We, the People of the United States...ordain and establish this Constitution for the United States of America.
That is letter for letter, word for word, no where in that declaration does the people subject themselves to the Constitution but they do subject those members of the United States of America.
7th Amendment
In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.
Word for word that is the 7th amendment and it specifically states to use common law to resolve disputes.
In fact Commentaries on the Laws of England by Sir William Blackstone is still quoted 5-7 times per year in front of the SCOTUS in our modern times.
