What if government is acting without Congressional approval?

Or under the terms of the Patriot Act issuing secret warrants that cannot be reported by the victims?

Without a Court that will issue a Declaratory statement on the unconstitutionality of the 666 Act (renamed and passed as the Patriot Act0 where do we stand?.
