I really get sick of peabrain situations like this. One person said all you have to do is make a lot of noise and the bear will run. Well, if your really lucky, but how about if your not lucky, what if it isn't your special day! Here's the link:

It is true that black bears are usually easy to scare off,

but if they get aggressive they are dangerous. It sounds to me like this guy just freaked out. It was probably the first bear he had ever seen outside a zoo. If he admitted the bear did not threaten anyone, then he probably should be considered to have taken a bear out of season (not to defend the game laws, just their equal application).

bears are COMPLETELY unpredictable.

sure, you can often scare bears away with noise ... but anyone who relies on that is a fool.

the reality is...

bears WILL kill you ... and they don't have to be provoked either... as a poor olympic athlete found out while trail running with headphones on. or how about the lady gardening in her back yard... very provoking huh?

bears WILL break into houses via windows as lower mainland residents were shocked to find out last summer. so don't feel all safe and cozy in your house or car.

bears used to people DO NOT scare easily. so saying... 'leave it alone, make noise, and it will go away... is a REALLY ignorant comment. ask anyone in Whistler, Jasper, or Banff.

hunters often have to use more than one bullet to take animals down. not unusual with bears or elk.

I would usually say go with a jury trial but obviously a lot of the people writing these commits (on the website where the story is), I mean the sheep are protecting the bear.

I once went to court:

for shooting a dog that was in my back yard, going after my kid. It belonged to a neighbor that had told me to stay away from it because it was not so friendly and might bite. Well, I stayed away from it, he didn't stay away from me. I of course won the case, but really. I can't believe they would even consider prosecuting this man.
I also know a man who many years ago shot a bear endangering his family and he went through pure hell over it. It turns out that the the states attorney had told him that if he relinquished the hide to him, he wouldn't prosecute.
It's bad when you can't protect your life because the critter is endangered.

I live in bear country

We "just" have black bears. In fact, I saw my 1st bear of this year last weekend. He was at a pond on one of my neighbor's property. We were about 1/4 mile away when we spotted it - I thought it was a horse, and my friend thought it was an elk - until it moved. It was a BIG dirty blond boar! Generally speaking, the black bears will do whatever they can to avoid humans, but it just takes a little carelessness to chum them in (Garbage, bird feeders, feathered friends). I personally know both the state game wardens in my county. They will aggressively prosecute poachers, but there is no way they would ever infringe on my right to protect myself. In fact, one of my nieghbors (70 yo widow) was being visited by a bear (humming bird feeders) and one of the game wardens spent the night in his truck at her house watching for the bear. There are a few situations when the black bears are truly dangerous (don't surprise them, don't get between sows & cubs ...). My dogs are always with me when I walk in the woods. Bears don't like the sound and smell of dogs. My dogs (labs) wouldn't last a milli-second with a bear. I have never heard of a bear breaking glass to get into a house, but I have heard of bears breaking glass to get out of a house. I have repaired windows where a bear had grabbed the window frame and tried to pull the whole window out. They are absolutely amazing animals to watch any time I get a chance - big, fast, graceful, strong beyond comprehension. I hope I'm never in a situation of having a bear make an agressive move toward me (or others). If you're indoors and the bear is outside, you're cool. If the bear is inside, go outside. I can give black bears the benefit of a doubt, but if thought I was threatened, I'd shoot - brown bears ... shoot & ask questions later. Bears are the only reason I don't have chickens.
