Help being audited by the IRS

Fellow DPers got a letter today from the IRS stating that my 2006 return is being audited. Any advice will be welcomed. I used myself as my own tax preparer so I'm on my own here.

My experience when I got "the letter"

I contacted my CPA and asked him what I should do. He said the worst thing I could do is attend the meeting they wanted me to go to and "discuss" their audit. He said they are trained to get (extort) information from you (w/o waterboarding) so they can bring in other years or areas that are not included in the original audit. He went for me and the case was closed.
I also spoke to a friend at work about it, after I talked to my CPA. My friend had been audited and he said my CPA was exactly 100% correct. When he was audited, he went on his own and they asked all kinds of questions that were not part of the original audit and he really got hosed by them.
Just my thoughts, be careful and take care.

will take the advise of some and contact an accountant. I'm still dealing with FEMA last november they made me get fllood insurance on my home because I live on a lake. Had to hire a surveyor to check out the evalation to say it was high enough and not needed. Still waiting for their final report so I can stop paying. Now I get to deal with the IRS. I feel like a new revenue source for the federal govt.

So what is the big deal?

Did you leave off some taxable income or claim deductions that were not real?

If you foolishly filed a return and deliberately left off income or claimed fraudulent deductions, then you do have concerns; otherwise, just provide them the details they requested and don't worry.

It is far better to not file a return than to file one with false information.

Don't volunteer any information that they did not specifically ask for? Don't make any confessions if you did fudge? Be very sparing with your answers, but don't be evasive.

Most audits are routine, and either were a result of random selection or deductions that were out of proportion to income levels. You may have consciousness of guilt, but they may only have a very limited purpose, unrelated to some part of the return that may be completely correct and supportable by your records.

Don't send them original records. Make copies.

that is 100% incorrect. Be 100% organized. You will piss these people off and they will start to dig more if you look like a disorganized fool. The IRS wants easy pickens, so make it look like you have your shit together. They are like the government, and they will feed on you if you look weak, so make sure you have your paperwork organized like a damn pro. That is of upmost importance. If you look disorganized, they will rape you for every penny. Organization is key, so make sure you have it together, good luck.

the utah office is where all the bogus returns go. Like the zero returns, etc.Some become more than an audit at that location. Be careful

Don't be afraid and don't settle on a payment plan

the worst they can do is say you owe them money. Get an accountant to look over your returns to see what the worst case scenario is. The worst thing they can do is say you owe, so play stupid and say I have no idea what I am doing so tell me if I MAY have missed anything. Do not admit guilt and answer as few questions as possible. Say well I got an accountant to look over these returns so I will have to get back to you. Most of all, don't be afraid, screw the IRS and give them some From Freedom to Fascism DVD's. Good luck.

If I am not mistaken

I was watching Michael Badnarik the other day at http://www.archive.org/details/Michael_Badnarik. In one of the segments, I believe it was either segment 2,3 or 4. Badnarik says that if you respond to the IRS audit within 10 days (and basically tell them bullsh*t) the burden of proof now turns back to the IRS. He is a pretty credible guy, maybe worth looking into.

Did you claim EIC? That is one of the fastest ways to get audited!!

...And I must make a comment about "real accountants". I was office administrator for a "Top 20" accounting firm (some of the most miserable days of my existence), they helped me with my 2004 taxes....and I'm still waiting on my return...

Do you know why they're auditing you? Was it something specific, or just the luck of the draw?

To have your audit canceled . . .

The IRS audited me a while back, and they did the same thing, asking me to mail in supporting documents. I did. A few days later, the IRS office burned to the ground, and I received a letter of apology telling me that my documents had burned and my audit was canceled.

Just a thought . . .

It's a nice thought

It's a nice thought. Still dealing with Fema also. Made me get flood insurance last november live on a lake. Had to hire a surveyor to say I didn't need it that evalation was high enough still waiting for Fema final report now I get to deal with IRS. I feel like I'm a new revenue source for the federal govt.

Here's what to do

You could try stuffing all your papers, receipts, anything they might be interested, into a big file cabinet nice and messy. When the auditor comes over, it's their duty to go in and sort it out if they're hell bent on doing a audit. They'll give up after a while and that's when you can try and haggle a deal with them.

Ask them

If what you send them will be used against you....if so (and it will be) then declare your right under the 5th amendment...

Get an accountant

a real accountant, and not one of these cheese ball fly-by-night operations that you see on t.v. around tax season. An actual accountant is invaluable, and is worth every penny spent.

Minor suggestion

Don't reveal that you resent their authority over you. Pretend to respect their authority up to the point of letting them get away with something bogus. Be polite. And depending on the specifics you should hire an expert.

The point is...

They're the ones with the guns, it only makes them come after you harder if you defy them in the process of raping you. Just sit back and enjoy the ride, you have no choice anyway.

First of all - don't panic.

Don't assume that they have you pegged as a tax avoider. Most tax audits are on a more-or-less random basis. If your paperwork is "all in order" - you should be fine. If your paperwork is not "all in order" - watch out.

If you think that you have been specifically targeted for an audit - get a tax lawyer on your case and don't say ****.

Watch out....

I got an IRS scam letter last year. Looked official but wanted my SSN, bank account number, etc. Call your IRS office to verify. First.

Didn't request personal info like bank or ss#

It also came with a twelve page questionaire to be filled out in detail. 2 copies of everything so. Called when I opened it ,on hold 30 minutes and guy gave me he'e employee #.

What's the return address on the letter?

Is there a phone number on the letter?

Does it match the phone number for the IRS listed in the phone book?

Before you send off any paperwork, it might be an idea to contact your nearest IRS office and ask them if the letter is legit.
