Supreme Court Citations?

These officers imply on more than one occasion that the Supreme Court allows them to conduct a warrantless search on basically no suspicion (or on false suspicion that they dream up on-the-fly as is increasingly rampant among law enforcement of late). The Supreme Court has ruled:

"The Fourth Amendment [is] held to forbid Border Patrol officers, in the absence of consent or probable cause, to search private vehicles at traffic checkpoints removed from the border and its functional equivalents..." --United States v. Ortiz, 422 U.S. 891

...and...

"It is agreed that checkpoint stops are 'seizures' within the meaning of the Fourth Amendment." - UNITED STATES v. MARTINEZ-FUERTE, 428 U.S. 543

...not to mention that the card personally handed to the driver by one of these "officers" clearly states that specific, reasonable suspicion is required for a search. Nevertheless, regardless of what the card says, if it conflicts with the Constitution then it is trumped by the Constitution, which is the highest law in the land. There are several other researchable Supreme Court cases specifically related to internal checkpoints which directly refute the officers' statements in this video.

I find it laughable that one of the "officers", sworn to uphold the Constitution, instructs the driver that he needs to educate himself. It seems to me that there is, in fact, a desperate need for education in this instance, but not on the part of the driver.

In modern times, when an individual declines to consent to an illegal, suspicionless search, such refusal *IS* probable cause for a search in the brainwashed minds of the majority of law enforcement officers. "If you have nothing to hide then you'll consent to a search; otherwise, you must be guilty of something, so I'm going to search anyway." Personally, I have not been inclined to subject myself to such petty "logic" since I last heard it on the playground sometime around the third grade. "Oh yeah?! Well then prove it!"

Also, what happened to the burden of proof being on the accuser? If these so-called law enforcement "professionals" suspect that the driver is in violation of immigration laws, or that he has illegal contraband in his vehicle, then they need to accuse him of a specific suspicion, along with good reason/evidence supporting specific probable cause, then conduct a search. But what we have here is a case of, "I think you might have done something wrong. I'm not sure exactly what, or even why I think it, but the burden is on you, the accused, to prove me wrong."

I will side with one of the officers when he indicated that the driver was acting in an unusual manner in comparison to the general flow of sheep passing through that checkpoint on a regular basis. They are not used to individuals standing up for their rights - it is sadly unusual these days. It is, however, ironic that an individual asserting his Constitutional rights instills intimidation and suspicion in the minds of officers sworn to uphold our Constitutional rights. WTF?!

Now I do understand that these officers are just doing their collective job and *think* they are doing some good for the country. However, they do so not realizing that they are being used as pawns of obedience training for the next steps of slowly eroding the Constitution, as carefully planned by the men behind the curtain - their unseen masters. This is exactly and precisely the reason that the most desirable quality for a DHS/Immigration law enforcement candidate is that he or she is just intelligent enough to blindly follow orders, even if done so against the officers' own conscience, and regardless of whether or not such orders violate the Constitution, but not intelligent enough to think outside the box and ask questions. This is quite clearly demonstrated in the video above. And the bottom line is that these checkpoints are doing very little to protect our country albeit it at great cost of operation to the taxpayers - research the statistics. Never mind the DHS/Border Patrol agent corruption cases stacking up by the week.

I feel much safer with these checkpoints in existence and I definitely feel that the taxpayers are getting bang for their hard-earned bucks. [/sarcasm]

The only sticking point is that line in the 4th Ammendment that says "unreasonable" search. In their minds they were not being unreasonable because he wasn't acting like a sheeple and just succumbing to their wishes.

But does that in itself warrant probable cause?

A "rebel", how can you rebelled when you are simply stating your rights under the 4th amendment and the constitution, the only way you can rebelled is when you actually let them search with out a court order as writing in the constitution.

I'm guessing FEMA wont actually name its camps like this, "hey are you a person who follows the constitution? if so than this is this the the "camp" for you.".

The "border" patrol are for the border not inside my state! but the damn border, and when they ask if your are a "U.S citizen" your response should be "I'm a Citizen of state name of this United States" the only people who are "U.S citizen" are the territorial "states" belonging to the federal government.
