Geez. Ive heard of this case and dont think the guy should be charged. that is ridiculous. But it serves as a caution to others. if you are going to conduct an interview over the phone, be sure to not only get their consent to record, but once you get it, get it again on audio. Otherwise, the party may later claim that they did not give consent.
In this case, obviously if the guy got consent, he would not have released the story if he had taped the convo illegally. only a jury of idiots would convict him. The state os going after him because they dont like people who stand against corrupt cops.
