What is appropriate punishment for crimes?
What is your thinking on crime and punishment?
I do not like the current system we have where if someone commits a crime they go to jail and then to prison for years at a time. I preach every week at the local jail and my heart goes out to these guys. Some of them get a year and are in jail till their time is served others get a lot of time and are waiting for transfer to prison. I think that it is cruel to keep someone locked up for years at a time, and I was wondering what your thoughts were on other forms of punishment like the stocks, or flogging, or the strap (george washington used this one on unruly troops) vs prison time.
Granted I am not talking about drug laws on this, I am talking about people who actually went out and hurt other people, or took their stuff, I know a lot of the guys I preach to and help out are in their for drug related stuff, and I understand that they should not be in there, but for the ones who actually hurt other folks what should their punishment be, and why?

What is the, your, definition of a crime?
Does include the corpus delicti?
CORPUS DELICTI - The body of the offense; the essence of the crime.
It was a general rule not to convict unless the corpus delicti can be established, that is, until the dead body has been found. Instances have occurred of a person being convicted of having killed another, who, after the supposed criminal has been put to death for the supposed offense, has made his appearance - alive. The wisdom of the rule is apparent; but in order to insure justice, in extreme cases, it may be competent to prove the basis of the corpus delicti by presumptive, but conclusive, evidence.
One of the significant items to note is that a corpus delicti requires a victim. So is speeding a crime? Is smoking pot a crime? Is J-walking a crime?
Who is the victim in those instances? No one, therefore it is not a crime according to the corpus delicti (Body of a crime).

All I Know is Mandatory Sentencing Laws are Wrong
Punishment should be based on community standards and expectations, not bureaucratic leap frogging. Judges have wrongly lost the the ability to exercise discretion in many cases. The letter and spirit of the law need to be followed but with mandatory sentencing guidelines, only the letter is breathing, the spirit is dead.
Many serving long term sentences really shouldn't be. I do expect economic conditions to relieve some of these problems as the tax base will no longer support incarceration costs which will lead to many reviews of who should and shouldn't be locked up.
