Seems to me that McCain is trying his best to protect any potential criminals by deflecting responsibility on those who "gave advice." He points out that it was "bad advice." And, we all know that "advice" is really just an opinion - so there should not be any responsibility for it.
BUT, there is a BIG difference between "advice" and "orders." Orders WERE given. Someone gave the orders. Not "advice" but ORDERS.
In addition, individuals CHOSE to carry out those orders all the while knowing that they had a legal obligation to disobey unlawful orders.
This issue has nothing to do with "bad advice." It's about "bad orders" and "bad actions."

Well ya just because there is an investigation doesn't mean we have to prosecute either all it means is we need to investigate and determine if there was wrong doing.
Nothing wrong with that. I'd rather have congress having bitter investigations than passins stuff.
