You see, we already know how this nominee would rule on Second Amendment rights: she doesn't believe we HAVE any!
Judge Sotomayor, a New York native, ruled on a Second Circuit Appeals Court panel that the Second Amendment is not a fundamental right and does not apply to the states in the case of Maloney v. Cuomo. This ruling is in direct conflict with a Ninth Circuit Court ruling in the Nordyke v. King case in California, that the Second Amendment IS incorporated through the due process clause of the Fourteenth Amendment.
So what does it mean, that Obama now nominated Sotomayor to sit on the U.S. Supreme Court? It means that any progress we've been making lately... WILL BE REVERSED.
While Democrats in Congress have been making great strides in the gun rights arena, refusing to consider a renewal of the Clinton gun ban, and offering overwhelming bipartisan support for legislation allowing citizens to carry firearms in national parks... President Obama just demonstrated that he prefers judges who OPPOSE Second Amendment rights.
The Supreme Court may take up this issue of incorporation during its next session beginning in October, because attorneys in the Maloney case plan to appeal in late June.
So, JUDGE Sotomayor ruled against our Second Amendment gun rights in Maloney v. Cuomo. If the Maloney appeal is accepted by the Supreme Court... would JUSTICE Sotomayor recuse herself from deliberations?
It's doubtful a judicial activist would ever do that!

Judge Sotomayor has also written an opinion that declined to order the release of certain information under the Freedom of Information Act. In one case, according to SCOTUSblog, she wrote that the "unwarranted invasion of privacy" for individuals whose names would be release under an FOIA request outweighed the public interest.
So, JUDGE Sotomayor seemed to rule to protect privacy rights...Would JUSTICE Sotomayor be just as protective of the privacy rights of concealed carry permit holders if a newspaper wanted to publish that information? Or is it more likely that an anti-Second Amendment judicial activist like Sotomayor would reject our privacy rights, in the interest of "protecting the public"?

How many senators?
How many senators have the guts to challenge someone who believes in empathy, emotion, gender, race, and other factors over the rule of law, precedent, or the constitution? My guess is about twenty five at best and if it was a perfect world between 35-40 votes. Her confirmation hearing will tell the tale, but it matters who gets elected. Personally, I wish the Hispanic community would just be Americans first, second, and third not worrying about ethnicity. No filibuster, no chance, no how, unless she messes up on her own between the present and the confirmation hearing. My educated guess is that she will be a justice with a 70-28 vote.

People like her because she's a woman, hispanic, poor background and she's appointed by a (halfblack) black man and the first (halfblack) black man to appoint a hispanic (or was that cardozo in 1930?) to the supreme court. Australians gave up their guns a year ago and now the crime rate
is SKYROCKETING because the criminals have their weapons so they can brazenly committ crimes, especially against the elderly and people who are at home completely defenseless! This was pointed out by the Australian policeman. I think even the police are beginning to regret the gun confiscation now, there jobs have become so much more difficult!
I read an article yesterday about this 81 yr. old Australian granny who used a .9mm pistol on 2 thugs who raped her granddaughter; granny staked them out for a week, took pictures of them back to her granddaughter to positively ID them and then went and destroyed their manhood!!! WAY TO GO GRANNY! She then went to the police dept. and turned herself and the gun in, which I wouldn't have done, but oh well!The officials don't know what to do with her because the citizens want to elect her the MAYOR!

Nominating Sotomayor reveals the president's true colors

With his nomination of Judge Sonia Sotomayor for the U.S. Supreme Court, President Obama has abandoned all pretense of being a post-partisan president. While he may like to think of himself as a thoughtful moderate soaring above the issues that divide America, his actions reveal what hides under that hopeful lining.
Presidents usually nominate judges that espouse their philosophy. So what does this nomination tell us about Mr. Obama's true colors?
Even the liberal establishment worries that Judge Sotomayor tilts too far to the left. New Republic essayist Jeffrey Rosen reports that fellow liberals who have watched or worked with her closely "expressed questions about her temperament, her judicial craftsmanship, and... [they have said] she is 'not that smart and kind of a bully on the bench.' "
A suspiciously high number of her decisions have been overruled by higher courts. Wendy Long of the Judicial Confirmation Network said that record shows "she is far more of a liberal activist than even the current liberal activist Supreme Court."
There will be much to say in days to come about Judge Sotomayor's manifest lack of appropriate judicial restraint and about other problems in her record. For now, though, three red flags beg for attention.

Given The reversal of Michigan v. Jackson, as requested by the OBOZO administration and delivered by the "conservatives" on the bench, I don't see where it matters. All is lost under the present system controlled by the cabal. Nothing will change for the better. Forget it. This lady is a catastrophe. Many of her rulings were later overturned by the Supreme Court. As a reward they're going to stick her on the Supreme Court. It hurts my head to think of how much damage another activist judge could (and likely will) cause. Let's not forget the SCOTUS came within 1 vote of declaring the 2nd amendment did not recognize the right of an individual to own a gun. This lady would've tipped the scales. That's effing terrifying. Every day I watch the news as everything I believe in is crapped on, belittled, or ignored. I have a really bad feeling about this lady. Really bad.

She is replacing a judge that voted against the majority in the Heller decision, so the scale so far is still weighted in favor of the 2nd amendment being an individual right.
And it really doesn't matter anyway because we are running head long into the collapse of the federal government which will either soon go the way of the USSR or, if it insists on trying to maintain control will become embroiled in a terrible civil war where those who want a federal government and those who don't start killing one another to see what the political entities of the future will be; 1776 and 1861 all over again; won't that be fun.

Yes, Sotomayor would've voted against the majority in Heller beyond doubt. But I don't look at it like Sotomayor is a one-for-one replacement in Heller. I look at it like she's yet another activist judge who will imperil my natural human rights. It's impossible to say what the tipping point will be but having Sotomayor cannot help things. We came within 1 measly vote which means the situation is dire. It simply cannot be that the 2nd amendment would be revoked by idiot SCOTUS judges. We can't afford any more encroachment. This lady gives me a bad feeling...
You can't bank on when the SHTF. I agree it's likely to happen but I have no idea when. Dr Paul was convinced in the '70's total fiat money wouldn't last as long as it has. Actually, I'm kinda hoping it'll be sooner rather than later because the earlier it happens the more time we'll have to fix the problems as free people. If any of us survives, of course. But the nightmare scenario is this drags on for decades while the Supreme Court continues its slow destruction of our rights. Sotomayor won't help and I have a bad feeling she'll be cheerleading the march to serfdom. Boil a frog, you know.
Let's face it.
This kind of anti-freedom judge is the only kind of candidate that Obama is going to select.
The Senate has no desire to oppose a selection that will further the destruction of the USA. They will pass Sotomayor, or else they will get somebody else to approve that is just like her anyway.
Eventually people will wake up and understand that there will be no peaceful solution to this tyranny. No sir. They are not going to "give you your country back". Nope. YOU are going to have to take it from them.

As for "Obama is appointing an anti-Second Amendment judge", wouldn't that be a logical expectation? After the Heller decision, the only easy way to come close to disarming the public would be to legislate gun rights away from the bench.
Republicans need to learn to take responsibility for their own unintended consequences. Had they opposed Bush in the court of public opinion, instead of licking his jackboots, and had they opposed McCain instead of rallying behind him, Obama would not be President today, and none of this would be happening. Bush should not have been given free rein to trample the Constitution, Cheney should have been impeached (or forced to resign), and the GOP voters should not have chosen McCain in the primaries instead of a conservative or constitutionalist candidate, like Ron Paul. In fact, leaving out our favorite candidate, suppose Bush had been pressured by Congressional Republicans with guts to force Cheney's resignation, and appoint a more Reaganesque Vice-President? Fred Thompson, for example. Or the oft-mentioned Mark Sanford? Or even Palin?
Any of the three could have run from an incumbent position, and beaten Obama easily. The McCain nomination, and his inevitable defeat, were logical culminations of what would happen after eight years of neo-con Presidency, untempered by dissent, because only one Republican on Capitol Hill was willing to stand up to the power structure and vote 'no'.
I'm sick of hearing these callow bastards whine about how everything is the fault of Democrats. If the Republicans were worth voting for, the Democrats would not be in power.
