You know, I do give the SC a pass. I give Roberts a pass. I this kind of issue, there is tremendous precedent, and the court system is built on that. Otherwise, the law will become subject to the fancies of a few people of power (more than it is even now).
I mean, come on. Scalia and Thomas voted against it; is there any doubt that it was purely a political vote and not based on philosophy?
A justice has to balance his view of the Constitution, with the history of the court. When you have less of a history; when you have new issues being brought up, then justices can make their mark on history and let their interpretation stand out. Its been a hundred years, if not more, since the Supreme Court expanded the role of the federal government, and it would be wrong for a group of 9 people to just overturn that overnight, no matter how correct we think they are, nor how good that decision would be..
