I just got a seatbelt ticket by the SC Highway Patrol

I will be taking this to court, its only $25, but its the point, I was pulled over just for that. Before the cop turned his lights on and pulled me over my seatbelt was on and stayed on when I got my wallet and insurance out of my pocket!
I think I will request a JURY trial, making sure even if I lose that it will cost the County more! If we all fought a ticket like that, they would stop giving them out.
Do any of you have advice for me?

SECTION 56-5-6520. Mandatory use of seat belt.

The driver and every occupant of a motor vehicle, when it is being operated on the public streets and highways of this State, must wear a fastened safety belt which complies with all provisions of federal law for its use. The driver is charged with the responsibility of requiring each occupant seventeen years of age or younger to wear a safety belt or be secured in a child restraint system as provided in Article 47 of this chapter. However, a driver is not responsible for an occupant seventeen years of age or younger who has a driver's license, special restricted license, or beginner's permit and who is not wearing a seat belt; such occupant is in violation of this article and must be fined in accordance with Section 56-5-6540.

except that the bastard lied and accused me of putting it on after he flashed his blue lights at me.
an injustice was done to me last night on July 5th, 2009 by highway patrol trooper, TFC Prince. was it on broad river road by any chance?
i was stopped at a red light with two vehicles in front of me on the corner of bush river and broad river road and i was in the left hand turning lane. mr. prince was parked right behind the traffic light because i saw his car sitting there.
i proceeded to turn left and mr. prince was suddenly behind me with his blue lights flashing near the racetrac gas station on broad river road. my friend, who was in the vehicle with me saw that i was wearing my seatbelt and i knew that i had my seatbelt on. i knew that i was not speeding. i quickly unbuckled my seatbelt to get my wallet out of my back pocket and i reached for my other information in the glove box (i cannot reach the glove box without unbuckling the seat belt first.). i rolled down the window and handed mr.prince my license and asked him, "did i do something wrong?" he responded, "i will let you know after i look at your license."
after he gave me my license, he said, "i stopped you for your seatbelt." i said, "i just unbuckled it".
then, mr.prince accused me of putting my seatbelt on as i was driving and then taking it off again when i was pulled over.
i never ever drive my truck without my seat belt on. in fact, that truck is almost impossible for me to drive without my seatbelt on. my friend tried to let him know that i did have it on and he would not listen. he gave me a $25.00 fine.
i called his supervisor, mr.grubb and he defended mr.prince. i asked him if he could look at the video and he said that he would, but that he knows mr.prince very well and knows that he would not make something up.
when things like this happen, it really concerns me because i feel as though mr.prince was looking for a reason to pull me over and charge me with a fine. it would be a really awful thing if the economy were affecting us so badly that police are now inventing reasons to give innocent people tickets and it is really not fair.
i understand that there is a court date and yes i know that my witness and myself can fight this before the judge, but that is also an inconvenience. my friend is moving to north carolina in two weeks and i have to take that day off from my job now because of this man's lie.
another thing, almost a month ago, my friend was pulled over by highway patrol officer and the reason that he gave her was that her tail light on her vehicle was out, which it turned out that it was not. it was actually a little dim. he was nice and admitted his mistake and let her go with a small warning.
why are these things happening? i am undeserving of this. can you help? if mr.prince had been telling the truth, i could understand and would accept my punishment and fine and that would be it, but if there is a way other than to go downtown, to the courthouse and wait five hours to fight a traffic ticket for $25.00, I am willing to take that route.
also, if i have to, i will contact anyone else and whoever is willing to listen to me and my case. like i said, it's one thing if i had really done what he accused me of doing, but i did not and i am innocent. to me, that is abuse of authority. the fact that nobody wants to examine the video is another thing. i contacted internal affairs and a very supportive gentleman took my complaint. i am not sure if he is going to look at the video or not. i hope that he does.
I just feel that things like this are completely unconstitutional and that people should be aware that things like this are going on. you are not alone, friend.

Also I dont mind the tail light thing so much because they are supposed to serve us and "protect" us, since they are informing you of a problem I dont have a problem with it till they seek money out of the deal.

Check your state's motor vehicle/highway/etc. act or the equivalent.

Were you in fact driving or were you traveling? If traveling is defined as private activity and driving as commerce as it is in many states (and provinces) then perhaps the statute does not even apply.

And they certainly won't expect you to be aware of any of this!

I was thinking about you people today when...

I was West bound on US Route 20 going toward Elgin, Illinois today. Out of nowhere a Illinois State trooper came right up on my rear bumper at 65 miles per hour. I'm thinking I'm speeding or something, so I get out of the show-off lane to the curb lane, and he keeps on going as I exited ?

I'm thinking he was in a hurry and I'm not suppose to be in the show-off lane unless passing - that's why he tail-gated me, I'm guessing ?

I was on my way to look at a retirement 55 + community. The prices have dropped $40,000 dollars on the low end models alone. Nice, but Kane County, IL has high property taxes. For a low end $200,000 model taxes are $5,000 a year. Stopped at Elgin's River Boat casino on the Fox River for a $11 buffet lunch on the way back to Chicago. I ate like a king, I highly recommend it if you are out this way. Remember, stay out of the show-off lane if you are not passing someone in Illinois, ticket offense.

It is illegal to pull someone over to check for a drivers license or without proof of public endangerment. Wonder why all the illegal checkpoints are popping up all over? Aside from conditioning the public for the forthcoming mass arrests it is also a desperate attempt to raise funds for all the insolvent cities and counties. The tickets issued are called "illegal executive equity excise tax assessments". Again, the citation is a tax. As the unlicensed, uninsured, unbonded, unsworn cop knows he has no delegation of authority to be a tax assessor. Ask a cop how he is able to stop (arrest) you without cause [proof of claim or damage(s)] or without a warrant. He'll just point to his gun and give you a smirk. He is not out solving crimes but participating in them under color of law. All that he wants is your credit/Federal Reserve Notes valued in Special Drawing Rights for his masters. The extorted funds are then diverted into the CAFR.
As the spirit moves you look up the legal definition of "inland piracy" and it's penalty. Under the Trial Court Funding Act the cop, traffic commissioner or judge, district attorney, public defender and the clerk of the court all have a financial interest in your guilt. I would like to know what the definition of the driver,every occupant and this state is. I have been pulled over 4 times in the last 7-8 days, which includes my workers as well. When I pulled up to a job the other day a car was following me as I was getting out of my truck they came over to me and flashed badges and started asking me questions. Well it now seems we have workers compensation police here patroling the city of Boston. I was not very cooperative with them because I didnt think i needed to answer all of his personal questions. Well he got pissed off and called the Boston police and what they call the truck enforcement team. The truck team showed up in a Boston police car and I proceded to ask him questions. he didnt like that too much. He had a Boston police uniform on as well. I asked him if he was, city, state or federal. He told me he is with the federal. So it looks as though all of the truck teams work for the federal. How can this be and where do they get their jurisdiction from. I dont believe he has jurisdiction or standing. That is why i posted these videos below. I will let you know how we make out. We are getting shaken down out here, state,federal,OSHA,workers comp and the list goes on.

In `92 I was issued a seat belt ticket by the DPS just west of

Bracketville ,Texas headed east towards Uvalde. I called for a jury trial ( which cost a $200 bond). I knew at the time that if you vehicle would carry a 1200 lb. load or more the seat belt was optional. I was driving a 1/2 ton Ford pickup that would legally haul 2300 lbs. I called Austin Tx. and asked the DPS how many seat belt tickets (in $ amounts) that they had issued to drivers of pickup trucks that year. They said a little over $4 milloin. Needless to say I won my court case by showing the judge the written law. I told the jurours about the law ( 6 citizens, a petit jury) and that the DPS had been committing Highway robbery against the citizens of Texas.
Two years later the scumbags in the Texas Leg included all trucks in the seat belt confinement law.
Now I am usually found driving my motorcycle.
