The language is you need to have "support" of five State delegations.

Meaning you need to have a majority of the delegates from 5 States support you.

It is certainly possible to have such majorities of actual delegates without having "won" their straw poll be it via primary or caucus poll.

There may even be a question of that since if delegates are technically free agents according to the RNC, if Paul can prevent Mitt or anyone else from getting majority of ACTUAL delegates in five States, then he can prevent them from being considered for the nomination. Though, this would mean he himself would need majorities from 38 States to accomplish this.
