To me 1st degree murder is ridiculous, sounds more like mutilating a dead corpse. This man needs a shrink, not a prison.

I noticed as well, but I tire of being the super-anal spelling nazi. I get so worn out correcting such egregious bone-headedness (starting in High School when I'd regularly correct THE ENGLISH TEACHERS' spelling and grammar) that I am delighted to see someone else pick up the baton.
Also, while we're on the subject of my being a jerk: A "dead corpse" is redundant, isn't it? What other kinds of corpses are there?

This is the injustice system making an example of someone who defended himself and the business....lest others think about using a gun to protect themselves and their property.

...when I saw the video, after reading the story.
Notice how Ersland shuffled the two WOMEN into a back room (or somesuch) when this unfolded. He wasn't overdoing it, he had people- women- to protect, and that scum was getting up.

Yup. It all happened pretty quickly and if it were me I think I would be scared to risk that the person would suddenly start shooting a gun. The system is being very heavy handed on someone who didn't create this situation, it wasn't him who schemed to hurt others - he was the victim and he may have saved himself and the store patrons from death, rape, or who knows what nasty fate. He also might haved saved taxpayers a lot of money from jailing the thug except now they are replacing the thug with him.
Also, I noticed at the end of the video segment that they said something about how they are requesting that citizens stop calling about the case. It sounded as if maybe local citizens are outraged that he is being punished. I really hope this case is dismissed or a trial acquits this man.

well exept that I dont and wont take any drugs, but just having him in the area would reduce crime. Just a couple of months back we had a papa johns delivery guy kill somebody in self defense, I have been ordering pizzas from them ever since and let them know that is the reason.

I say he should shoot the moron to neutralize the threat. Wish he would have got the other one too. Walking past the guy and common sense tells me the guy with a bullet in his head was no longer a threat. Thus the need to go get another gun and shoot him 5 more times is a mental issue (due to the stress of the cituation or something else). Therefor I stand by my statement he needs a shrink not a prison. If he wouldn't have gone so far overboard I would say he needs a medal.

Before seeing the video I had no problem with it. But the pharmacist did not appear freaked out. He may have combat experience, it looks like he knew exactly what he was doing. He was acting calm and collected. As a juror, I would be asking why the pharmacist turned his back to the guy on the floor twice, and did not bother to keep an eye on him, IF the pharmacist is claiming he was in fear for his life. He cannot claim he was worried about the guy on the floor, watch the video, the pharmacist runs by the guy once without looking at him before running outside (understandable, if he thinks there is no threat left inside). Then he walks past the guy on the floor after coming back in, turns his back on the wounded robber, does not watch him, then walks back over and shoots the downed robber.
Don't get me wrong. I believe the pharmacist had every right to defend himself and his business. But, like the DA said, there is a difference between defense, and offense. We cannot see what the kid was doing on the floor, if he had a weapon and tried to pull it, that would then deserve getting shot again. Supposedly there was no weapon.
I would like to hear the pharmacist, and eye witness testimony.
None of us knows how we would react in such a situation. All of the innocent people survived, so that is a plus. The kid made a fatal decision, one which he did not live to regret.
I recall being told many times over........
my life experience that, if you shoot someone...make sure they are dead. This was the mantra as severely wounded often ended up suing and winning huge civil lawsuits from persons "defending" themselves.......

The government does not want the people to protect themselves...,this guy is going to go to jail.......Wrong as that is. Our judicial/legal? system could not "profit" if people took justice into their own hands. Imagine no lawyers, judges, fines, prison industry. Nah...this guys going to jail.
I think they are hoping he will "plea bargain".
They could keep him on remand for a long time and try to get him to plead to Murder 2 or Manslaughter. I think that's what the authorities want.
You're right in saying they don't want people to defend themselves. He's being made an example of.

and unsure that someone has the means to continuing their original assault on you, it is primitive nature to "finish the job." The military teach "3" round bursts and assault troops like "Seals" use the double tap to the chest and one to the head. It is the standard. This Dr. should go free and praised for standing up to (what is going to be more) thuggery and assault and murder attempts on law abiding people. Too bad for the dumbass.

I experienced something like that
I was fighting as part of an organized sport and knocked out my opponent. Any reasonable person would have realized a scream and kicking from an unconscious person was convulsions, but some part of my brain interpreted it as outrage and I had a hard time complying with the proper etiquette in that situation which was to turn your back and kneel because some part of my brain wouldn't let go of the notion that a revenge attack was on its way. I guess that would beg the question of how he could turn his back in the video, then, huh?

I've never tried to murder anyone, but I believe that there is an almost automatic desire to finish the job when one is in that state of mind.
As far as I am concerned, anything that happens in the next few minutes should be considered one act, not several separate acts. This is also true of hit-and-runs where the perpetrator turns himself in within a few minutes or hours.
It is what someone does after they panic that shows who they are, and someone who takes responsibility after calming down should be given some leniency, or, as in this case, where it was fear for his life that put him into that state in the first place. He didn't cause the situation..
Whenever I see the prosecution call these situations "cold-blooded" because of the number of shots or stab wounds, or whatever, I realize they are simply ignoring how long it takes for fear hormones to clear from the body.
This is another good reason for us to serve on juries. If I were in this situation, I certainly hope I would not be treated like a robber who killed someone, when I was, in fact, the victim.
For me, the key question is, would he do it again? Did he learn something? Was it an overreaction due to PTSD? None of us knows how we will react until it happens to us. Balance is called for.
