Patent Act of 1790 - constitutional?

The only way I can see this being constitutional is through the power to regulate commerce:
[3] To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
However, from Ron Paul:
"The framers of the Constitution intended the interstate commerce clause to create a free trade zone among the states, not to give the federal government regulatory power over every business that has any connection with interstate commerce."

Seems to me it *would* be covered with the commerce clause, but Ron Paul seems to disagree with this statement.
