coffeeshop, fill in the blank--to keep logs of all internet activity for two years for law enforcement purposes.

This requirement is similar to those already in place for libraries under the Patriot Act. The federal government hasn't been especially kind or respectful to libraries when asking for internet records. Why bother with a subpoena when it's quicker and easier to just threaten to seize the computer in question? (Sorry not to be more specific, but I have been told this has really happened).

Interesting Coincidence

One false attack away? Did you happen to read the news the three days before April 1st? The Conflicker worm was supposed to infect millions of personal computers and it was supposed to happen on the same day that this Act was brought to the Senate. I read about the worm on almost every news site I view (CNN, MSNBC, Wall Street Journal) and even my local morning new program talked about it. My parents who were out of town for the last week even called to ask me what they needed to do to protect themselves. If this bill had been passed already, I could 99.9% guarantee that the government would of shutdown certain facets of the internet. I believe that the government has good intentions, I really do. I just think that right now they are in a mad rush to control every facet of American's lives because they think they are smarter than we are. Man it makes me angry.

They would be shooting themselves in the foot.

Imagine if you will, they shut down the Internet like Ravenous says. How many people / businesses would be affected? How many Billions if not Trillions of dollars would be lost for even 1 days outage? I know that most of us take the Internet for granted, My Kids will never know what it was like before the Internet came to be. I do remember, I used to run a BBS back in the day. It sucked then, but it allowed for our communications to grow with each other. Nothing like today. Everyday, somebody is purchasing something on the Internet for themselves or for a loved one. Imagine the lost taxes the government would lose out on because of "shutting down" the Internet because they don't know how to secure their own equipment. How many jobs would be lost because the government is turning off the Internet because it's deemed "un-safe" ? Sounds like someone in the Emerald Palace needs to get in touch with reality. I've worked for an ISP and if a business wasn't able to get on. OMG, the sky was falling, and their business was losing money. Now imagine that kind of reaction across the United States. Won't take long for a group of us to get together and do an old tar and feather action to a few politicians and kick their F'n butts out of the country.
